Detention in the criminal procedure legislation of Serbia and experiences of the public prosecutor’s office for organized crime - (non) compliance with European standards?

AB  - Freedom as one of the key values in a democratic society is limited by the contemporary needs of protecting the individual from arbitrariness and illegality, regardless of the sphere of social life in which the individual exists. This freedom, in our case freedom of movement, is determined by legal boundaries, both from the aspect of the national framework and international standards. Namely, present-day states set the realization of human rights as one of the main goals, but also the possibility of restrictions due to necessity in a democratic society and with a restrictive approach to the basis of legal restrictions, in this case restrictions on the right to freedom and security of person. In accordance with that, the paper critically analyses the adequacy of positive legal norms that regulate detention in Serbia and research was conducted in the Prosecutor’s Office for Organized Crime. In the conducted research, for the purpose of collecting primary data, a specially designed instrument was used - a survey questionnaire consisting of 7 questions. The aim of the research is to consider the adequacy of the legal norm and the efficiency of its application when it comes to the measure of detention, but also to identify problems in practice when determining the said measure. The results of the research indicate that the reform of the measure of detention is necessary, not only from the aspect of the national framework, but also the degree of harmonization with contemporary comparative criminal procedure legislation and European standards of deprivation of liberty.
AB  - Слобода као једно од кључних вредности у демократском друштву ограничена је савременим потребама заштите појединца од произвољности, незаконитости, без обзи ра у којој сфери друштвеног живота појединац егзистира. Наведе на слобода, у нашем случају слобода кретања је одређена законским границама и то како посматрано са аспекта националног оквира тако и међународних стандарда. Наиме, савремене држа ве као један од главних циљева постављају остварење људских права, али исто тако и могућност ограничења из разлога неоп хо дности у демократском друштву и уз рестриктивни приступ основа законитог ограничења, у овом случају ограничења права на слободу и безбедност личности. У складу са тим, у раду је критички анализирана адекватност позитивноправних норми које регу лишу меру притвора у Србији и спроведено је истраживање у Тужилаштву за организовани криминал у Србији. У спроведеном истраживању, у сврху прикупљања примарних података кориш ћен је посебно конструисан инструмент – анкетни упитник који је био сачињен од 7 питања. Циљ истраживања је сагледавање адекватности законске норме и ефикасности њене примене када је реч о мери притвора, али и уочавања проблема у пракси приликом одређивања наведене мере. Резултати истраживања указују да је неопходна реформа мере притвора и то не само посматрано са аспекта националног оквира, већ и степена усаглашености са савременим компаративним кривичнопроцесним законодавствима и европским стандардима мера лишења слободе.

The role and importance of contemporary energy, economic and environmental security policies in international integration

AB  - The significance of energy for modern states and people’s lives, limitation and non-renewability of the most of energy sources, as well as their continuing potential vulnerability (by the natural disasters, technical and technological accidents and by destructive human behavior), necessarily and justifiably caused the development of economic and energy security theoretical thought and practice, with special attention to their relationship with environmental security. The Republic of Serbia has also realized that improving the energy security, improves national security as well. However, there’s a lot of space for it’s improvement in national energy policy. In fact, our country is an energy - importing country, therefore energy dependent and 'politically vulnerable'. At the same time, a number of potential alternative and pure energy sources that Serbia possesses in abundance are unexploited, and realizing the obligations undertaken by signing the Kyoto Protocol, the Serbian position on it’s European integration way would be significantly advanced. Furthermore, geo-strategic position of the significant transregional energy connector would have to encourage national policy designed to stimulate infrastructure projects with national and international importance, which brings 'profit and so the political points'. Finally, in cooperation with NGO sector, the state should improve the energy resource security mechanisms. That would make the benefit of energy sector development, at least triple: the national economy would be advanced, the international position of Serbia would be improved, and the environment would be protected, which would enhance the national security.
AB  - Značaj energije za život modernog čoveka i države, ali i ograničenost i neobnovljivost većine energenata, kao i njihova kontinuirana potencijalna ugroženost (prirodnim nepogodama, tehničko-tehnološkim akcidentima i destruktivnim ljudskim ponašanjem), neminovno su i opravdano uslovili razvoj teorijske misli i prakse ekonomsko- energetske bezbednosti, pri čemu se posebna pažnja posvećuje njihovoj vezi sa ekološkom bezbednošću. Republika Srbija uvidela je da se unapređenjem energetske, unapređuje i nacionalna bezbednost. Međutim, u nacionalnoj energetskoj politici ima prostora za poboljšanje. Naime, naša zemlja je uvoznica energenata i energije te je, u tom smislu, i energetski zavisna, a samim tim i 'politički ranjiva'. Istovremeno, nisu iskorišćeni brojni potencijali alternativnih i čistih izvora energije kojima Srbija obiluje, a realizovanjem obaveza koje je preuzela potpisivanjem Kjoto protokola unapredio bi se položaj Srbije na putu evrointegracija. Geostrateška pozicija značajnog transregionalnog energetskog konektora morala bi da podstakne nacionalnu politiku koja stimuliše infrastrukturne projekte državnog i međunarodnog značaja, što donosi 'i profit i političke poene'. Najzad, država bi morala da, u saradnji sa nevladinim sektorom, unapredi mehanizme bezbednosti energetskih resursa. Tako bi dobit od razvoja energetskog sektora bila najmanje trostruka: unapredila bi se nacionalna ekonomija, poboljšao bi se međunarodni položaj Srbije i zaštitila bi se životna sredina, čime bi se unapredila i nacionalna bezbednost.

