AB  - The reformed criminal procedural legislation of the RS successfully follows the modern
trends in the criminal procedural doctrine, especially in the area of application of the
measures of deprivation of liberty by the police and the limitation of the right to liberty
and security of a person. The new legal solutions in the RS (CPC/2011) are different both
in their conceptual definition, and by the entity that decides on the implementation of the
measures, which make the issue in question even more current, so the authors accordingly
paid special attention to the following issues: firstly, the police deprivation of liberty as an
international standard in the reformed criminal procedure legislation of the RS; Secondly,
court as a subject of decision on the legality of police deprivation of liberty in the RS;
Thirdly, empirical research into the implementation measures of police arrest in the RS and
suggestions of de lege ferenda.

Composition of the criminal courts

AB  - The composition of a criminal court stands as one of the most interesting issues in the comparative law. Different viewpoints when it comes to the need of including non-professional citizens in the contemporary criminal procedure have contributed to interesting approaches related to regulating this issue. First of all, there are original jury systems that are a feature related mainly to the Anglo-American legal systems, but whose ideas have found their place in the European legislature as well. Furthermore, there are countries where the trial body stands as a separate authority, which consists of professional judges and lay judges, whereas some of the countries have both professional judges and lay judges, the first being in charge of resolving legal issues, and the second ones being in charge of factual issues. There are many articles devoted to the jury systems in the world, but in a very small proportion of them we could find solutions from the mixed court of the Balkan countries. Mixed court is one of the features continental countries. The authors compare Balkan countries, where Slovenia and Croatia being the European Union Members, whereas the rest of them are in the process of accession. Thereby, some of the countries strive to get their courts become more professional by leaving out citizens non-professional from the composition of trial chamber, while some of them have kept them, whereby the scope of their jurisdiction varies from one country to another. Today, it is a great question whether a mixed court will survive legislative changes, due to the criticism of the jurists and non-jurists.
AB  - Sastav sudećih veća jedno je od najinteresantnijih pitanja današ­njice, pogotovo u vremenu velikih reformskih poduhvata. Različita shvatanja potrebe za učešćem građana-laika u savremenom krivičnom postupku doprinela su zanimljivim pristupima u regulisanju tog pitanja. Na prvom mestu, postoje pravi porotni sistemi, koji su odlika prevashodno angloameričkog pravnog sistema, ali su njegove ideje našle mesto i u evropskim zakonodavstvima. Postoje i države u kojima sudeće veće predstavlja jedno telo, sastavljeno od sudija profesionalaca i sudija porotnika, dok u pojedinim imamo, takođe, i sudije profesionalce i porotnike, ali su prvi zaduženi za rešavanje pravnih, a drugi za rešavanje činjeničnih pitanja. Autori u radu porede strukturu sudskih veća u krivičnim postupcima za punoletna lica u pojedinim balkanskim zemljama, od kojih su, primera radi, Slovenija i Hrvatska članice Evropske unije, dok su druge u procesu pridruživanja. Neke od njih teže profesionalizaciji sudstva, izbacujući građane-laike iz sastava sudskog veća, dok su ih druge zadržale, pri čemu obim njihove nadležnosti varira od države do države.

Domestic violence in Serbia

AB  - Domestic violence is one of the most complex criminal issues, representing negation of the basic human rights and freedoms protected by a number of international documents and national legal regulations, starting with the right to life to the right to safety. The authors analyze this increasingly common form of violence (psychical, psychological, economic and sexual) as a social phenomenon that has its substantive criminal law aspect and criminal procedure aspect, neither of which eliminates the causes of its origin but only treats the consequences. Family violence primarily affects women. The authors have conducted a survey for the period of ten years of the Criminal Code application in order to examine the criminal offense of the domestic violence, procedure and perpetrators.
AB  - Nasilje u porodici predstavlja jedno od najkompleksnijih pitanja u krivičnom pravu, a koje predstavlja negaciju osnovnih ljudskih prava i sloboda zaštićenih brojnim međunarodnim i unutrašnjim pravnim dokumentima, počev od prava na život i sigurnost. Autori analiziraju ovu sve prisutniju formu nasilja (psihičkog, fizičkog, ekonomskog i socijalnog), kao društveni fenomen sa aspekta krivičnog i krivičnog procesnog prava. Porodično nasilje pre svega pogađa žene. Autori su sproveli istraživanje za vreme desetogodišnjeg važenja Krivičnog zakonika u Srbiji, s ciljem izučavanja krivičnog dela nasilja u porodici, postupka za ovo krivično delo i njegovih izvršilaca.

