Legislative Framework of Nuclear Security in the Republic of Serbia

AB  - The paper presents the concept and characteristics of nuclear security, the elements of the nuclear safety strategy, the legislative framework and the most important solutions from the Law on Radiation and Nuclear Safety and Security. At the international level, the most important entity in this field is the International Atomic Energy Agency, while at the national level, most important is the Directorate for Radiation and Nuclear Safety and Security of Serbia. An important role is played by the Vinča Institute of Nuclear Sciences as the most referential scientific institution in this field, as well as the operational bodies – Nuclear Facilities of Serbia, the Ministry of Internal Affairs, Ministry of Defence, and the Serbian Armed Forces. Engagement of these bodies is carried out in regular peacetime circumstances, emergency situations and wartime. The most important challenges, risks and threats to nuclear security of Serbia were pointed out as well as the need to harmonize norms, procedures and processes in purpose of the strengthening institutional mechanisms in the field of nuclear security.
AB  - У раду су изложени појам и карактеристике нуклеарне и радијационе безбедности, елементи стратегије нуклеарне безбедности, легислативни оквир и важнија решења из Закона о радијационој и нуклеарној сигурности и безбедности. На међународном нивоу најважнији субјект у овој области је Међународна агенција за атомску енергију, док је на националном нивоу Директорат за радијациону и нуклеарну сигурност и безбедност Србије. Значајну улогу имају Министарство одбране, Војска Србије, Министарство унутрашњих послова Републике Србије, Институт за нуклеарне науке Винча као најреферентнија научна институција у овој области и Јавно предузеће Нуклеарни објекти Србије као оперативни орган. Ангажовање субјекта остварује се у редовним мирнодописким околностима, ванредним ситуацијама и ратним приликама. Указано је на најзначајније изазове, ризике и претње по нуклеарну безбедност у Србији, као и на потребу усаглашавања норми, процедура и процеса у циљу јачања институционалних механизама у области нуклеарне безбедности.

Public Risk Perspectives Regarding the Threat of Terrorism in Belgrade: Implications for Risk Management Decision-Making for Individuals, Communities and Public Authorities

AB  - The aim of this paper is to assess the risk of terrorist attacks as perceived by individuals, the local community as a whole, and municipal public safety officials in Belgrade, the capital of the Republic of Serbia. The structured questionnaire about perceived risk of terrorist attacks and preparedness was developed using close-ended, multiple choice questions and questionnaire items featuring 5-point Likert response options. Data were collected between June and September 2017 by a telephone survey using a random digit dialing procedure; 485 adult Serbian residents participated in the research voluntarily. Study participants exhibited low levels of perception vis-a-vis the future likelihood of terrorist attacks occurring in their communities, and only a moderate knowledge of counter-terrorism activities currently being undertaken by public safety authorities. Other responses to our questionnaire indicated statistically significant differences in perception of the risks of terrorism threats in Belgrade with respect to demographic variables such as age, gender, employment and past exposure to major emergencies. We encourage emergency management agencies in Serbia to use the differences in public perception of risks identified in our study to develop enhanced counter-terrorism preparedness measures through the promotion of behavioural change. Such action goes hand-in-hand with the adoption of improved risk management decision-making procedures. Furthermore, to improve risk management decision-making we need to anticipate virtually all possible scenarios because terrorism is now a clear and present danger to the safety of the citizens of Serbia. All cities and towns in Serbia need to have up-to-date disaster plans that are tailored to specific scenarios and locations as opposed to only preconceived generalized plans.

Cracking caused by cutting of plasma-sprayed hydroxyapatite coatings and its relation to the structural features of coatings deposited at different initial substrate temperatures

AB  - The present study estimated the cracking phenomenon in as-plasma-sprayed hydroxylapatite coatings (HACs) after they were being subjected to the severe cutting conditions in the direction perpendicular to the coating/substrate interface. In order to evaluate the effects of substrate preheating on the occurrence of micro-cracks, the HACs were deposited at different initial substrate temperatures (T-S = 20, 100 and 200 degrees C). The changes in phase composition and HA splat morphology with T-S were observed and were correlated with the cracking occurrence. The results showed that severe cutting conditions introduced a localized cracking in the regions of HACs dominantly attributed to the brittle hydroxyl- deficient amorphous calcium phosphate (ACP) phase. This effect was particularly observable in the HACs deposited without preheating of substrate. On the other hand, the preheating of substrate reduced the presence of micro-cracks and caused insignificant changes in the average local phase composition. In HACs deposited with preheating of substrate, the HA splats (of which HACs are composed) were thinner and recrystallized HA regions seemed smaller in size and more evenly distributed. These results implied potentially important roles of the HA splat formation mechanism on the distribution of ACP and recrystallized HA regions in the as-plasma-sprayed HACs and the cracking resistance of HACs.

