abstract = "Деценијама уназад, научно засновани налази из области психологије доследно показују да
човек, као извор доказа добијених на основу препознавања лица, може бити веома
непоуздан. Иако се квалитет изворног памћења лица које обавља препознавање другог лица
не може значајно унапредити, употребом научно неутемељених поступака, оно може бити
деградирано у значајној мери.
Радња препознавања лица се у Републици Србији превасходно спроводи када је потребно
да се провери сећање презумптивног сведока (оштећеног или очевица) о учиниоцу
кривичног дела, Налази дисертације показују да криминалистичко-тактичко поступање
српске полиције, приликом припреме и обављања препознавања лица у предистражном
поступку и истрази, није у складу са релевантним научно заснованим препорукама. Између
осталог, полиција није дужна да сведоку саопшти никакво упутство пре почетка
препознавања, па ни непристрасно упутство којим се он упозорава да је могуће да учинилац
није присутан у линији. Такође, полиција може сведоку саопштити и пристрасно упутство,
којим се ствара или појачава његово уверење да је стварни учинилац идентификован од
стране полиције и да је његов задатак да га пронађе у линији и изврши позитивно
препознавање.
Налази експеримента спроведеног за потребе дисертације јасно показују негативан утицај
пристрасног упутства на тачност препознавања. Практичне импликације овог налаза су да
полиција не сме да ствара и појачава уверење сведока да се у линији засигурно налази
учинилац кривичног дела и да треба да му саопшти да је слободан да донесе било коју
одлуку, па и да одбаци линију, тј. да не изабере ниједног члана линије. Уколико полиција
то не учини, повећава се вероватноћа да ће сведок покушавати да „пронађе“ учиниоца међу
показаним лицима у линији, што ће имати нарочито штетне последице уколико се у линији
налази невини осумњичени (а не учинилац), јер сведоци начелно имају потешкоће да
препознају одсуство учиниоца у линији. Када невини осумњичени у значајној мери личи на
учиниоца кривичног дела, код сведока се појачава тенденција да га погрешно изабере, иако
се не уклапа у потпуности са његовим сећањем о учиниоцу. Под утицајем пристрасног
упутства, сведок може изабрати и неког другог члана линије (тзв. ометача).
Неодговарајуће поступање органа поступка узроковано је пропустом законодавца да, на
јасан и свеобухватан начин, појмовно одреди радњу препознавања лица и поступке који се
користе приликом њене припреме и обављања. То значи да не постоји ни квалитетна основа
за оцену веродостојности сведока и поузданости добијених резултата. Последично,
истраживање судске праксе показује да суд не разматра доказ добијен на основу
препознавања довољно обазриво, водећи рачуна о поступцима који су коришћени у сврхе
његовог прикупљања.
Налази дисертације јасно указују да је потребно спровести значајну реформу у области
препознавања лица у Републици Србији, која би подразумевала инкорпорирање научно
заснованих препорука у текст процесног закона. Стога, у дисертацији су предложене измене
и допуне које је потребно спровести, како би поступање органа поступка у предистражном
поступку и истрази било у складу са научно заснованим стандардима за прикупљање,
чување и интерпретацију доказа у вези са препознавањем лица., For decades, evidence-based findings in the field of psychology consistently indicate that a person,
as a source of identification evidence, may be highly unreliable. Although the quality of the
original memory of the person performing identification of another person cannot be significantly
improved, it is possible that, due to the scientifically unfounded actions taken, it may be degraded
to a significant extent.
In the Republic of Serbia, the action of identification of persons is primarily conducted when it is
necessary to test the memory of a presumptive witness (victim or eyewitness) about the perpetrator
of a criminal offense. The findings of the dissertation indicate that criminalistics-tactics actions of the
Serbian police, during preparation and conduction of the identification of persons in the pre-
investigation proceedings and investigation, are not in accordance with the relevant scientifically
based recommendations. Among other things, the police have no duty to provide the witness with
any instruction before starting the identification, so neither an unbiased instruction warning the
witness that it is possible that the perpetrator is not in a lineup. Also, the police may provide the
witness with biased instruction, which forms or reinforces his belief that the actual perpetrator has
been identified by the police and that his task is to find him in a lineup and to make a positive
identification.
The findings of the experiment conducted for the purposes of dissertation clearly indicate the
negative impact of biased lineup instruction on identification accuracy. The practical implications
of this finding are that the police must not form or reinforce the witness's belief that the perpetrator
is certainly in a lineup and that they should inform him that he is free to make any decision, even
to reject a lineup, i.e., does not select any lineup member. If the police do not do this, the
probability that the witness will try to “find” the perpetrator among the shown persons in а lineup
increases, which will have particularly harmful consequences if there is an innocent suspect (not
the actual perpetrator) in a lineup, because witnesses generally have difficulty recognizing the
absence of the perpetrator in a lineup. When an innocent suspect has a significant resemblance to
the perpetrator, the witness has an increased tendency to wrongly choose him, even though it does
not completely match his memory of the perpetrator. Under the influence of biased instruction, the
witness can also choose another member of the lineup (the so-called filler).
Inadequate acting of the authority conducting proceedings was caused by the legislator's failure to
conceptually determine action of the identification of persons and procedures used during its
preparation and conduction, in a clear and comprehensive manner. This means that there is no
quality basis for assessing the credibility of witnesses and the reliability of the results obtained.
Consequently, the research of the case law indicates that the court does not consider the
identification evidence carefully enough, considering the procedures that were used for the
purpose of obtaining it.
The findings of dissertation clearly indicate that it is necessary to implement a significant reform
in the field of the identification of persons in the Republic of Serbia, which would imply the
incorporation of scientifically based recommendations into the text of the procedural law.
Therefore, this dissertation proposed the amendments and additions that need to be implemented,
so that the actions of the authority conducting pre-investigation proceedings and investigation, are
in accordance with scientifically based standards for the collection, preservation, and interpretation
of the identification evidence.",