Main hearing according to the new Serbian Criminal Procedure Code: Survey in practice

AB  - The main hearing is the central part of the criminal procedure. In Serbia, the reform of the national criminal procedure legislation has brought about numerous changes related to this stage of criminal proceedings. Numerous objections have been addressed to the almost entirely new legal text. In an attempt to examine the advantages and disadvantages of the new legislation and observe how the prescribed rules are applied in practice, the authors have conducted an empirical research by attending 205 main hearings which were conducted under the rules of the new Criminal Procedure Code. The research covers a huge number of related issues but, given the page limit, this paper will focus on individual issues observed in trial proceedings. The focal point of reference is the examination of witness, but the authors also consider a number of other issues: the examination of expert witness, the delay of the trial, and the use of a video-link as a novelty introduced owing to the technological achievements of the modern era. The article is organized into several parts. The authors first provide a theoretical background of the issue under consideration and, then, present and discuss the research results provided in tables. In the third part of the article, the authors draw specific conclusions about the current practice in trials proceedings.
AB  - Glavni pretres predstavlja centralni deo krivičnog postupka. Reformom krivičnog procesnog zakonodavstva u Srbiji unete su, između ostalog, i brojne promene kada je u pitanju ova faza krivičnog postupka. Gotovo celokupnom novom zakonskog tekstu upućene su brojne primedbe. Usleg toga, autori su izvršili istraživanje prateći 205 glavnih pretresa koji su održani po pravilima novog Zakonika o krivičnom postupku, pokušavajući da sagledaju prednosti i nedostatke, te kako se pravila primenjuju u praksi. Budući da je za obim rada bilo izuzetno teško obraditi sva pitanja, autori su se bazirali na pojedina pitanja na glavnom pretresu. Akcenat je stavljen na ispitivanje svedoka, ali nisu zanemarena ni pitanja veštačenja, odlaganja glavnog pretresa, te upotrebe video-linka, kao novine zahvaljujući tehničkim dostignućima savremenog doba. Autori rad dele u više celina, teoretski obrazlažući pitanje o kojem se bave, a potom tabelarno predstavljajući rezultate istraživanja. Na osnovu toga, na kraju rada izvode konkretne zaključke o dosadašnjoj praksi vođenja glavnih pretresa.

Cooperation between police and public prosecutor: Law and practice in Serbia

AB  - Considering conceptual changes in by now not-so-new Criminal Procedure Code, the authors analyze relations between the prosecutor and police from the angle of law provisions but also in their implementation in practice. The paper is divided in two main parts. After introductory remarks, the authors consider a number of theoretical issues related to fair trial in the context of balancing roles, competences and powers of various procedural subjects with focus on relations and cooperation between police and the public prosecutor. The second part of the paper includes presentation of the results arising from empirical research dedicated to implementation of the novelties in the Serbian Criminal Procedure Code related to cooperation between prosecutors and the police.
AB  - Zakonodavac je, sada ne tako novim, Zakonikom o krivičnom postupku predvideo više rešenja kojima se menja položaj procesnih subjekata u odnosu na rešenja kakva su bila predviđena s početka ovog veka. Prevashodno, glavno obeležje novog zakonskog teksta iz ove oblasti jeste drastično menjanje položaja javnog tužioca uvođenjem tužilačke istrage. Time je i položaj policije unekoliko promenjen, te je bilo neophodno sprovesti praktično istraživanje o odnosima ova dva procesna subjekta za prve tri godine primene Zakonika o krivičnom postupku. Stoga, nakon teorijskog uvodnog dela, glavni deo rada se odnosi na rezultate istraživanja sprovedenog među pripadnicima policije.

Prevashodno, glavno obeležje novog zakonskog teksta iz ove oblasti jeste drastično menjanje položaja javnog tužioca uvođenjem tužilačke istrage. Time je i položaj policije unekoliko promenjen, te je bilo neophodno sprovesti praktično istraživanje o odnosima ova dva procesna subjekta za prve tri godine primene Zakonika o krivičnom postupku. Stoga, nakon teorijskog uvodnog dela, glavni deo rada se odnosi na rezultate istraživanja sprovedenog među pripadnicima policije.",

