Protection of adult victims of trafficking in human beings and the status of a particularly sensitive witness

AB  - In addition to the introduction and conclusion, the paper consists of three logically related parts within which an analysis of certain international and national legal standards in the protection of victims of crime and particularly sensitive witnesses in criminal proceedings has been performed. A special subject of analysis were the national criminal law provisions regulating the protection of adult victims of the criminal offence of trafficking in human beings. Key problems and omissions in the protection of these witnesses were identified, as well as suggestions for overcoming them. In its conclusion, the paper underlines that particularly sensitive witnesses are not always provided protection in accordance with minimum international standards, and the reasons can be found in the impossibility of providing technical conditions, insensibility of acting officers, as well as an inadequate assessment by the authorities in charge of applying certain elements of criminal law protection.

Identifying Street Hotspots Using a Network Kernel Density Estimation

AB  - Throughout history, police have dedicated their attention to locations with a high incidence of crime and/or disorder.
These efforts have become more systematic since the introduction of hotspot policing in the 1990s. A large body of
research conducted over the last three decades has shown that focusing police resources on areas characterised by
high concentration of crime (hotspots) may have positive preventive effects. If crime hotspots inaccurately reflect
the spatial patterning of crime, (intense) criminal activity may not attract police attention. The progress of the crime
mapping discipline, spurred by the development of information technology (e.g. GIS) and spatial statistics, enabled
crime analysts to identify hotspots more accurately than before. When identifying hotspots, crime analysts use spatial
statistical methods which are based on the assumption of a 2D homogeneous Euclidean space. However, in an urban
setting, the street network may significantly affect the patterning of crime. Crime may be concentrated along the
streets, thus forming linear hotspots. When such linear distribution is analysed, the assumption of homogeneity
of the 2D space, which is inherent in “traditional” spatial statistical methods, could lead to a false conclusion. In
order to avoid that from happening, these methods should be extended to a network space. This paper explains the
specifics of spatial analysis in a network environment and its relevance to the crime analysis practice. Finally, the
network extension of one of the most popular methods of hotspot identification, i.e. the kernel density estimation
(KDE) method, was applied in the present paper. Having compared the network and planar KDE outputs, the authors
concluded that the network-based KDE allowed a more accurate identification of linear hotspots, resulting in a more
effective deployment of resources.

AB  - Efficient  countering  contemporary  forms  of  crime,  especially  terrorism,  high-tech  and organised crime, requires a multi-agency approach and cooperation, both at the national and  international  level.  One  of  the  basic  indicators  for  assessing  the  quality  of  cooperation  is  the  exchange  of  information.  The  exchange  of  information  overcomes  limited  resources,  and  improves  the  efficiency  and  cost-efficiency  of  the  evidentiary  procedure.  The  National  Criminal Intelligence System is based on the establishment of a Platform for secure electronic communication,  exchange  of  data  and  information  between  government  authorities,  special  organisational units of government authorities and institutions, in order to prevent organised crime and other forms of serious crime. The following institutions are participating in the first phase of the establishment of the National Criminal Intelligence System: the Ministry of Interior; Ministry  of  Justice;  Republic  Public  Prosecutor’s  Office;  Prosecutor’s  Office  for  Organised  Crime; Office of the National Security Council and Classified Information Protection; Customs Administration;  Anti-Corruption  Agency;  and  Tax  Administration.  The  subject  of  this  paper  is the analysis of the legal framework, defining of recommendations, establishing which issues need to be legally regulated and which legal acts should be adopted to create the legal conditions necessary for the establishment and development of the NCIS.

AB  - The Ministry of Interior of the Republic of Serbia (MoI RS) is currently implementing
the Intelligence-led Policing (ILP) model in the territory of four police directorates (Novi
Sad, Valjevo, Kraljevo and Leskovac). The starting elements of this approach include
improvement of intelligence function and providing criminal intelligence information to
police management, based on which it is possible to identify security problems and make
adequate strategic and operational decisions directed at prevention primarily. The paper3
analyses the legal framework and organization of ILP and highlights the key principles,
positive experiences and problems occurring during its implementation. Organisational
changes and the application of the basic principles have made influence on more efficient
solving of security problems, primarily prevention. However, time is required for the full
implementation of the model, particularly for the change in the manner of decision-making