Techniques of special physical education in the function of controlling suspect's resistance and protecting police officers

AB  - The paper analyzes the use of physical force as a means of coercion, i.e. techniques of physical control. The Law on Police and the Regulations on conditions and manner of use of coercive means define the conditions and manner of use of means of coercion (force), period of duration, limitations as well as obligations following the use of force.10 Special attention has been devoted to the definition of force, quantity and nature of resistance that should be surmounted, as well as the level of force control the police officers use in order to neutralize unlawful physical actions of a suspect in order to control a certain situation. Practical application of techniques of Special Physical Education (SPE) as means of legal control activities of the police, i.e. technical physical control in the function of controlling physical resistance given by a suspect have been analyzed. The total number of 182 reports when the physical force was used was analyzed. In addition to this, the paper highlights the need for clear codification and generally accepted set of rules for the use of physical force as a guarantee for ethical and legal performance of police powers.
AB  - U radu je urađena analiza primene fizičke snage kao sredstva prinude, odnosno tehnike fizičke kontrole. Zakonom o policiji i Pravilnikom o uslovima i načinu upotrebe sredstava prinude, definisani su uslovi i način upotrebe sredstava prinude (sile), vreme trajanja, ograničenja, kao i obaveze nakon primene sile1. Posebna pažnja posvećena je definiciji sile, količini i prirodi otpora koji se mora savladati, te nivou kontrole sile koju pripadnik policije primenjuje da bi neutralisao nezakonite fizičke akcije osumnjičenog u cilju upravljanja (kontrole) određenom situacijom. Analizirana je praktična primena tehnika specijalnog fizičkog obrazovanja (SFO-a) kao sredstva zakonitih kontrolnih aktivnosti policije tj. tehnike fizičke kontrole u funkciji kontrolisanja fizičkog otpora koji pruža osumnjičeno lice. Analizirano je ukupno 182 izveštaja u kojima je bila opravdana upotreba fizičke snage. Dalje, u radu je potencirana potreba jasno kodifikovanog i opšte prihvaćenog niza pravila prilikom primene sile, kao garant etičkog i zakonitog vršenja policijskih ovlašćenja.

AB  - In order to analyze and percept, even partially, what is the manifestation of complexity of contemporary intelligence operations and their realizations, the authors primarily points at actual understanding of intelligence operation concept. They indicate intelligence operations elements and signifies that enormous resources and financial means are spending during realization. Also, points that is necessary to manage complex processes of intelligence operations realization, in order to enable their efficiency and efficient ending of whole intelligence enterprise. Realization of diverse intelligence enterprises, for its complexity, dynamism and uncertainty, perforce need intelligence methodical project analysis of organizing, conducting and managing intelligence operations. Survey of intelligence operations management is, irrespective of level of ambition and detailing, extremely difficult attempt. In this paper phases of intelligence operations development are given and it points that intelligence operations planning represent first phase in process of operations management, which contains definition of aims, directions and global development strategy, specification of measures and means for achievement of established goals and selection of best alternative.

