Detention in the criminal procedure legislation of Serbia and experiences of the public prosecutor’s office for organized crime - (non) compliance with European standards?

AB  - Freedom as one of the key values in a democratic society is limited by the contemporary needs of protecting the individual from arbitrariness and illegality, regardless of the sphere of social life in which the individual exists. This freedom, in our case freedom of movement, is determined by legal boundaries, both from the aspect of the national framework and international standards. Namely, present-day states set the realization of human rights as one of the main goals, but also the possibility of restrictions due to necessity in a democratic society and with a restrictive approach to the basis of legal restrictions, in this case restrictions on the right to freedom and security of person. In accordance with that, the paper critically analyses the adequacy of positive legal norms that regulate detention in Serbia and research was conducted in the Prosecutor’s Office for Organized Crime. In the conducted research, for the purpose of collecting primary data, a specially designed instrument was used - a survey questionnaire consisting of 7 questions. The aim of the research is to consider the adequacy of the legal norm and the efficiency of its application when it comes to the measure of detention, but also to identify problems in practice when determining the said measure. The results of the research indicate that the reform of the measure of detention is necessary, not only from the aspect of the national framework, but also the degree of harmonization with contemporary comparative criminal procedure legislation and European standards of deprivation of liberty.
AB  - Слобода као једно од кључних вредности у демократском друштву ограничена је савременим потребама заштите појединца од произвољности, незаконитости, без обзи ра у којој сфери друштвеног живота појединац егзистира. Наведе на слобода, у нашем случају слобода кретања је одређена законским границама и то како посматрано са аспекта националног оквира тако и међународних стандарда. Наиме, савремене држа ве као један од главних циљева постављају остварење људских права, али исто тако и могућност ограничења из разлога неоп хо дности у демократском друштву и уз рестриктивни приступ основа законитог ограничења, у овом случају ограничења права на слободу и безбедност личности. У складу са тим, у раду је критички анализирана адекватност позитивноправних норми које регу лишу меру притвора у Србији и спроведено је истраживање у Тужилаштву за организовани криминал у Србији. У спроведеном истраживању, у сврху прикупљања примарних података кориш ћен је посебно конструисан инструмент – анкетни упитник који је био сачињен од 7 питања. Циљ истраживања је сагледавање адекватности законске норме и ефикасности њене примене када је реч о мери притвора, али и уочавања проблема у пракси приликом одређивања наведене мере. Резултати истраживања указују да је неопходна реформа мере притвора и то не само посматрано са аспекта националног оквира, већ и степена усаглашености са савременим компаративним кривичнопроцесним законодавствима и европским стандардима мера лишења слободе.

Suppression Of Organized Crime and Serbia’s Accession to the European Union

AB  - Fight against organized crime is a proactive, strategically
oriented activity of all contemporary, democratic states, both nationally
and at the international level. The set limits of more efficient suppression
of the most serious crimes are the result of active reforms of national
normative frameworks, ratified international documents, but also
intensive professional cooperation between countries in the field of
detecting, combating and prosecuting organized crime. Security threats,
which are extremely high when it comes to organized crime, would be
difficult to combat without adequate international cooperation between
democratic states. One of the countries that actively participate in
international cooperation, emphasizing cooperation with European
agencies is Serbia. Namely, there is a justified question of the efficiency
of Serbia’s cooperation with European agencies in the suppression of
organized crime, the harmonization of the national framework with the
acquis communautare, which is the goal of research in this paper. In
accordance with that, the author, through expert and critical analysis
of normative solutions, results of practical application and valid
theoretical views, analyses the subject matter from the following aspects:
first, introductory considerations; second, the effectiveness of financial
investigations and the Action Plan for Chapter 23; third, Serbia’s
cooperation with European agencies in combating organized crime and
reforming the normative framework; fourth, concluding remarks.
AB  - Борба против организованог криминалитета
представља проактивну, стратешки орјентисану активност свих
савремених, демократских држава, како унутар њених граница,
тако и на међународном нивоу. Постављене границе ефикаснијег
сузбијања најтежих кривичних дела представљају резултат ак-
тивних реформи националних нормативних оквира, ратификова-
них међународних докумената, али и интензивне, професионалне
сарадње између држава која се одвија на пољу откривања, суз-
бијања и процесуирања кривичних дела организованог криминали-
тета. Безбедносне претње, које су изузетно високог степена када
су у питању кривична дела организованог криминалитета, тешко
би се могле сузбијати без адекватне међународне сарадње демо-
кратских држава. Једна од земаља која активно учествује у међу-
народној сарадњи, истичући сарадњу са европским агенцијама је
Србија. Наиме, поставља се оправдано питање ефикасности са-
радње Србије са европским агенцијама у сузбијању организованог
криминалитета, усклађености националног оквира са европским
тековинама, што представља и циљ истраживања у овом раду. У
складу са тим, аутор кроз стручно-критичку анализу норматив-
них решења, резултата практичне примене и валидна теоријска
гледишта, анализира предметну проблематику са следећих аспе-
ката: прво, уводна разматрања; друго, ефикасност финансијских
истрага и акциони план за поглавље 23; треће, сарадња Србије
са европским агенцијама у сузбијање организованог криминала и
реформа нормативног оквира; четврто, закључна разматрања.

