French court system control board and its contribution to the construction of the democratic legal state
Francuski sistem sudske kontrole uprave i njegov doprinos izgradnji demokratske pravne države
Апстракт
In this paper, attention is paid to the French system of judicial control of the administration, the so-called system of special administrative courts and its contribution to the building of a democratic state of law. The introduction presents the basic notes on the administrative dispute and its significance. It then discusses the role of the State Council, the civil courts, administrative and appellate courts, administrative control authorities. This is followed by the analysis of the main institute administrative proceedings in French law. Paper closes with a discussion of the advantages and disadvantages of this system of administrative control and contribution in building democratic legal state in the European territory.
U ovom radu pažnja je posvećena francuskom sistemu sudske kontrole uprave, tzv. sistemu posebnih upravnih sudova i njegovom doprinosu u izgradnji demokratske pravne države. U uvodu se daju osnovne napomene o upravnom sporu i njegovom značaju. Zatim se razmatra uloga Državnog saveta, redovnih sudova, upravnih i apelacionih upravnih sudova u kontroli uprave. Posle toga sledi analiza osnovnih instituta upravnog spora u francuskom pravu. Rad se završava zaključnim razmatranjima o prednostima i nedostacima ovog sistema kontrole uprave i njegovom doprinosu u izgradnji demokratskih pravnih država na evropskom prostoru.