AB  - Contemporary trends in criminal procedure legislation are deliberately looking for efficiency as well as the instruments of implementation of international standards both in its quantitative and qualitative aspects. Doctrinal considerations find their footing in the decades-long reform of criminal procedural legislation of the Serbia, whereas the question that has always represented one of the most significant characteristics of criminal procedural legislation in general is the correlation between the public prosecutor and the police and its contribution to the efficiency of criminal proceedings. Serbia adopted new Criminal Procedure Code in 2011, which entered into the force during the 2013. According to the abovementioned, the authors pay special attention to the following issues: first, the notion of the police and the police functions; secondly, the correlation of the public prosecutor and the police as a factor in the efficiency of criminal proceedings; thirdly, empirical research and proposals de lege ferenda.
AB  - Savremeni trendovi u krivičnoprocesnom zakonodavstvu tendenciozno tragaju za instrumentima realizacije efikasnosti kao međunarodni standard i to u svom kvantitativnom i kvalitativnom aspektu. Doktrinarna razmatranja svoje uporište pronalaze u višedecenijskoj reformi krivičnoprocesnog zakonodavstva Srbije, a pitanje koje je oduvek predstavljalo jedno od značajnijih obeležja krivičnoprocesnog zakonodavstva uopšte je i korelacija javnog tužioca i policije i njen doprinos efikasnosti krivičnog postupka. AB  - The authors in the work deal with the trial process against members of the Young Bosnia for the assassination of the Austro-Hungarian heir Archduke Franz Ferdinand and his wife Sophie Chotek in Sarajevo 1914. That issue attends scientific and lay public attention over the hundred years. Authors divided their article into few parts. After the introductory remarks they explain conditions in the country before the assassination, especially problem of the Bosnia and Herzegovina's annexation and its ratification within the Austro-Hungarian legislation. After that, they remind on the ultimatum that the Dual Monarchy referred to Serbia, which was not accepted, but which 'caused' the First World War. The main part of the work is dedicated to the criminal proceeding against the Young Bosnians. They analyze criminal procedure in that time, behavior of the participants, especially president of the judicial council, and defense attorneys, which was shameful, except the defense of the Dr. Rudolf Cistler. Consequently, he had borne numerous negative consequences after the judgment.
AB  - Autori u radu razmatraju suđenje pripadnicima Mlade Bosne za ubistvo austrougarskog prestolonaslednika Franca Ferdinanda i njegove supruge Sofije Hotek u Sarajevu 1914. godine, budući da to pitanje i nakon više od sto godina zaokuplja pažnju stručne i laičke javnosti. Autori su rad podelili u više celina, jer je nakon uvodnih razmatranja bilo nužno prikazati uslove u državi pre atentata, a prevashodno problem aneksije Bosne i Hercegovine i njene ratifikacije u okviru austrougarske legislative. Nakon toga su u kratkim crtama podsetili na ultimatum koji je Dvojna monarhija uputila Srbiji, koji nije prihvaćen, posle čega je došlo do izbijanja Prvog svetskog rata. Centralni deo rada autori su posvetili krivičnom postupku protiv Mladobosanaca, analizirajući tadašnji postupak, ponašanje učesnika, a pogotovo predsednika sudećeg veća i branilaca okrivljenih, gde je jedina hvale vredna odbrana pripadala dr Rudolfu Cistleru, usled čega je snosio mnogobrojne negativne posledice nakon okončanja postupka.

The role of the jury system in the French criminal procedure

AB  - End of the XX century showed that almost all European countries have failed in the suppression of the crime. As a result, they began to seek new legal institutes to establish new mechanisms for efficient resolution of criminal cases. First of all, they stand out plea agreement, which in some countries inevitably follows the system of real jury trial. Among them, France stands out as a country with a long tradition of citizens' participation in criminal proceedings. Specifically, in this country jury trial takes place more than two hundred years, and was created on the model of English jury. However, almost immediately began the process of separating and distinguishing jury trials in these geographically close states. As it is case today, it is almost impossible to take a legal institute from one state and implement it in the legislation of another state in the same form. So, the English type of jury underwent to the adjustments to the French criminal procedure. That is the best illustrated with the numerous legislative acts adopted in the meantime, through which the jury experienced constant transformation. Since it is one of the oldest jury systems in the world, the author paid the attention to it in this work. The author deals with several units and after the introduction remarks he will explain the position and the role of lay judges in criminal proceedings. Then, he gives a cross-section of their position through the development of this type of trial. After that, he analyzes a jury according to positive French law. Also, throughout the paper provides a comparative analysis of some elements of this type of trial, and on the end he gives a concluding remarks.
AB  - Kraj XX veka je pokazao da su skoro sve evropske zemlje doživele neuspeh u suzbijanju kriminaliteta. Usled toga, proučavajući uporedno pravo, zakonodavci su počeli da traže pravne institute kako bi uspostavili nove mehanizme efikasnijeg rešavanja krivičnih predmeta. Kao pravni transplantat koji je zaživeo u skoro svim evropskim državama izdvaja se sporazum o priznanju krivičnog dela, koji u pojedinim neizbežno prati sistem pravog porotnog suđenja. Među njima, Francuska predstavlja državu s dugom tradicijom učešća građana u krivičnim postupcima. U ovoj zemlji porotno suđenje se odvija duže od dvesta godina, a nastalo je po ugledu na engleski porotni sud. Međutim, kao što je to slučaj i danas, gotovo je nemoguće jedan pravni institut preuzeti iz jednog zakonodavstva i implementirati u drugo u istom obliku, pa je tako i porotni sistem suđenja doživeo prilagođavanja francuskom krivičnom postupku. O tom najbolje svedoče mnogobrojni zakonski akti doneti u međuvremenu, putem kojih je porota doživljavala konstantne transformacije. U ovom radu autori obrađuju više celina. Nakon uvodnih napomena o porotnom suđenju objašnjuju položaj i ulogu porotnika u krivičnom postupku. Potom daju presek njihovog položaja kroz razvoj ovog tipa suđenja, da bi posle analizirali porotu prema pozitivnom francuskom pravu. Takođe, kroz ceo rad daje se i komparativna analiza pojedinih elemenata ovog oblika suđenja, a na kraju su data zaključna razmatranja u kojima autori na jedan rezimirani način sumiraju rezultate do kojih su došli u proučavanju predmetne problematike.