Serbia's Action against Transnational Organised Crime

AB  - This article examines the extent to which Serbia has implemented relevant international standards on action against transnational organised crime contained in the United Nations Convention against Transnational Organised Crime 2000. The first part explores key obligations with particular reference to prohibition of substantive offences, intelligence-led law enforcement (special investigative techniques), confiscation of criminal proceeds, as well as international law enforcement cooperation. The second part of the article analyses how these obligations are implemented by Serbia in reality by examining legislative frameworks as well as law enforcement practices. The main conclusion is that, while Serbia has taken some steps to implement international standards with a view to enhancing individual and collective actions against transnational organised crime, effective law enforcement is hampered by issues such as corruption and a lack of expertise, experience and resources.

European Union's information exchange legal framework: A prerequisite for successful co-operation in fighting organized crime

AB  - The contemporary social conditions increasingly enable the development of transnational organized crime. Considering this fact a global response is required, or rather the development of general strategies of international character. The authors of the paper discuss certain, i.e. the most dangerous forms of organized crime which are present in Serbia as well as in the entire international community. Also, in order to make investigations and prosecutions easier, it is necessary to develop cooperation. Information exchange, as well as exchange of intelligence and evidence collecting data is a prerequisite for improving safety. Timely access to the relevant and objective information is a key element for successful detection, prevention and proving criminal offenses. Enhancing the co-operation, defining the legal framework and the establishing of technical possibilities, particularly with the handling of electronic, digital evidence, effective and timely compliance with requests for mutual legal assistance are prerequisites for success.
AB  - Savremeni društveni uslovi sve više omogućavaju razvoj transnacionalnog organizovanog kriminala. S tim u vezi, potreban je globalni odgovor ili, bolje rečeno, razvoj generalnih strategija međunarodnog karaktera. Autori se u radu osvrću na pojedine, najopasnije oblike organizovanog kriminala koji su prisutni kako u Srbiji tako i u čitavoj međunarodnoj zajednici. Takođe, da bi se olakšale istrage i krivična gonjenja, neophodno je razvijati saradnju. Razmena informacija, obaveštajnih i dokaznih podataka preduslov je za poboljšanje bezbednosti. Blagovremen pristup relevantim i objektivnim informacijama ključni je element za uspešno otkrivanje, sprečavanje i dokazivanje krivičnih dela. Unapređenje saradnje, definisanje pravnih okvira i uspostavljanje tehničkih mogućnosti, naročito za rukovanje elektronskim, digitalnim dokazima, i efikasno i blagovremeno postupanje u skladu sa zahtevima za uzajamnu pravnu pomoć - preduslovi su za uspeh.

Information exchange, as well as exchange of intelligence and evidence collecting data is a prerequisite for improving safety. Timely access to the relevant and objective information is a key element for successful detection, prevention and proving criminal offenses. Enhancing the co-operation, defining the legal framework and the establishing of technical possibilities, particularly with the handling of electronic, digital evidence, effective and timely compliance with requests for mutual legal assistance are prerequisites for success., Savremeni društveni uslovi sve više omogućavaju razvoj transnacionalnog organizovanog kriminala. S tim u vezi, potreban je globalni odgovor ili, bolje rečeno, razvoj generalnih strategija međunarodnog karaktera. Autori se u radu osvrću na pojedine, najopasnije oblike organizovanog kriminala koji su prisutni kako u Srbiji tako i u čitavoj međunarodnoj zajednici. Takođe, da bi se olakšale istrage i krivična gonjenja, neophodno je razvijati saradnju. Razmena informacija, obaveštajnih i dokaznih podataka preduslov je za poboljšanje bezbednosti. Blagovremen pristup relevantim i objektivnim informacijama ključni je element za uspešno otkrivanje, sprečavanje i dokazivanje krivičnih dela. Unapređenje saradnje, definisanje pravnih okvira i uspostavljanje tehničkih mogućnosti, naročito za rukovanje elektronskim, digitalnim dokazima, i efikasno i blagovremeno postupanje u skladu sa zahtevima za uzajamnu pravnu pomoć - preduslovi su za uspeh.",