Profile of Police Officers Convited of Bribery

AB  - The purpose of this research was to identify the basic elements of the profiles of police officers based on court decisions rendered in criminal cases involving bribery, and to determine which police units are characterised by a greater risk of corruption, and which problems should be considered when selecting measures to protect police integrity. The research analysed 23 court proceedings within which 40 employees of the Ministry of the Interior were found guilty of committing bribery in the period from 1 January 2010 to 1 January 2015. Results indicate that the majority of those convicted of taking bribes are male with secondary education qualifications working as police officers, who are not in management positions, in the Border Police or Traffic Police Directorates, and their median age is 33.92. On average, the largest bribes were taken by police officers from the criminal police. Results also reveal the fundamental elements of the profile of a corrupt police officer and point to problems related to enhancing police integrity, which should be considered when drafting a strategy for the combatting police corruption. This research can serve as a basis for future studies, the results of which may be used for conducting a comparative analysis, as well as for outlining criminal and legal responses of states concerning police corruption.

European Union's information exchange legal framework: A prerequisite for successful co-operation in fighting organized crime

AB  - The contemporary social conditions increasingly enable the development of transnational organized crime. Considering this fact a global response is required, or rather the development of general strategies of international character. The authors of the paper discuss certain, i.e. the most dangerous forms of organized crime which are present in Serbia as well as in the entire international community. Also, in order to make investigations and prosecutions easier, it is necessary to develop cooperation. Information exchange, as well as exchange of intelligence and evidence collecting data is a prerequisite for improving safety. Timely access to the relevant and objective information is a key element for successful detection, prevention and proving criminal offenses. Enhancing the co-operation, defining the legal framework and the establishing of technical possibilities, particularly with the handling of electronic, digital evidence, effective and timely compliance with requests for mutual legal assistance are prerequisites for success.
AB  - Savremeni društveni uslovi sve više omogućavaju razvoj transnacionalnog organizovanog kriminala. S tim u vezi, potreban je globalni odgovor ili, bolje rečeno, razvoj generalnih strategija međunarodnog karaktera. Autori se u radu osvrću na pojedine, najopasnije oblike organizovanog kriminala koji su prisutni kako u Srbiji tako i u čitavoj međunarodnoj zajednici. Takođe, da bi se olakšale istrage i krivična gonjenja, neophodno je razvijati saradnju. Razmena informacija, obaveštajnih i dokaznih podataka preduslov je za poboljšanje bezbednosti. Blagovremen pristup relevantim i objektivnim informacijama ključni je element za uspešno otkrivanje, sprečavanje i dokazivanje krivičnih dela. Unapređenje saradnje, definisanje pravnih okvira i uspostavljanje tehničkih mogućnosti, naročito za rukovanje elektronskim, digitalnim dokazima, i efikasno i blagovremeno postupanje u skladu sa zahtevima za uzajamnu pravnu pomoć - preduslovi su za uspeh.

Criminal Careers of Football Club Fan Leaders in Serbia

AB  - The subject of this paper is the criminal activities of fan group leaders in Serbia. The data used for the research are contained in the police data base Records of extreme fans, which is kept by the Ministry of Interior of the Republic of Serbia. The research sample included 30 leaders of fan groups from six football clubs of the first national football league, and focused on their criminal records, whereas all crimes for which criminal charges were brought were analyzed both quantitatively and qualitatively. The goal of the research was to study the criminal activities of fan group leaders and highlight the possible influence on fan group members. The results have shown that fan group leaders are inclined to commit crimes, with more than one third having drug-related criminal charges filed against them. Criminal charges for property crimes have been brought against 22 of the 30 leaders included in the sample, and three leaders committed homicide. One fan group leader was murdered. The results show significantly that future research should pay more attention to criminal activities of fan group leaders. The inclination to commit crime is an important fact which should be taken into account when planning control and drawing programs aimed at preventing football-related violence.