Financial Investigation and Adequacy of State Response to Property Crime : (Norm and Practice in The Republic of Serbia)

AB  - The subject matter of the paper includes criminal legal (theoretical, normative and practical) issues of financial investigation as an increasingly important instrument of adequacy of the state response to property crime. A lot of issues have been analysed and particular attention has been paid to the following issues: the notion and assumptions of the adequacy of the state response to property crime; criminal and political reasons for the necessity of conducting a financial investigation, as well as the most important features of its standardization and practical realization (conditions, subject matter and objectives, as well as the basic principles of its implementation – urgency and timeliness of the procedure, exclusion of the possibility of invoking confidentiality of data, transfer of burden of proof to the suspect, confidentiality of the collected data, etc.) At the end of the paper, the authors’ position regarding the adequacy of the analysed legal norms in terms of the desired degree of success in detecting, proving and confiscating property acquired through the commission of criminal offenses is presented.
AB  - Предмет анализе у раду су кривичноправна (теоретска, нормативна и практича) питања финансијске истраге као све значајнијег инструмента адекватности државне реакције на криминалитет с имовинским обележјем. Међу немалим бројем анализираних питања посебна пажња је посвећена питањима која се тичу: појма и претпоставки адекватности државне реакције на криминалитет с имовинским обележјем; криминално-политичких разлога неопходности спровођења финансијске истраге као и најважнијих особености њеног нормирања и практичне реализације (услова, предмета и циља, као и основних начела њеног спровођења - хитност и благовременост поступања, искључење могућности позивања на тајност података, пребацивање терета доказивања на осумњиченог, поверљивост прикупљених података и др). На крају рада изнет је став аутора по питању адекватности анализираних законских норми за жељени степен успешности откривања, доказивања и одузимања имовине стечене вршењем кривичних дела.

Pre-crime concept as an effective instrument of penalty policy for the crime of domestic violence – new challenges for Serbia

AB  - Contemporary tendencies of criminal procedure legislation in general, including criminal
procedure legislation of Serbia, have been increasingly emphasizing the importance of the
implementation of the preventive aspect of criminal policy. One such general trend has
also been applied in Serbia when it comes to the crime of domestic violence. Namely, the
phenomenon of domestic violence is not only recognized in underdeveloped countries,
but is also widespread in the most developed countries whose legal systems are based
on the principles of democracy, the rule of law and the prohibition of discrimination.
The aforementioned trend of recognizing the existence of domestic violence in almost
all countries indicates the increasing importance of establishing adequate instruments
to combat this form of crime even more effectively, especially bearing in mind the close
relationship between the abuser and the victim and the temporal determinant of the
continued torture of the victim. Accordingly, following the European path and based
on the contemporary pre-crime concept, Serbia adopted the Law on the Prevention of
Domestic Violence setting up the police as the key subject for a more effective fight in the
field of the prevention of domestic violence. The key determinants used by the authors
in analysing the subject matter are the essential explanations of the new rules and the
criminal and political reasons for which they were established as well as their purpose.
The authors analysed them from the following aspects: first, Serbia and harmonization
with European standards for combating domestic violence (introductory considerations);
second, the police as the key subject of the penalty policy for domestic violence off enses;
third, a conducted survey of police officers and their views on the implementation of the
Law on the Prevention of Domestic Violence, fourth, conclusion.

AB  - The reformed criminal procedural legislation of the RS successfully follows the modern
trends in the criminal procedural doctrine, especially in the area of application of the

Composition of the criminal courts

AB  - The composition of a criminal court stands as one of the most interesting issues in the comparative law. Different viewpoints when it comes to the need of including non-professional citizens in the contemporary criminal procedure have contributed to interesting approaches related to regulating this issue. First of all, there are original jury systems that are a feature related mainly to the Anglo-American legal systems, but whose ideas have found their place in the European legislature as well. Furthermore, there are countries where the trial body stands as a separate authority, which consists of professional judges and lay judges, whereas some of the countries have both professional judges and lay judges, the first being in charge of resolving legal issues, and the second ones being in charge of factual issues. There are many articles devoted to the jury systems in the world, but in a very small proportion of them we could find solutions from the mixed court of the Balkan countries. Mixed court is one of the features continental countries. The authors compare Balkan countries, where Slovenia and Croatia being the European Union Members, whereas the rest of them are in the process of accession. Thereby, some of the countries strive to get their courts become more professional by leaving out citizens non-professional from the composition of trial chamber, while some of them have kept them, whereby the scope of their jurisdiction varies from one country to another. Today, it is a great question whether a mixed court will survive legislative changes, due to the criticism of the jurists and non-jurists.
AB  - Sastav sudećih veća jedno je od najinteresantnijih pitanja današ­njice, pogotovo u vremenu velikih reformskih poduhvata. Različita shvatanja potrebe za učešćem građana-laika u savremenom krivičnom postupku doprinela su zanimljivim pristupima u regulisanju tog pitanja. Na prvom mestu, postoje pravi porotni sistemi, koji su odlika prevashodno angloameričkog pravnog sistema, ali su njegove ideje našle mesto i u evropskim zakonodavstvima. Postoje i države u kojima sudeće veće predstavlja jedno telo, sastavljeno od sudija profesionalaca i sudija porotnika, dok u pojedinim imamo, takođe, i sudije profesionalce i porotnike, ali su prvi zaduženi za rešavanje pravnih, a drugi za rešavanje činjeničnih pitanja. Autori u radu porede strukturu sudskih veća u krivičnim postupcima za punoletna lica u pojedinim balkanskim zemljama, od kojih su, primera radi, Slovenija i Hrvatska članice Evropske unije, dok su druge u procesu pridruživanja. Neke od njih teže profesionalizaciji sudstva, izbacujući građane-laike iz sastava sudskog veća, dok su ih druge zadržale, pri čemu obim njihove nadležnosti varira od države do države.