AB  - Терористички напади, велики број миграната из ратом захваћених подручја Азије и Африке, организовани и високотехнолошки криминалитет, код многих грађана су створили страх
за личну и породичну безбедност. Тренутни облици сарадње на
међународном нивоу више нису довољни, све чешће се говори о
новим оперативним моделима сарадње, који укључују и формирање наднационалних оперативних јединица. Безбедност ЕУ и глобална безбедност су међусобно повезане и условљене категорије.
Европском агендом безбедности 2015-2020. године, унапређени
су инструменти за супротстављање криминалитету предвиђени у
Стратегији унутрашње безбедности ЕУ из 2010. године. Посебна
пажња је посвећена размени информација, оперативној сарадњи,
обуци и истраживањима криминалитета. Аналогно географској
позицији Републике Србије и жељи да постанемо чланица ЕУ део
анализе је посвећен правним и институционалним капацитетима Републике Србије за сарадњу. На крају, критички је указано на проблеме и мере за унапређење међународне сарадње.

AB  - The article contains introduction, conclusion and three logically connected chapters. Introduction presents a short review of etymology meaning of the term "street crime group", "gang" and "clan". In the first chapter "Concept and characteristics of street crime groups" the authors research different definitions of street crime groups, theirs basic characteristics, as presentation results from different studies of numerous and characteristic street crime groups in Europe and the United States. Based on the hypothesis that violence is important feature of street crime groups, the second chapter presents phenomenology of homicide which are committed by their members. In this chapter the authors indicate modi operandi and the principles which could be used in the analysis of consequences of unknown offender profile of homicide. Conclusion contains information about problems related to street crime groups in the Republic of Serbia.
AB  - Rad pored uvoda i zaključka čine tri logički povezana dela. U uvodu je dat kratak osvrt na etimološko značenje termina "ulična kriminalna grupa", "gang" i "banda". U prvom delu "Pojam i karakteristike uličnih kriminalnih grupa", autori su svoj predmet istraživanja usmerili na prikaz različitih definicija uličnih kriminalnih grupa, njihovih osnovnih karakteristika, kao i prezentaciju rezultata različitih studija o broju i karakteristikama uličnih kriminalnih grupa u Evropi i SAD-u. Polazeći od hipoteze da je nasilje bitno obeležje uličnih kriminalnih grupa u drugom delu je dat prikaz pojavnih oblika krivičnog dela ubistva koja se vrše od strane njihovih članova. U ovom delu autori su se osvrnuli i na opis načina izvršenja i principe koji se mogu koristiti u analizi posledice i izvođenju zaključaka o elementima profila nepoznatog učinioca izvršenog ubistva. Logično, na kraju, prezentovani su modeli programa za prevenciju uključivanja mladih u bande Nacionalnog centra za prevenciju kriminala u Kanadi. U zaključku, iznete su osnovne informacije o problemu uličnih kriminalnih grupa u Republici Srbiji.

AB  - There are various motives of committing a criminal act. When we talk about homicide, we need to say that it can be the result of huge number of motives, first of all, revenge, blood feud, material gain, jealousy, political motives, sexual motives, etc. The authors present motivational model of multiple-serial killers, and pay attention on factors which contribute that a person becomes a serial killer. First of all, they focus on influence of inadequate social environment, events during childhood, model of responsibility and operations directed to others and us.
AB  - Polazeći od velikog broja determinanti koje mogu uticati na neko lice da izvrši seriju seksualno motivisanih ubistava, autori u radu vrše analizu motivacionih modela, kojima se nastoji dati odgovor na pitanje zašto jedno lice postane učinilac serije takvih krivičnih dela. Pri tome, posebnu pažnju su usmerili na motivacioni model koji su Berdžes i njegovi saradnici koristili u objašnjenju seksualno motivisanih ubistava i model kontrole traume koji je definisao Hiki (Hickey). Na kraju, s ciljem objektivnijeg sagledavanja ubistava, date su kratke informacije o motivacionom spektru koji su Revič i Šlezindžer koristili za klasifikaciju serijskih ubistava.