AB  - The article contains introduction, conclusion and three logically connected chapters. Introduction presents a short review of etymology meaning of the term "street crime group", "gang" and "clan". In the first chapter "Concept and characteristics of street crime groups" the authors research different definitions of street crime groups, theirs basic characteristics, as presentation results from different studies of numerous and characteristic street crime groups in Europe and the United States. Based on the hypothesis that violence is important feature of street crime groups, the second chapter presents phenomenology of homicide which are committed by their members. In this chapter the authors indicate modi operandi and the principles which could be used in the analysis of consequences of unknown offender profile of homicide. Conclusion contains information about problems related to street crime groups in the Republic of Serbia.
AB  - Rad pored uvoda i zaključka čine tri logički povezana dela. U uvodu je dat kratak osvrt na etimološko značenje termina "ulična kriminalna grupa", "gang" i "banda". U prvom delu "Pojam i karakteristike uličnih kriminalnih grupa", autori su svoj predmet istraživanja usmerili na prikaz različitih definicija uličnih kriminalnih grupa, njihovih osnovnih karakteristika, kao i prezentaciju rezultata različitih studija o broju i karakteristikama uličnih kriminalnih grupa u Evropi i SAD-u. Polazeći od hipoteze da je nasilje bitno obeležje uličnih kriminalnih grupa u drugom delu je dat prikaz pojavnih oblika krivičnog dela ubistva koja se vrše od strane njihovih članova. U ovom delu autori su se osvrnuli i na opis načina izvršenja i principe koji se mogu koristiti u analizi posledice i izvođenju zaključaka o elementima profila nepoznatog učinioca izvršenog ubistva. Logično, na kraju, prezentovani su modeli programa za prevenciju uključivanja mladih u bande Nacionalnog centra za prevenciju kriminala u Kanadi. U zaključku, iznete su osnovne informacije o problemu uličnih kriminalnih grupa u Republici Srbiji.

AB  - There are various motives of committing a criminal act. When we talk about homicide, we need to say that it can be the result of huge number of motives, first of all, revenge, blood feud, material gain, jealousy, political motives, sexual motives, etc. The authors present motivational model of multiple-serial killers, and pay attention on factors which contribute that a person becomes a serial killer. First of all, they focus on influence of inadequate social environment, events during childhood, model of responsibility and operations directed to others and us.
AB  - Polazeći od velikog broja determinanti koje mogu uticati na neko lice da izvrši seriju seksualno motivisanih ubistava, autori u radu vrše analizu motivacionih modela, kojima se nastoji dati odgovor na pitanje zašto jedno lice postane učinilac serije takvih krivičnih dela. Pri tome, posebnu pažnju su usmerili na motivacioni model koji su Berdžes i njegovi saradnici koristili u objašnjenju seksualno motivisanih ubistava i model kontrole traume koji je definisao Hiki (Hickey). Na kraju, s ciljem objektivnijeg sagledavanja ubistava, date su kratke informacije o motivacionom spektru koji su Revič i Šlezindžer koristili za klasifikaciju serijskih ubistava.

Violence at sporting events in the Republic of Serbia: National and international standards prevention and repression

AB  - The paper, besides the Introduction and Conclusion, consists of three logically related units. In the first part, the authors pointed out basic information on different forms and consequences of violence at sporting events. As a logical continuation, the second section provides an overview of legal solutions adopted in the Republic of Serbia with the aim of creating a legal framework for more effective countering of this kind of violence. The third part deals with the most important standards of police procedure in the control of violence at sporting events, defined by the Council of Europe in its legal documents (European Convention on Spectator Violence and Misbehaviour at Sports Events and in particular at Football Matches; Recommendations of the Council of Europe of 22 April 1996; Council Resolution of 3 June 2010).. In the Conclusion, the authors have stated suggestions about what needs to be done to reduce violence at sporting events, as well as measures that the Police of the Republic of Serbia is undertaking to increase their effectiveness in preventing of violence at sporting events, particularly in organizational terms (the formation of the organizational unit for monitoring and preventing of violence at sporting events).