AB  - Domestic violence is one of the most complex criminal issues, representing negation of the basic human rights and freedoms protected by a number of international documents and national legal regulations, starting with the right to life to the right to safety. The authors analyze this increasingly common form of violence (psychical, psychological, economic and sexual) as a social phenomenon that has its substantive criminal law aspect and criminal procedure aspect, neither of which eliminates the causes of its origin but only treats the consequences. Family violence primarily affects women. The authors have conducted a survey for the period of ten years of the Criminal Code application in order to examine the criminal offense of the domestic violence, procedure and perpetrators.
AB  - Nasilje u porodici predstavlja jedno od najkompleksnijih pitanja u krivičnom pravu, a koje predstavlja negaciju osnovnih ljudskih prava i sloboda zaštićenih brojnim međunarodnim i unutrašnjim pravnim dokumentima, počev od prava na život i sigurnost. Autori analiziraju ovu sve prisutniju formu nasilja (psihičkog, fizičkog, ekonomskog i socijalnog), kao društveni fenomen sa aspekta krivičnog i krivičnog procesnog prava. Porodično nasilje pre svega pogađa žene. Autori su sproveli istraživanje za vreme desetogodišnjeg važenja Krivičnog zakonika u Srbiji, s ciljem izučavanja krivičnog dela nasilja u porodici, postupka za ovo krivično delo i njegovih izvršilaca.

Main hearing according to the new Serbian Criminal Procedure Code: Survey in practice

AB  - The main hearing is the central part of the criminal procedure. In Serbia, the reform of the national criminal procedure legislation has brought about numerous changes related to this stage of criminal proceedings. Numerous objections have been addressed to the almost entirely new legal text. In an attempt to examine the advantages and disadvantages of the new legislation and observe how the prescribed rules are applied in practice, the authors have conducted an empirical research by attending 205 main hearings which were conducted under the rules of the new Criminal Procedure Code. The research covers a huge number of related issues but, given the page limit, this paper will focus on individual issues observed in trial proceedings. The focal point of reference is the examination of witness, but the authors also consider a number of other issues: the examination of expert witness, the delay of the trial, and the use of a video-link as a novelty introduced owing to the technological achievements of the modern era. The article is organized into several parts. The authors first provide a theoretical background of the issue under consideration and, then, present and discuss the research results provided in tables. In the third part of the article, the authors draw specific conclusions about the current practice in trials proceedings.
AB  - Glavni pretres predstavlja centralni deo krivičnog postupka. Reformom krivičnog procesnog zakonodavstva u Srbiji unete su, između ostalog, i brojne promene kada je u pitanju ova faza krivičnog postupka. Gotovo celokupnom novom zakonskog tekstu upućene su brojne primedbe. Usleg toga, autori su izvršili istraživanje prateći 205 glavnih pretresa koji su održani po pravilima novog Zakonika o krivičnom postupku, pokušavajući da sagledaju prednosti i nedostatke, te kako se pravila primenjuju u praksi. Budući da je za obim rada bilo izuzetno teško obraditi sva pitanja, autori su se bazirali na pojedina pitanja na glavnom pretresu. Akcenat je stavljen na ispitivanje svedoka, ali nisu zanemarena ni pitanja veštačenja, odlaganja glavnog pretresa, te upotrebe video-linka, kao novine zahvaljujući tehničkim dostignućima savremenog doba. Autori rad dele u više celina, teoretski obrazlažući pitanje o kojem se bave, a potom tabelarno predstavljajući rezultate istraživanja. Na osnovu toga, na kraju rada izvode konkretne zaključke o dosadašnjoj praksi vođenja glavnih pretresa.

AB  - Considering conceptual changes in by now not-so-new Criminal Procedure Code, the authors analyze relations between the prosecutor and police from the angle of law provisions but also in their implementation in practice. The paper is divided in two main parts. After introductory remarks, the authors consider a number of theoretical issues related to fair trial in the context of balancing roles, competences and powers of various procedural subjects with focus on relations and cooperation between police and the public prosecutor. The second part of the paper includes presentation of the results arising from empirical research dedicated to implementation of the novelties in the Serbian Criminal Procedure Code related to cooperation between prosecutors and the police.
AB  - Zakonodavac je, sada ne tako novim, Zakonikom o krivičnom postupku predvideo više rešenja kojima se menja položaj procesnih subjekata u odnosu na rešenja kakva su bila predviđena s početka ovog veka. Prevashodno, glavno obeležje novog zakonskog teksta iz ove oblasti jeste drastično menjanje položaja javnog tužioca uvođenjem tužilačke istrage. Time je i položaj policije unekoliko promenjen, te je bilo neophodno sprovesti praktično istraživanje o odnosima ova dva procesna subjekta za prve tri godine primene Zakonika o krivičnom postupku. Stoga, nakon teorijskog uvodnog dela, glavni deo rada se odnosi na rezultate istraživanja sprovedenog među pripadnicima policije.