Plea bargaining before the Tribunal for the former Yugoslavia

AB  - The authors in the work deal with the plea agreement in the international law - before the Tribunal for the former Yugoslavia. International law, which is glorified from the one side, and criticized for the other, gradually developed in the field of criminal procedure. This development is, however, largely influenced by political factors, which can be best seen in the proceedings before the Tribunal, where the individual rules are created during the criminal proceedings and particular amendments, followed by implementation of American legal solutions, despite all critics of the same rules in that system, as well as different opinions of the trial judges in the Tribunal. After the introductory remarks, the authors explain the legal basis of the plea bargaining. Then, they explain the majority of criminal cases in which occurred guilty plea. Through these cases, the authors came to the conclusion that, although in the national legal systems plea negotiation and plea agreement contributes to the efficiency of the criminal proceedings, briefly prescribed legal rules for its conclusion and application before the Tribunal once again proved a distinct selectivity in the delivering of justice in this area of international law.
AB  - Autori u radu obrađuju sporazum o priznanju krivičnog dela u međunarodnom pravu, i to pred Tribunalom za bivšu Jugoslaviju. Međunarodno pravo, koje se sa jedne strane glorifikuje, a sa druge kritikuje, postepeno se razvilo i u domenu krivičnog procesnog zakonodavstva. Ovaj razvoj je, ipak, pretežno bio uslovljen političkim faktorima, što se najbolje može videti u postupcima pred Tribunalom, pred kojim su pojedina pravila postupka krojena za vreme trajanja krivičnog postupka, praćena implementiranjem zakonskih rešenja iz američkog prava uprkos svim kritikama upućenim istim pravilima u ovom sistemu, kao i različitim mišljenjima sudija u Tribunalu. Nakon uvodnih razmatranja, autori su objasnili zakonske osnove zaključenja sporazuma o priznanju krivičnog dela, a potom obrazložili većinu krivičnih predmeta u kojima je došlo do priznanja krivice. Kroz te krivične postupke autori su došli do zaključka da, iako u nacionalnim pravnim sistemima pregovaranje o priznanju krivice i zaključenje nagodbe doprinosi efikasnosti krivičnog postupka, šturo propisivanje pravila njenog zaključenja, a potom i njihova primena, još jednom su dokazali izrazitu selektivnost u deljenju pravde pred Tribunalom.

Međunarodno pravo, koje se sa jedne strane glorifikuje, a sa druge kritikuje, postepeno se razvilo i u domenu krivičnog procesnog zakonodavstva. Ovaj razvoj je, ipak, pretežno bio uslovljen političkim faktorima, što se najbolje može videti u postupcima pred Tribunalom, pred kojim su pojedina pravila postupka krojena za vreme trajanja krivičnog postupka, praćena implementiranjem zakonskih rešenja iz američkog prava uprkos svim kritikama upućenim istim pravilima u ovom sistemu, kao i različitim mišljenjima sudija u Tribunalu. Nakon uvodnih razmatranja, autori su objasnili zakonske osnove zaključenja sporazuma o priznanju krivičnog dela, a potom obrazložili većinu krivičnih predmeta u kojima je došlo do priznanja krivice. Kroz te krivične postupke autori su došli do zaključka da, iako u nacionalnim pravnim sistemima pregovaranje o priznanju krivice i zaključenje nagodbe doprinosi efikasnosti krivičnog postupka, šturo propisivanje pravila njenog zaključenja, a potom i njihova primena, još jednom su dokazali izrazitu selektivnost u deljenju pravde pred Tribunalom.",