U trećem delu autori su ukazali na najvažnije standarde policijskog postupanja u kontroli nasilja na sportskim priredbama koje je pravnim aktima definisao Savet Evrope (Evropska konvencija o nasilju i nedoličnom ponašanju gledalaca na sportskim priredbama, posebno na fudbalskim utakmicama, Preporuke Saveta Evrope od 22. aprila 1996, Rezolucija Saveta Evrope od 3. juna 2010 godine). AB  - Relevant element of law enforcement work is collecting data about criminal act which we can get from witnesses (including victims) and persons suspected for committing a crime. It is a very important issue for success of each the process of proving. The special subject of objective analysis of statement presents criminalistic analysis truthfulness of written statements, transcripts or recorded statements. For criminalistic analysis today we often use two techniques, whereby authors in article write about that: Criterion Based Statement Analysis-CBSA and Scientific Content Analysis-SCAN.
AB  - Nezaobilazan element policijskog rada čini prikupljanje informacija koje o krivičnom delu mogu dati potencijalni svedoci (uključujući i žrtve) i lica osumnjičena za njegovo izvršenje. To je bitan elemenat za uspeh svakog postupka dokazivanja. Poseban predmet objektivne analize iskaza predstavlja kriminalistička analiza istinitosti pisanih izjava, transkripata, ili snimljenih izjava. Danas se za kriminalističku analizu izjava najčešće koriste dve tehnike, pri čemu se autori u radu upravo osvrću na njih: Analiza izjave na osnovu kriterijuma (Criterion Based Statement Analysis-CBSA) i Naučna analiza sadržaja (Scientific Content Analysis-SCAN).

The special subject of objective analysis of statement presents criminalistic analysis truthfulness of written statements, transcripts or recorded statements. For criminalistic analysis today we often use two techniques, whereby authors in article write about that: Criterion Based Statement Analysis-CBSA and Scientific Content Analysis-SCAN., Nezaobilazan element policijskog rada čini prikupljanje informacija koje o krivičnom delu mogu dati potencijalni svedoci (uključujući i žrtve) i lica osumnjičena za njegovo izvršenje. To je bitan elemenat za uspeh svakog postupka dokazivanja. Poseban predmet objektivne analize iskaza predstavlja kriminalistička analiza istinitosti pisanih izjava, transkripata, ili snimljenih izjava. Danas se za kriminalističku analizu izjava najčešće koriste dve tehnike, pri čemu se autori u radu upravo osvrću na njih: Analiza izjave na osnovu kriterijuma (Criterion Based Statement Analysis-CBSA) i Naučna analiza sadržaja (Scientific Content Analysis-SCAN).",

AB  - Collection of various information about citizens and their storage in appropriate data bases are realities of modern societies. Ever-increasing amount of that information has triumphed over human capacity to deal and analyse them in traditional manner requiring development of computerised methods. Being widely applied in public administration and economy for many years, computer search and data comparison has not been sufficiently exploited in criminalistics and forensic. Police agencies and forensic laboratories collect a significant amount of various data resulting from the analysis of numerous criminal activities. A success of the automatic search and comparison in criminal investigations essentially depends on the availability and characteristics of the existing data about persons, objects or events. From 2006 onwards, automatic computer search of personal and other related data has become available as particular evidential act within Serbian criminal legislation which was a decisive motive for writing this article.
AB  - Prikupljanje najraznovrsnijih informacija o građanima i njihovo smeštanje u odgovarajuće baze, predstavlja realnost savremenog društva. Rast količine ovih informacija prevazišao je čovekove moći da tradicionalnim sredstvima obrađuje i analizira tako velike količine podataka, iziskujući kompjuterizovane metode za ove potrebe. Iako godinama unazad ima široku primenu u poslovima javne uprave i privrede, kompjutersko pretraživanje i upoređivanje podataka do sada nije dovoljno eksploatisano u kriminalistici i forenzici. Policijske agencije i forenzičke laboratorije sakupljaju velike količine različitih podataka, koji nastaju kao rezultat obrade brojnih kriminalnih aktivnosti. Sam uspeh njihovog automatskog pretraživanja i upoređivanja u krivičnim istragama u presudnoj meri zavisi od raspoloživosti i karakteristika podataka (obeležja, rastera) koja se odnose na lica, predmete ili događaje. Od 2006. godine i srpsko krivično zakonodavstvo, kao posebnu dokaznu radnju, predviđa automatsko računarsko pretraživanje ličnih i drugih sa njima povezanih podataka, što je bio odlučujući motiv za pisanje ovog rada.