AB  - Докторска дисертација под називом Лишење и ограничење слободе од странеполиције превасходно се бави криминално-политичким, теоријским, нормативно-правним и практичним питањима полиције као неизоставног субјекта откривања идоказивања кривичних дела и њихових извршилаца. Четири су основна циљаспроведеног истраживања: утврђивање положајa, места и улоге полиције каосубјекта лишења и ограничења слобoде једног лица, односно, сагледавањеквалитета нормативне основе правног регулисања питања која се тичу основа иначина моућности практичне реализације права полиције да одређено лице лишислободе и да га ограничи у другим његовим правима; затим, утврђивање степенаусаглашености позитивног кривичног законодавства Србије, саопштеприхваћеним стандардима по питању могућности, обима и условаограничавања слобода и права грађана од стране полиције, као једног од важнијихсубјеката оваквог једног овлашћења; потом, испитивање практичног поступањаполиције у примени мера лишења и ограничавања слобода и права грађана уРепублици Србији, а у оквиру тога, пре свега обима и законотости применетаквих њених овлашћења. На крају, један од основних циљева рада надисертацији јесте давање предлога de lege ferenda у два правца. У правцуповећања степена заштите слобода и права грађана уопште, а посебно са аспектаовлашћења полиције у случајевима њиховог ограничавања. Односно,усаглашавање позитивног кривичног процесног законодавства Србије попитањима која представљају предмет дисертације са ратификованиммеђународним правним актима и другим општеприхваћеним међународнимстандардима из ове области, што је од посебног значаја управо у времену рада надисертацији. Ово из разлога што је у току рад на окончању реформе кривичногпроцесног законодавства Србије започете доношењем Законика о кривичномпоступку из 2001. године, а једно од важнијих питања те реформе јесте управопитање начина, услова и обима лишења слободе и ограничења других праваграђана као субјеката кривичног поступка уопште, а тиме и полиције.
AB  - Doctoral dissertation entitled Deprivation and restriction of liberty is primarilyconcerned with criminal, political, theoretical, normative- legal and practical issues ofthe police as an obligatory subject of discovering and proving criminal acts and theirperpetrators. There are four main goals of the research: determining the position, theplace and role of the police as the subject of deprivation and restriction of liberty of aperson, that is, evaluating the quality of the legal normative basis regulating issuesregarding the basis and manner, Possibility to practical realization of the right of policeto apprehend a certain person and restrict it in his or her other rights; Then, determiningthe degree of harmonization of the positive criminal legislation of Serbia with thegenerally accepted standards in terms of features, size and operating conditionsrestricting the rights and freedoms of citizens by the police, as one of the importantsubjects such an authorization; Then, testing the practical conduct of the police in theimplementation of measures of deprivation and restriction of freedoms and rights ofcitizens in the Republic of Serbia, and in this framework, notably the scope andapplication of such a principle of its powers. Finally, one of the main goals of the thesisis to make proposals de lege in two directions. In the direction of increasing the level ofprotection of freedoms and rights of citizens in general, particularly in terms of thepowers of the police in cases of their restriction. In other words, harmonization of thepositive criminal procedure of legislation in Serbia on matters which were the subject ofthe dissertation with ratified international legal acts and other generally acceptedinternational standards in this field, which is of particular importance in the time in thethesis. This is because the ongoing work on the finalization of the reform of criminalprocedure legislation in Serbia started the adoption of the Code of Criminal Procedurein 2001, And one of the most important issues of this reform is the very issue of theway, the conditions and the scope of his detention and other restrictions on the rights ofcitizens as subjects of criminal procedure , and therefore the police.

AB  - Contemporary trends in criminal procedure legislation are deliberately looking for efficiency as well as the instruments of implementation of international standards both in its quantitative and qualitative aspects. Doctrinal considerations find their footing in the decades-long reform of criminal procedural legislation of the Serbia, whereas the question that has always represented one of the most significant characteristics of criminal procedural legislation in general is the correlation between the public prosecutor and the police and its contribution to the efficiency of criminal proceedings. Serbia adopted new Criminal Procedure Code in 2011, which entered into the force during the 2013. According to the abovementioned, the authors pay special attention to the following issues: first, the notion of the police and the police functions; secondly, the correlation of the public prosecutor and the police as a factor in the efficiency of criminal proceedings; thirdly, empirical research and proposals de lege ferenda.
AB  - Savremeni trendovi u krivičnoprocesnom zakonodavstvu tendenciozno tragaju za instrumentima realizacije efikasnosti kao međunarodni standard i to u svom kvantitativnom i kvalitativnom aspektu. Doktrinarna razmatranja svoje uporište pronalaze u višedecenijskoj reformi krivičnoprocesnog zakonodavstva Srbije, a pitanje koje je oduvek predstavljalo jedno od značajnijih obeležja krivičnoprocesnog zakonodavstva uopšte je i korelacija javnog tužioca i policije i njen doprinos efikasnosti krivičnog postupka. U skladu sa navedenim, autori posebnu pažnju posvećuju sledećim pitanjima: prvo, pojam policije i policijske funkcije; drugo, korelacija javnog tužioca i policije kao faktor efikasnosti krivičnog postupka; treće, empirijsko istraživanje i predlozi de lege ferenda.

