Legislative framework and criminal operational aspect of combatingnew forms of community violence

AB  - The paper presents the legislative framework and the criminalistics-operational aspect of the fight against new forms of violence in Serbia. It is primarily about domestic violence, then peer violence and violence at sports events. The social response to the challenges, risks and threats posed by new forms of violence in the community first included normative-legal activity. The legal frame-work for the fight against new forms of violence in the community included the adoption of special laws and bylaws, which were pointed out in the paper. On that basis, the criminalistics-operational response  of  the  police  and  law  enforcement  agencies,  judicial  bodies  and  other  relevant  entities  was  further  upgraded.  The  paper  also  points  out  the  activities  of  the  RS  Ministry  of  the  Interior  in the fight against forms of domestic violence, peer violence and violence at sports events. In the concluding remarks, proposals were made for improving the legislative framework de lege ferenda, strengthening multi-agency and multi-sectoral cooperation, and accepting the good practice of the developed countries in the context of our application for the EU accession.

Fight against organised crime and some contemporary criminalistics methods

AB  - The paper gives a brief overview of the definition of organized crime with the answer what definition is most appropriate from the aspect of police work. The basic characteristics of organized crime are also presented.
In the continuation, the paper gives an overview on some methods used by
members of an organized criminal group or criminal organization as a whole
in order to obscure their criminal activities and avoid criminal prosecution.
An analysis of the practical activities of the police and modern technologies reveals certain possibilities that can lead to the improvement of police
work in the field of the fight against organized crime. An analysis of the content of available literature related to the topic of paper was also carried out.
To improve the rates of detecting and clarifying of organized crime, police
must primarily be able to assess the perpetrators of such crimes. Finally, the
synthesis of all methods leads to the conclusion what methods are the most
effective. All contemporary methods have to be used while respecting the
fundamental rights and freedoms that are guaranteed by the constitution and
international legal acts. If not so, all police and prosecutor work on proving
the felonies will ‘go down the drain’ as the courts must declare the evidence
to be inadmissible and unlawful.

Counter Terrorism and Migrant Crisis in Context of Criminal Low Cooperation Between Countries of the Region

AB  - The Western Balkans is a region that is at the same time one of the migrant routes from the war-affected areas to the EU countries. Recent decades in the world have seen an increase in the number of terrorist attacks, which culminated in the attack on the Twin Towers of the 9/11 in the United States. In major cities across Europe, there has been a series of bombings and other attacks, particularly with the onset of the major migrant crisis in 2015. Armed conflicts in the areas of North Africa and the Middle East are still the main generator of the refugee wave, with new terrorist attacks. Although the increase in the number of attacks and migration leads to the link of research, they say the opposite. An effective counter terrorism and the elimination of the consequences of an attack implies, at the same time, the reaction of states on the national level, as well as international criminal law cooperation between states and organizations at the regional and global level. In the first part of the article, the authors briefly referred to the (un)defined notion of terrorism, then examining migration on the route of the Western Balkans and ultimately pointed to the legal and institutional mechanisms of criminal law cooperation of the countries of the Region in counter terrorism.

Analysis of characteristic novelties in the Police Law: Critical review

AB  - Although it had not yet reached full-capacity implementation, the Police Law experienced changes as early as March 18. It took full two years to detect certain shortcomings both in terms of the immediate enforcement of the legal provisions and regarding the adoption of secondary legislation. For the purposes of this paper, novelties can be classified in several groups: 1) novelties of a general character, 2) organizational-functional novelties, and 3) labor-law novelties. The greatest number of innovations is in the field of labor-law relations of a specific officer's (career) system in the Ministry of the Interior. The authors analyze some of the characteristic novelties with a critical review of the exercised freedoms and rights of citizens, especially police officers, but also their obligations. At the same time, they point out to some additional novelties de lege ferenda.
AB  - Iako još uvek nije primenjen u punom kapacitetu, Zakon o policiji je već u martu 2018. godine doživeo izmene i dopune. Trebalo je pune dve godine da se uoče određeni nedostaci kako u neposrednoj primeni normi zakona, tako i sa aspekta donošenja sekundarne legislative. Za potrebe ovog rada novele možemo svrstati u nekoliko grupa: 1) novele opšteg karaktera, 2) organizaciono-funkcionalne novele i 3) radno-pravne novele. Najveći broj novela je iz oblasti radno-pravnog odnosa, konkretno specifičnog službeničkog (karijernog) sistema u MUP-u. Autori u radu analiziraju neke od karakterističnih novela uz kritički osvrt na ostvarivanje sloboda i prava građana, naročito policijskih službenika, ali i njihovih obaveza. Istovremeno su ukazali na još neke novele de lege ferenda.

AB  - Novi Zakon o policiji stupio je na pravnu snagu i počeo da se primenjuje 5. februara 2016. godine. Sličan je starom zakonu i njime se uređuju unutrašnji poslovi, organizacija i nadležnost MUP-a, policijski poslovi, organizacija i nadležnost policije, ljudski resursi, disciplinska odgovornost i odgovornost za materijalnu štetu, kontrola rada MUP-a i policije, finansiranje, pomoćna policija, primena drugih propisa i ovlašćenje za donošenje podzakonskih propisa. U radu su izložene najbitnije novine u Zakonu o policiji sa posebnim osvrtom na upotrebu sredstava prinude, kao najvažnije oblasti sa stanovišta ljudskih prava i građanskih sloboda.