AB  - Graphical methods for displaying information represent one of the most efficient method for visualization and integration of large amounts of data on organized crime groups and their connections. Application of these methods in investigating organized crime allows the organization of existing data so as to provide an insight into all important aspects of criminalistic investigation in a short period of time. Specifically, the criminal investigation of organized crime accumulate a large quantity of data from numerous sources over long periods tim, and contain information on a wide range of organizations, activities and people involved in organized criminal activity. An analyst using the graphical methods in the analysis of these data gives them a new dimension. The authors pay special attention to the application of the graphical methods in making the connection diagrams, telephone call diagrams and the chronology of events diagrams in investigations of organized crime offences. The effective use of these methods to display information can significantly improve performance in preventing and combating all crime, including organized crime offences.
AB  - Grafički metodi za prikaz informacija predstavljaju jedan od izuzetno efikasnih načina za prikaz i integraciju velikog broja podataka o organizovanim kriminalnim grupama i njihovim vezama. Pri­mena ovih metoda u istragama organizovanog kriminala omogućava organizaciju postojećih podataka na takav način da se u kratkom vremenskom intervalu može dobiti uvid u sve značajne aspekte kriminalističke obrade. Naime, kriminalističke obrade slučajeva organizovanog kriminala obiluju podacima koje duže vreme prikupljaju različita lica, a sadrže informacije o velikom broju organizacija, delatnosti i ljudi uključenih u organizovane kriminalne aktivnosti. Koristeći ove podatke analitičar primenom grafičkih metoda tokom procesa analize tim podacima daje jednu novu dimenziju. Autori u radu posebnu pažnju posvećuju primeni grafičkih metoda u izradi dijagrama veza, telefonskih poziva i hronologije događaja u istragama krivičnih dela organizovanog kriminala. Efikasno korišćenje ovih metoda za prikaz informacija može značajno da poboljša rezultate rada u sprečavanju i suzbijanju svih krivičnih dela, uključujući i krivična dela organizovanog kriminala.

AB  - This paper deals with crime reconstruction as a method of crime investigation which represents a set of systematic, analytical processes which serve to provide relevant information about the manner of creation and dynamics of crime perpetration. Special attention is paid to ethical principles of crime reconstruction, as well as to the relationship between a scientific method and crime reconstruction method. In addition to this, basic information on models, scientific principles and practical standards of crime reconstruction have been presented. The subject of research is directed towards the analysis of determinants of creation of material pieces of evidence, as well as towards establishing theories and scientific principles for their analysis in order to deduct evidence admissible in court. Finally, the paper analyses the place of crime reconstruction within a complex procedure of its clearing up and proving.
AB  - Rekonstrukcija krivičnog dela se definiše kao skup sistematskih analitičkih procesa kojima se obezbeđuju relevantne informacije o načinu nastanka i dinamici izvršenja krivičnog dela. Polaznu osnovu u njenoj realizaciji čine materijalni dokazi, do kojih se najvećim delom dolazi na uviđaju, ali i iskazi svedoka, žrtve i okrivljenog. Pri tome treba imati u vidu činjenicu da je percepcija krivičnog dela od strane različitih subjekata različita, te da je rezultat odraza radnje i determinanti krivičnog dela u njihovoj svesti. Rezultati rekonstrukcije zavise od poštovanja etičkih principa profesije, primene naučnih metoda i praktičnih standarda analize dokaza. Takođe, oni su direktno uslovljeni i profesionalizmom koji se manifestuje kroz stručnu (posedovanje neophodnih znanja vezanih za profesiju) i moralnu komponentu (etički kodeks profesije) ličnosti kriminaliste. Objektivna analiza činjenica, odnosno dokaza, podrazumeva postojanje profesionalnog integriteta i nezavisnosti osobe koja izvodi zaključke. Poseban akcenat u postupku rekonstrukcije treba staviti na praktične standarde, kao fundamentalna pravila interpretacije dokaza u postupku rekonstrukcije krivičnog dela.