AB  - The authors in the work deal with the trial process against members of the Young Bosnia for the assassination of the Austro-Hungarian heir Archduke Franz Ferdinand and his wife Sophie Chotek in Sarajevo 1914. That issue attends scientific and lay public attention over the hundred years. Authors divided their article into few parts. After the introductory remarks they explain conditions in the country before the assassination, especially problem of the Bosnia and Herzegovina's annexation and its ratification within the Austro-Hungarian legislation. After that, they remind on the ultimatum that the Dual Monarchy referred to Serbia, which was not accepted, but which 'caused' the First World War. The main part of the work is dedicated to the criminal proceeding against the Young Bosnians. They analyze criminal procedure in that time, behavior of the participants, especially president of the judicial council, and defense attorneys, which was shameful, except the defense of the Dr. Rudolf Cistler. Consequently, he had borne numerous negative consequences after the judgment.
AB  - Autori u radu razmatraju suđenje pripadnicima Mlade Bosne za ubistvo austrougarskog prestolonaslednika Franca Ferdinanda i njegove supruge Sofije Hotek u Sarajevu 1914. godine, budući da to pitanje i nakon više od sto godina zaokuplja pažnju stručne i laičke javnosti. Autori su rad podelili u više celina, jer je nakon uvodnih razmatranja bilo nužno prikazati uslove u državi pre atentata, a prevashodno problem aneksije Bosne i Hercegovine i njene ratifikacije u okviru austrougarske legislative. Nakon toga su u kratkim crtama podsetili na ultimatum koji je Dvojna monarhija uputila Srbiji, koji nije prihvaćen, posle čega je došlo do izbijanja Prvog svetskog rata. Centralni deo rada autori su posvetili krivičnom postupku protiv Mladobosanaca, analizirajući tadašnji postupak, ponašanje učesnika, a pogotovo predsednika sudećeg veća i branilaca okrivljenih, gde je jedina hvale vredna odbrana pripadala dr Rudolfu Cistleru, usled čega je snosio mnogobrojne negativne posledice nakon okončanja postupka.

AB  - End of the XX century showed that almost all European countries have failed in the suppression of the crime. As a result, they began to seek new legal institutes to establish new mechanisms for efficient resolution of criminal cases. First of all, they stand out plea agreement, which in some countries inevitably follows the system of real jury trial. Among them, France stands out as a country with a long tradition of citizens' participation in criminal proceedings. Specifically, in this country jury trial takes place more than two hundred years, and was created on the model of English jury. However, almost immediately began the process of separating and distinguishing jury trials in these geographically close states. As it is case today, it is almost impossible to take a legal institute from one state and implement it in the legislation of another state in the same form. So, the English type of jury underwent to the adjustments to the French criminal procedure. That is the best illustrated with the numerous legislative acts adopted in the meantime, through which the jury experienced constant transformation. Since it is one of the oldest jury systems in the world, the author paid the attention to it in this work. The author deals with several units and after the introduction remarks he will explain the position and the role of lay judges in criminal proceedings. Then, he gives a cross-section of their position through the development of this type of trial. After that, he analyzes a jury according to positive French law. Also, throughout the paper provides a comparative analysis of some elements of this type of trial, and on the end he gives a concluding remarks.
AB  - Kraj XX veka je pokazao da su skoro sve evropske zemlje doživele neuspeh u suzbijanju kriminaliteta. Usled toga, proučavajući uporedno pravo, zakonodavci su počeli da traže pravne institute kako bi uspostavili nove mehanizme efikasnijeg rešavanja krivičnih predmeta. Kao pravni transplantat koji je zaživeo u skoro svim evropskim državama izdvaja se sporazum o priznanju krivičnog dela, koji u pojedinim neizbežno prati sistem pravog porotnog suđenja. Među njima, Francuska predstavlja državu s dugom tradicijom učešća građana u krivičnim postupcima. U ovoj zemlji porotno suđenje se odvija duže od dvesta godina, a nastalo je po ugledu na engleski porotni sud. Međutim, kao što je to slučaj i danas, gotovo je nemoguće jedan pravni institut preuzeti iz jednog zakonodavstva i implementirati u drugo u istom obliku, pa je tako i porotni sistem suđenja doživeo prilagođavanja francuskom krivičnom postupku. O tom najbolje svedoče mnogobrojni zakonski akti doneti u međuvremenu, putem kojih je porota doživljavala konstantne transformacije. U ovom radu autori obrađuju više celina. Nakon uvodnih napomena o porotnom suđenju objašnjuju položaj i ulogu porotnika u krivičnom postupku. Potom daju presek njihovog položaja kroz razvoj ovog tipa suđenja, da bi posle analizirali porotu prema pozitivnom francuskom pravu. Takođe, kroz ceo rad daje se i komparativna analiza pojedinih elemenata ovog oblika suđenja, a na kraju su data zaključna razmatranja u kojima autori na jedan rezimirani način sumiraju rezultate do kojih su došli u proučavanju predmetne problematike.