AB  - Communication surveillance is a relatively new measure in the Serbian legal system and with the development of new technologies applicable to various types of communication, new problems are emerging very fast. Of course this is not the case exclusively in Serbia, but much further. Similar problems emerge in the EU, and Serbia as a signatory of the European Convention on Human Rights, has to oblige with the case law of the European Court of Human Rights in Strasbourg (ECHR). Standards made in this area in the laws of the EU countries are derived from the rules made by case law of ECHR. Regardless of the depicted trends and occurrences in this sphere, Serbian legislation has not been lately following the lead of European legislators. Authors are analyzing facts and circumstances in connection to legal defining and proscribing of the measure of communication surveillance, giving a parallel comparative legal analysis of ECHR and Luxemburg Court of EU. The analysis also includes considerations regarding some articles from the draft Act on Criminal Procedure in Serbia pertaining to communication surveillance. The purpose of the analysis is to suggest certain regulations de lege ferenda in Serbia.
AB  - Mera nadzora nad komunikacijama je relativno nova u našem zakonodavstvu, ali pojavom novih tehnologija primenljivih na najrazličitije oblike komunikacija javljaju se mnogobrojni problemi. Naravno, ovo nije slučaj samo u Srbiji, već mnogo šire. Slična problematika javlja se i u Evropskoj uniji, a mi se kao potpisnica evropske Konvencije o ljudskim pravima (EKLjP) moramo rukovoditi i praksom Evropskog suda za ljudska prava u Strazburu (ESLjP). Standardi koji se u evropskim zemljama postavljaju u ovoj oblasti u svojoj osnovi sadrže pravila ustanovljena upravo u praksi ovog suda. Bez obzira na sve trendove i događaje u ovoj oblasti naš zakonodavac, u poslednje vreme, nije u potpunosti na nivou evropskih. Autori analiziraju činjenice i okolnosti vezane za zakonsko regulisanje mere nadzora i snimanja telefonskih i drugih oblika komunikacija, uz uporedno pravnu analizu prakse ESLjP, ali i suda EU u Luksemburgu. U ovu analizu unosi se i razmatranje predloga nacrta novog Zakonika o krivičnom postupku (ZKP). Autori analizom i prikazom uporedno pravne prakse pokušavaju i da daju predloge de lege ferenda u Srbiji.

AB  - After the introductory observations in the paper on seizure of assets obtained through criminal offences, the authors elaborate more specifically the role of police as a state institution entrusted with conducting the financial investigation. Previously, the authors observe international standards with regard to specialized education in this area making a note of rather insufficient and non-institutionalized system of this kind of education in our country. The central part of the article reviews both current and proposed legal framework regulating police engagement in financial investigation, related criticism, current police practice and suggested proposals for improvements.
AB  - Nakon uvodnih i opštih razmatranja o oduzimanju imovine stečene izvršenjem krivičnih dela autori se bave policijom u svojstvu subjekta finansijskih istraga. Prethodno se ukazuje na međunarodne standarde u pogledu specijalističke edukacije u ovoj oblasti, kao i na nedovoljno razvijen i neinstitucionalizovan sistem obuke prisutan kod nas. Centralni deo rada bavi se razmatranjima o aktuelnim i predloženim zakonskim okvirima policijskog angažovanja u finansijskim istragama, njihovom kritikom, sadašnjom policijskom praksom i predlozima za njeno unapređenje.

AB  - The paper considers the issue of stealing electric energy as a manifestation of theft, as well as legal solutions derived from the Law on Energetics. The Public Enterprise 'Electric Power industry of Serbia', that is, the state budget, loses over 3 billion dinars a year from electric power thefts, so that social danger that derives from this offence is more than evident. Besides defining the offence in terms of criminal law, the paper itemizes ways of detecting the offence, describes the modus operandi of electric power theft and proposes the methodology of stolen energy audit. Efforts made by the Public Enterprise 'Electric Power Industry of Serbia' to lower the technical and non-technical losses in the transportation and distribution of electric power are different and are being conducted more or less successfully. Special emphasis was given to the action of replacement of electricity meters started by the Public Enterprise 'Electric Power Industry of Serbia', in order to act preventively on lowering technical and non-technical losses during the transportation and distribution of electric power.
AB  - Rad je posvećen razmatranju problematike krađe električne energije kao pojavnog oblika krađe, uz sagledavanje zakonskih rešenja proisteklih iz Zakona o energetici. JP EPS, odnosno državni budžet, godišnje je oštećen za oko tri milijarde dinara krađom električne energije, te je više nego očigledna društvena opasnost koja proizlazi iz vršenja pomenutog krivičnog dela. Pored krivično-pravnog određenja dela, u radu su navedeni i načini saznanja za izvršenje dela, kao i modus operandi krađe električne energije, uz metodologiju obračuna snage ukradene električne energije. Napori JP EPS da se smanje tehnički i netehnički gubici prilikom transporta i distribucije električne energije su različiti i sprovode se sa manje ili više uspeha, a poseban osvrt dat je na akciju zamene strujomera, započetu od strane JP EPS kojom bi se preventivno delovalo na smanjenje tehničkih i netehničkih gubitaka prilikom transporta i distribucije električne energije.