AB  - Relevant element of law enforcement work is collecting data about criminal act which we can get from witnesses (including victims) and persons suspected for committing a crime. It is a very important issue for success of each the process of proving. The special subject of objective analysis of statement presents criminalistic analysis truthfulness of written statements, transcripts or recorded statements. For criminalistic analysis today we often use two techniques, whereby authors in article write about that: Criterion Based Statement Analysis-CBSA and Scientific Content Analysis-SCAN.
AB  - Nezaobilazan element policijskog rada čini prikupljanje informacija koje o krivičnom delu mogu dati potencijalni svedoci (uključujući i žrtve) i lica osumnjičena za njegovo izvršenje. To je bitan elemenat za uspeh svakog postupka dokazivanja. Poseban predmet objektivne analize iskaza predstavlja kriminalistička analiza istinitosti pisanih izjava, transkripata, ili snimljenih izjava. Danas se za kriminalističku analizu izjava najčešće koriste dve tehnike, pri čemu se autori u radu upravo osvrću na njih: Analiza izjave na osnovu kriterijuma (Criterion Based Statement Analysis-CBSA) i Naučna analiza sadržaja (Scientific Content Analysis-SCAN).

Trafficking in women and children for sexual exploitation

AB  - There are different kinds of women and children exploitation in the world today. The main reasons for women and children being trapped in human trafficking are mostly financial, but beside them there are also other reasons such as the rise of the organized crime, migrations, deterioration of country's institutions, the process of transition, etc. The most present form of women and children exploitation is the sexual exploitation that most often leaves hard psycho-social consequences on victims, where force and frightening are used as the most frequent methods against them. Women and children trafficking is a very profitable activity among the organized crime groups which are engaged in this phenomenon just because of the possibility of gaining high profits. According to specific estimates, it is believed that the crime groups make a year income between one hundred million to several billions of euros just by this form of crime. Considering the existing forms of exploitation of women and children, starting from labor exploitation through the illegal adoption of children, trafficking in human organs, forced marriages, as well as involving in armed conflicts, we believe that sexual exploitation will have prevailing influence in this part of the Europe in the future.
AB  - Problem trgovine ljudima u svetu je danas veoma aktuelan. Kao oblik transnacionalnog organizovanog kriminala, on predstavlja samo jednu u nizu kriminalnih delatnosti koji- ma se bave organizovane kriminalne grupe. U širem kontekstu, trgovina ljudima, a pre svega trgovina ženama i decom u cilju seksualne eksploatacije, smatra se najrasprostranjenijim oblikom iskorišćavanja u Evropi. Zemlje članice Evropske unije najčešća su mesta destinacije žrtava trgovine, dok su zemlje centralno-istočne Evrope i Balkana mesta porekla i tranzita. Aktuelna istraživanja ukazuju da više od 80% žrtava potiče iz jugoistočne Evrope i da je većina prisiljena da se bavi prostitucijom. Žrtve su najčešće ženska lica, starosti između 20 i 25 godina međutim oko 30% čine devojčice između 15 i 18 go- dina. U odnosu na ostale oblike trgovine ljudima, trgovina ženama i decom u cilju seksualne eskploatacije ostavlja najteže i najkomplikovanije posledice na žrtvu.

The main reasons for women and children being trapped in human trafficking are mostly financial, but beside them there are also other reasons such as the rise of the organized crime, migrations, deterioration of country's institutions, the process of transition, etc. The most present form of women and children exploitation is the sexual exploitation that most often leaves hard psycho-social consequences on victims, where force and frightening are used as the most frequent methods against them. Women and children trafficking is a very profitable activity among the organized crime groups which are engaged in this phenomenon just because of the possibility of gaining high profits. According to specific estimates, it is believed that the crime groups make a year income between one hundred million to several billions of euros just by this form of crime. Considering the existing forms of exploitation of women and children, starting from labor exploitation through the illegal adoption of children, trafficking in human organs, forced marriages, as well as involving in armed conflicts, we believe that sexual exploitation will have prevailing influence in this part of the Europe in the future., Problem trgovine ljudima u svetu je danas veoma aktuelan. Kao oblik transnacionalnog organizovanog kriminala, on predstavlja samo jednu u nizu kriminalnih delatnosti koji- ma se bave organizovane kriminalne grupe. U širem kontekstu, trgovina ljudima, a pre svega trgovina ženama i decom u cilju seksualne eksploatacije, smatra se najrasprostranjenijim oblikom iskorišćavanja u Evropi. Zemlje članice Evropske unije najčešća su mesta destinacije žrtava trgovine, dok su zemlje centralno-istočne Evrope i Balkana mesta porekla i tranzita.