AB  - The authors in the work deal with the plea agreement in the international law - before the Tribunal for the former Yugoslavia. International law, which is glorified from the one side, and criticized for the other, gradually developed in the field of criminal procedure. This development is, however, largely influenced by political factors, which can be best seen in the proceedings before the Tribunal, where the individual rules are created during the criminal proceedings and particular amendments, followed by implementation of American legal solutions, despite all critics of the same rules in that system, as well as different opinions of the trial judges in the Tribunal. After the introductory remarks, the authors explain the legal basis of the plea bargaining. Then, they explain the majority of criminal cases in which occurred guilty plea. Through these cases, the authors came to the conclusion that, although in the national legal systems plea negotiation and plea agreement contributes to the efficiency of the criminal proceedings, briefly prescribed legal rules for its conclusion and application before the Tribunal once again proved a distinct selectivity in the delivering of justice in this area of international law.
AB  - Autori u radu obrađuju sporazum o priznanju krivičnog dela u međunarodnom pravu, i to pred Tribunalom za bivšu Jugoslaviju. Međunarodno pravo, koje se sa jedne strane glorifikuje, a sa druge kritikuje, postepeno se razvilo i u domenu krivičnog procesnog zakonodavstva. Ovaj razvoj je, ipak, pretežno bio uslovljen političkim faktorima, što se najbolje može videti u postupcima pred Tribunalom, pred kojim su pojedina pravila postupka krojena za vreme trajanja krivičnog postupka, praćena implementiranjem zakonskih rešenja iz američkog prava uprkos svim kritikama upućenim istim pravilima u ovom sistemu, kao i različitim mišljenjima sudija u Tribunalu. Nakon uvodnih razmatranja, autori su objasnili zakonske osnove zaključenja sporazuma o priznanju krivičnog dela, a potom obrazložili većinu krivičnih predmeta u kojima je došlo do priznanja krivice. Kroz te krivične postupke autori su došli do zaključka da, iako u nacionalnim pravnim sistemima pregovaranje o priznanju krivice i zaključenje nagodbe doprinosi efikasnosti krivičnog postupka, šturo propisivanje pravila njenog zaključenja, a potom i njihova primena, još jednom su dokazali izrazitu selektivnost u deljenju pravde pred Tribunalom.

AB  - The topic of this article is a critical analysis of professional issues in the investigation of the concept of reform of the criminal procedure legislation in Serbia which is still ongoing. Underlying issues have been analyzed from three aspects. First, general comments about the investigation and its relevance to criminal proceedings are provided and within those the issues for a long period of criminal procedure discussed in theory and practice are specifically emphasized. For example, there is a case to investigate the relationship between the concept and its effectiveness and thus the efficiency of the process as a whole. The second aspect of analyzed issues consist of questions related to the concept of prosecutorial investigation as an essential feature of the process of reform of the criminal procedure legislation in Serbia, where arguments of prosecutorial justification of the concept of judicial investigation have primarily been analyzed along with the principles by which a legislator should be guided in the standardization of the prosecutorial concept of investigation. Finally, the third - and the key aspect consists of the issues related to review of normative elaboration of the concept of prosecutorial investigation into the new RS CPC and the draft Law on Amendments to the legal text available to Serbian expert public, and not just Serbian. The main conclusion of expert critical analysis of this group of questions that are still in the draft of the Law on Amendments to the CPC concept of prosecutorial investigation in Serbia develops in a way that is consistent with the efforts of the majority of experts in Serbia and not only Serbia.
AB  - Predmet analize u radu je stručno-kritička analiza pitanja koncepta istrage u procesu reforme krivičnog procesnog zakonodavstva Srbije koja je još uvek u toku. Predmetna pitanja analizirana su sa tri aspekta. Prvo su date opšte napomene o istrazi i njenom značaju za krivični postupak i u okviru istih su posebno apostrofirana pitanja koja su već duži period predmet rasprave kako krivičnoprocesne teorije tako i prakse. Slučaj npr. sa pitanjem odnosa koncepta istrage i njene efikasnosti a time i efikasnosti krivičnog postupka kao celine. Drugi aspekt analizirane problematike čine pitanja tužilačkog koncepta istrage kao bitnog obeležja procesa reforme krivičnog procesnog zakonodavstva Srbije, i u istom su pre svega analizirani argumenti opravdanosti tužilačkog nad sudskim konceptom istrage i načela kojima treba da se rukovodi zakonodavac u normiranju tužilačkog koncepta istrage. Na kraju, treći - ključni aspekt čine pitanja prikaza normativne razrade tužilačkog koncepta istrage u novom ZKP RS i u Radnoj verziji Zakona o izmenama i dopunama ovog zakonskog teksta dostupnoj stručnoj javnosti Srbije i ne samo Srbije. Osnovni zaključak stručno-kritičke analize ove grupe pitanja je da se tek u Radnoj verziji Zakona o izmenama i dopunama ZKP tužilački koncept istrage u Srbiji razrađuje na način koji je u skladu sa većinskim zalaganjima stručne javnosti Srbije i ne samo Srbije.