The criminality of violence: Serial murders

AB  - Violence and murders represent the gravest forms of negation of the law. Following that fact, which is, according to the author, indisputable, the first part describes the terms which are most commonly used in defining the greatest number of murders performed by one perpetrator(serial killer, mass killer, spree killer). Besides that, in order to achieve insight into the abundance of terms which are used to designate certain murders, their short review is presented regarding the fact who the perpetrator is and who the victim of the murder is. In the second part of this work, consisting of two units, we point out the objective danger coming from the criminal acts of violence, and above all, from the murders, especially serial ones. The results of the research are given in the first part: who the most famous serial killers in Europe are, both in distant as well as in the recent past. The second part is a short analysis of the criminal acts of murder done in Republic of Serbia and Belgrade in the period between 2001 and 2005. In the end, as a conclusion of the work, as a prerequisitive for a successful prevention of criminal acts of violence, the definition of the following principle is given: Clearly demonstrated and legally defined cooperation of all segments of society based on partnership and sharing of responsibility is a basis for prevention of violence.
AB  - Nasilje i ubistva predstavljaju najteži oblik negacije prava. Prateći tu, po autoru nespornu činjenicu, u prvom delu rada objašnjeni su termini koji se najčešće koriste za određenje većeg broja ubistava izvršenih od strane jednog učinioca (serijski ubica, masovni ubica). Pored toga, radi sticanja uvida u bogatstvo termina kojim se označavaju pojedina ubistva, dat je njihov kratak pregled u zavisnosti od toga ko je učinilac a ko žrtva. U drugom delu rada, koga čine dve celine, ukazano je na objektivnu ugroženost od krivičnih dela nasilja, a pre svega ubistava i to serijskih. Prvu od navedene dve celine čine rezultati istraživanja, ko su najpoznatije serijske ubice na području Evrope, kako u dalekoj prošlosti tako i u skorašnjoj istoriji. Druga celina predstavlja kratku analizu krivičnih dela ubistava izvršenih na području Republike Srbije i Beograda u periodu od 2001. do 2005. godine. Na kraju, u zaključcima rada, kao preduslov za uspešnu prevenciju krivičnih dela nasilja definisan je princip: Jasno ispoljena i zakonski definisana saradnja svih segmenata društva zasnovana na partnerstvu i podeli odgovornosti osnova je za prevenciju nasilja.

AB  - The analysis represents a systematic procedure of studying crime problems. It involves the process of defining the ways for collecting, processing, classification, identification and use of the acquired information. In the first part, by pointing out the importance of crime analysis for the police work, the author gives some basic information about the process of analysis, statistic techniques, concrete analytical methods and computer software, used as the necessary back-up for keeping, analysis and use of the given information. In the presentation of the information about the process of analysis, a particular emphasis is placed on the need for respecting this principle - the process of analysis directly conditions the results of the crime analysis. In addition to this, the author points out the fundamental ideas of the theories most frequently used for explaining the indicators of crime, and above all: Routine Activity Theory, Rational Choice Theory and Crime Pattern Theory. In the second part, depending on the purpose and primary cause of the analysis, the author shows the most common types of analyses: Intelligence Analysis, Criminal Investigative Analysis, Tactical Crime Analysis (TCA), Strategic Crime Analysis (SCA), Administrative Crime Analysis (ACA). In the end, it is pointed out to the importance of the analysis for the police work, starting with the organization of the everyday work to the definitions of strategies for fighting the crime.
AB  - Analiza predstavlja postupak proučavanja problema kriminaliteta koji se sastoji u definisanju načina prikupljanja, obrade, klasifikacije, identifikacije i korišćenja tako dobijenih informacija. Ukazujući na značaj analize kriminaliteta za rad policije, autor je u prvom delu rada dao osnovne informacije o postupku analize, konkretnim analitičkim metodama, statističkim tehnikama i kompjuterskim softverima koji se koriste kao neophodna podrška za skladištenje, analizu i korišćenje dobijenih informacija. U prezentaciji informacija o postupku analize posebno je naglašena potreba za poštovanjem načela: rezultati analize kriminaliteta direktno su uslovljeni postupkom analize. Pored toga, autor je posebno istakao osnovne postulate najčešćih teorija koje se koriste za objašnjenje izvedenih indikatora, a pre svega: Teorije rutinske aktivnosti, Teorije racionalnog izbora i Teorije obrasca kriminalnog ponašanja. U drugom delu, u zavisnosti od svrhe i primarnog cilja analize, autor je ukazao na najčešće vrste analiza: Obaveštajnu analizu; Analizu ličnosti učinioca; Taktičku analizu kriminaliteta; Strategijsku analizu kriminaliteta i Administrativnu analizu. Na kraju, ukazano je na značaj analize za rad policije, počev od organizacije svakodnevnog rada, pa sve do definisanja strategija za borbu protiv kriminaliteta.