AB  - The role of the police in informing the public on proceeding in criminal cases is discussed in this paper. International standards and current national legislative solutions in this field are presented. When discussing the chosen issue, we have been especially focused on the protection of particular rights such as the right of the public to be informed about police activities and the rights of the persons handled by the police. By fulfilling one of their obligations, based upon the requirement to act transparently, the members of the police can appear as the violators of guaranteed human rights and freedoms. In this context, we primarily refer to the right to fair trial and the right to privacy. Besides, due to withholding the information on its work, the police can be accused of violating the right of the freedom of expression, i. e. the right of the public to be familiar with police activities in general, including those conducted in criminal cases as well. Therefore, establishing a balance between these rights represents a task of current international and national legal provisions. The judicial practice of the European Court of Human Rights, whose most important decisions are presented in this paper, offers an immeasurable contribution to the establishment of an adequate legal framework for this issue.
AB  - U radu je obrađena uloga policije u informisanju javnosti o postupanju u krivičnim stvarima. Predstavljeni su međunarodni standardi i nacionalna pozitivnopravna rešenja u ovoj oblasti. Poseban interes u obradi izabrane problematike iskazali smo na polju zaštite određenih prava, kao što su pravo javnosti da bude obaveštena o policijskim aktivnostima i pravima određenih lica prema kojima policija postupa. Ispunjavajući jednu od svojih obaveza koja se bazira na potrebi transparentnog postupanja, policija se može naći u poziciji prekršioca nekog od garantovanih ljudskih prava i sloboda. Ovde, pre svega imamo u vidu pravo na pravično suđenje i pravo na privatnost. Takođe, uskraćivanjem informacija o svom radu policija može biti optužena da krši pravo na slobodu izražavanja, odnosno pravo javnosti da bude upoznata sa policijskim postupanjem uopšte, pa i u krivičnim stvarima. Stoga je uspostavljanje balansa između uživanja ovih prava zadatak pozitivne međunarodne i nacionalne pravne regulative. Nemerljiv doprinos adekvatnoj zakonskoj regulativi predmetne problematike pruža i praksa Evropskog suda za ljudska prava, čije smo neke od najvažnijih odluka predstavili u ovom radu.

The judicial practice of the European Court of Human Rights, whose most important decisions are presented in this paper, offers an immeasurable contribution to the establishment of an adequate legal framework for this issue., U radu je obrađena uloga policije u informisanju javnosti o postupanju u krivičnim stvarima. Predstavljeni su međunarodni standardi i nacionalna pozitivnopravna rešenja u ovoj oblasti. Poseban interes u obradi izabrane problematike iskazali smo na polju zaštite određenih prava, kao što su pravo javnosti da bude obaveštena o policijskim aktivnostima i pravima određenih lica prema kojima policija postupa. Ispunjavajući jednu od svojih obaveza koja se bazira na potrebi transparentnog postupanja, policija se može naći u poziciji prekršioca nekog od garantovanih ljudskih prava i sloboda. Ovde, pre svega imamo u vidu pravo na pravično suđenje i pravo na privatnost. Takođe, uskraćivanjem informacija o svom radu policija može biti optužena da krši pravo na slobodu izražavanja, odnosno pravo javnosti da bude upoznata sa policijskim postupanjem uopšte, pa i u krivičnim stvarima. Stoga je uspostavljanje balansa između uživanja ovih prava zadatak pozitivne međunarodne i nacionalne pravne regulative. Nemerljiv doprinos adekvatnoj zakonskoj regulativi predmetne problematike pruža i praksa Evropskog suda za ljudska prava, čije smo neke od najvažnijih odluka predstavili u ovom radu.",

AB  - This paper deals with the relationship between police and other subjects of pre-trial process and its impact at the efficiency of criminal process in both qualitative and quantitative manner. Accordingly, the subject-matter has been analyzed through three groups of questions. First, it is concerned with general remarks about pre-trial proceeding, its subjects and concrete actions and particularly, its importance for the decision of public prosecutor to press charges or stop the conviction. Furthermore, within the second group of issues, the author analyzes the concept, importance and factors of the efficiency of pre-trial process emphasizing the significance of mutual relations between participating subjects for its efficiency. Besides, author points out to other factors of efficiency such as: diversion principle, complexity and seriousness of a criminal case, legal provision, organization of the subjects of pre-trial process, misuse of law, number of crime reports, etc. The third group of questions is devoted to the relation between police and other subjects in pre-trial process (mainly public prosecutor and investigative judge) and the influence of this relation to its efficiency. Also, legal solutions for mutual relations between police, public prosecutor and other subjects of pre-investigative and investigative procedure proposed in Draft Criminal Procedure Code have been analyzed respectively. Finally, author gives concluding remarks and de lege ferenda suggestions developed in the course of researching this issue.
AB  - U radu je obrađena problematika odnosa policije i drugih subjekata pretkrivičnog postupka i njenog uticaja na njegovu efikasnost shvaćenu u kvalitativnom i kvantitativnom smislu reči. Posmatrano u tom kontekstu, u radu je predmetna problematika analizirana kroz tri grupe pitanja. Prva grupa pitanja je posvećena opštim napomenama o pretkrivičnom postupku, subjektima i radnjama i njegovom značaju za donošenje odluke javnog tužioca o pokretanju ili nepokretanju krivičnog postupka u datoj krivičnoj stvari. Nakon ovog, u drugoj grupi pitanja analiziran je pojam, značaj i faktori efikasnosti pretkrivičnog postupka i u okviru iste je posebno ukazano na značaj međusobnog odnosa subjekata pretkrivičnog postupka kao faktora njegove efikasnosti. Pored ovog, u radu je ukazano i na druge faktore efikasnosti kao što su: načelo oportuniteta, složenost i težina konkretnog krivičnog predmeta, zakonska norma, organizacija subjekata pretkrivičnog postupka, zloupotreba prava, broj podnetih krivičnih prijava i dr. Treća grupa pitanja je posvećena odnosu policije i drugih subjekata pretkrivičnog postupka (prevashodno javnog tužioca i istražnog sudije) i uticaju njihovog odnosa na efikasnost pretkrivičnog postupka, kao posebnom i značajnom faktoru efikasnosti. U okviru ove grupe pitanja analizirana su i rešenja međusobnog odnosa policije, javnog tužioca i drugih subjekata predistražnog i istražnog postupka prema rešenjima datim u Radnoj verziji ZKP RS. Na kraju rada data su zaključna razmatranja i predlozi de lege ferenda do kojih se došlo u proučavanju predmetne problematike.

Opportunistic principles of the criminal prosecution

AB  - The subject of elaboration of this essay would be the certain questions that are characteristic for the opportunistic principles of the criminal prosecution in general. From the aspect of the content, all those questions are grouped into six categories and conclusion remarks, given at the end of this work. In the introductory remark, the author has pointed at the significance of the opportunistic principles of the criminal prosecution and its more frequent presence in the criminal procedure legislation generally. Afterwards, the author is analyzing questions concerning the premise and the type of these principles, not only in our, but in the criminal procedure legislation in general (e.g. the case of German criminal procedure legislation which draw the author's particular attention). Third group of questions is designated to the justification of reasons and the purpose of the existence of these principles. In this chapter, the author provides full evidences and complete justification for the existence of principles using firm arguments and concurrently appeals for its more expansive implementation in our prosecutorial practice. The topic of the opportunistic principles of the criminal prosecutor for adult offenders is elaborated in the fourth part of this essay. Two subgroups of issues are perceived by the author in this section. First subgroup of issues is addressing the possibilities for the postponement of the criminal prosecution under the certain conditions, further followed by the rejection of a criminal complaint, excluding the right for the injured party to undertake the criminal prosecution. Second subgroup is analyzing possibilities for the rejection of a criminal complaint, without any prior orders towards the suspect, and excluding the right for the injured party to undertake the criminal prosecution. The opportunistic principles of the criminal prosecution against the juvenile offenders are the subject of the fifth part of this essay. The final part is elaborating the other possibilities and cases in the criminal procedure legislation of Serbia, which could use the opportunistic principles of the criminal prosecution (i.e. the procedure of extradition, homologation for the criminal prosecution, and transfer of the criminal case files to a foreign state for the reason of the criminal prosecution).
AB  - Predmet razmatranja u radu su neka pitanja specifična za načelo oportuniteta krivičnog gonjenja uopšte. Posmatrano sa aspekta svog sadržaja sva ova pitanja su grupisana u šest celina i zaključna razmatranja koja su data na kraju rada. U uvodnim napomenama ukazano je na značaj načela oportuniteta krivičnog gonjenja i njegovo sve veće prisustvo u krivičnoprocesnim zakonodavstvima uopšte. Nakon ovog, u radu su analizirana pitanja koja se tiču pojma i vrsta ovog načela, i to ne samo u našem već i u krivičnom procesnom zakonodavstvu uopšte (slučaj npr. sa nemačkim krivičnoprocesnim zakonodavstvom kojem je posvećena posebna pažnja). Treća grupa pitanja posvećena je razlozima opravdanosti i svrsi postojanja ovog načela i u istoj je na jedan argumentovan način dokazana puna opravdanost njegovog postojanja i izraženo je zalaganje za njegovu veću primenu i u našoj javnotužilačkoj praksi. Načelo oportuniteta krivičnog gonjenja kod punoletnih učinilaca krivičnih dela obrađeno je u četvrtom delu rada. Dve su grupe pitanja kojima je u ovom delu autor posvetio najviše pažnje. Prva se sastoji u prikazu mogućnosti odlaganja krivičnog gonjenja pod određenim uslovima a potom i odbacivanja krivične prijave bez prava oštećenog na preuzimanje krivičnog gonjenja. Druga u analizi mogućnosti odbacivanje krivične prijave bez prethodnog nalaganja bilo kakvih obaveza osumnjičenom licu, i bez prava oštećenog da nakon toga preuzme krivično gonjenje. Načelo oportuniteta krivičnog gonjenja prema maloletnim učiniocima krivičnih dela su pitanja koja čine predmet razmatranja petog dela rada, dok je njegov poslednji deo posvećen prikazu ostalih slučajeva mogućnosti korišćenja oprtuniteta krivičnog gonjenja u krivičnoprocesnom zakonodavstvu Srbije (u postupku ekstradicije, davanju odobrenja za krivično gonjenje, ustupanju krivičnih spisa stranoj državi radi krivičnog gonjenja).