AB  - Ministarstvo unutrašnjih poslova Republike Srbije i Odeljenje za međunarodni razvoj britanske vlade (DFID) - Program za bezbednost, sigurnost i dostupnost pravde na Balkanu (SSAJP), sproveli su evaluaciju pilot projekta „Policija u lokalnoj zajednici i bezbednost zajednice u Srbiji“. Rad predstavlja sažet prikaz rezultata sprovedene evaluacije, koja je tako zamišljena da obezbedi objektivnost i kritičnost u ocenjivanju na svakoj pilot lokaciji. Zbog toga je i sprovedena od strane autora koji nisu učestvovali u implementaciji samog projekta. Kao osnova za izvođenje zaključaka poslužili su: rezultati upitnika i intervjua obavljeni sa predstavnicima policije i lokalne zajednice, kao i rezultati sprovedene ankete sa građanima. U radu su prezentovana tematski grupisana zapažanja o primeni osnovnih principa policije u lokalnoj zajednici, preporuke date za otklanjanje identifikovanih problema i postizanje standarda u postupanju, kao i zaključak, u kome je činjenično ukazano na prednosti projekta policije u zajednici u odnosu na tradicionalni model policijskog rada.

AB  - A crucial factor of finding a solution to a problem is the knowledge of its main characteristics. The said approach in a proving procedure offers an option of a more efficient resolving the practical criminal-tactical tasks. Bearing this in mind, a special attention in this paper is paid to the cases of violent crime. Analogue to that, along with the definition of violent crime concept, the status of offender-victim conflict and trends of its movement are presented. Also, the initial grounds for a better quality approach to proving violent criminal offenses are given. Further, a considerable attention is paid to the analysis of the consequence being the basis of an objective conclusion drawing on the offender-victim relation during crime committing. In the end, in a short review given instead of a conclusion, the need for a more intensive and profound research of this problem is pointed to.
AB  - Osnovni uslov za rešavanje jednog problema jeste poznavanje njegovih bitnih karakteristika. Navedeni pristup u postupku dokazivanja pruža mogućnost za efikasnije rešavanje praktičnih kriminalističko-taktičkih zadataka. Imajući u vidu tu činjenicu, u radu je posebna pažnja posvećena nasilničkom kriminalitetu. Analogno tome, pored određenja pojma nasilničkog kriminaliteta ukazano je na stanje i trendove kretanja, karakteristike konflikta učinilac - žrtva, a date su i polazne osnove za kvalitetniji pristup u dokazivanju krivičnih dela nasilničkog kriminaliteta. Osim toga znatna pažnja posvećena je analizi posledice kao osnovi za objektivno izvođenje zaključaka o odnosu između učinioca i žrtve u toku izvršenja krivičnog dela. Na kraju, umesto zaključka u kratkom osvrtu ukazano je na potrebu za većim izučavanjem ovog problema.

Causality application in the trace analysis of a committed criminal act

AB  - Causality presumes an objective approach to the analysis of the genesis of a criminal act appearance. By relating the traces and the objects to the cause they are the effects of, an objective basis is created for a quality reconstruction of the proceeding of a criminal act. By establishing the determinants of the mode of perpetration on the basis of the effects, it is possible to build the personality profile of the perpetrator. A tactical approach based on causality by which an attempt is made to set prognostic versions of the perpetrator's behavior after the crime had been committed is an objective basis for planing the measures and actions that should be taken within the framework of the forensic investigation.
AB  - Uzročnost podrazumeva objektivan pristup analizi geneze nastanka kriminalnog događaja. Povezivanjem tragova i predmeta sa uzrokom usled koga su nastali, stvara se objektivna osnova za kvalitetnu misaonu rekonstrukciju toka radnje kriminalnog događaja. Utvrđivanjem determinanti načina izvršenja, na osnovu posledice, omogućuje se izrada profila ličnosti učinioca. Taktički pristup koji na osnovu uzročnosti nastoji postaviti prognozne verzije o post deliktnom ponašanju učinioca predstavlja objektivnu osnovu za planiranje mera i radnji u okviru kriminalističke obrade.
