Internationalization of constitutional law: The example of the Republic of Serbia

AB  - Constitutional Law is in the process of increasingly intensified internationalization. The process of internationalization of constitutional law is accompanied by the process of consitutionalization of international law. The two processes involve terminology whose meaning is yet to be clearly defined. The ensuing confusion has been further compounded by the emergence of new terms refering to a process similar to but not the same as the process of internationalization of constitutional law (for example, the globalization of constitutional law). Hence, this paper aims to contribute to the understanding and clarification of modern trends in the deve­lopment of constitutional law and to point out the differences between the existing processes that are simultaneously taking place in the sphere of constitutional law. At the same time, the paper will also discuss the process of normative and factual internationalization of constitutional law of the Republic of Serbia.
AB  - Ustavno pravo je u procesu sve intenzivnijeg internacionalizovanja. Uporedo sa procesom internacionalizacije ustavnog prava odvija se proces konstitucionalizacije međunarodnog prava. Reč je o terminima koji još uvek nemaju jasno određeno značenje, a dodatnoj konfuziji doprinosi i pojava novih termina koji označavaju slične procese, ali ne i istovetne sa procesom internacionalizacije ustavnog prava (na primer, globalizacija ustavnog prava). Otuda ovaj rad ima za cilj da doprinese razumevanju savremenih trendova u razvoju ustavnog prava i da ukaže na razlike između aktuelnih procesa koji se uporedo odvijaju u sferi ustavnog prava. Ujedno, u radu se ukazuje na procese normativnog i faktičkog internacionalizovanja ustavnog prava Republike Srbije.

Police Perceptions of Discrimination in Serbia

AB  - One of the key requirements of a democratic society is the absence of police discrimination. Discriminatory treatment by the police is a challenge in many societies, and every society that wishes to be truly democratic, should aim to keep police discrimination to an absolute minimum and continuously work on its elimination. One step toward this is studying the perceptions and understanding that police have toward discrimination to enable the most effective preventive measures to any discriminatory behaviour they may exhibit. This paper presents the results of a study conducted on the attitudes of police officers toward discrimination in the Republic of Serbia. This research focused on the recognition of the meaning of discrimination and awareness of the presence of discrimination in Serbian society by police officers, the level of police social and ethnic distance toward different groups, police perceptions as to the influence and responsibility that public and social institutions can have in provoking discrimination, as well as the existence and acceptance of prejudice among police officers in Serbia.

Да ли је уставна жалба делотворно правно средство? – Осврт на десет година примене Устава Србије од 2006. године

AB  - У овом раду аутор анализира институционалну физиономију уставне жалбе, као и праксу њеног коришћења. Први
је утисак да Устав веома екстензивно поставља могућност коришћења уставне жалбе, што ствара опасност од загушивања
рада Уставног суда. Подаци о раду Уставног суда показују да
је одлучивање по уставним жалбама постала доминантна надлежност овог органа. Осим тога, могућност Уставног суда да
поништава судске одлуке створила је тензију између овог органа и редовног правосуђа. Отуда, однос између Уставног суда
и редовног правосуђа мора бити конзистентније и прецизније
нормативно уређен. Смањење броја предмета пред Европским
судом за људска права против Србије указује да уставна жалба постаје све делотворније правно средство. Ипак, за потпуно
афирмисање уставне жалбе као правног средства за заштиту
људских права, неопходна је изградња и одговарајуће правне
културе за коју је потребно одговарајуће време.
AB  - In this paper the author analyses the institutional physiognomy of constitutional appeal, as well as it application in practice. At
first glance, it seems that the 2006 Constitution of Serbia has very extensively established the use of constitutional appeal, which created a
risk of stifling the work of the Constitutional Court. The data regarding the work of the Constitutional Court show that deciding on constitutional appeals has become the dominant competency of this body.
In addition, the possibility of the Constitutional Court to annul court
decisions has created tension between this court and the regular court
system. Hence, the relationship between the Constitutional Court and
the regular courts must be regulated more precisely and more consistently by legal provisions. In any case, the decreasing number of cases
appearing before the European Court for Human Rights against Serbia shows that constitutional appeal is an increasingly effective legal
remedy. However, for full affirmation of constitutional appeal as the
legal remedy for protection of human rights, it is also necessary to develop appropriate legal culture which requires time.

Euthanasia and ethical dillemas: Human dignity against sanctity of life

AB  - The paper analyses ethical dilemmas and conflicting issues tied to euthanasia and the institutionalization of the right to a dignified death, viewed through a prism of arguments in favour of and against euthanasia, solutions of comparative law and the practice of the European Council and The European Court of Human Rights in this field, as well as the existing practices of physicians with respect to the implementation of various modalities of euthanasia. At the national lavel, the topic is becoming of interest as the Preliminary Draft of the Civil Code, in essence foresees, that this right can be effectuated in exceptional cases whereby all humane, psycho-social and medical conditions are fulfilled; whilst in a public hearing regarding the proposed solution showed a lack of readiness of the expert public, primarily medical, for radical changes in this field. Taking into consideration that passive euthanasia, whereby an incurable disease is allowed to run its course is widespread in medical practice, and that palliative care cannot provide all dying patients with cumbrous symptoms a peaceful and dignified death, the question of the right to euthanasia should be approached without hypocrisy. Access to euthanasia should be enabled, but under strict conditions, exclusively to individuals that are in the conclusive stages of an incurable illness, where death within a foreseeable time period is inevitable. Conditions and procedures tied to euthanasia should be precisely defined, so as to avoid its misuse and to establish clear rules in terms of physician accountability.
AB  - U radu se razmatraju etičke dileme i sporna pitanja vezana za eutanaziju i institucionalizovanje prava na dostojanstvenu smrt, sagledane kroz prizmu argumenata za i protiv ozakonjenja eutanazije, uporednopravnih rešenja i prakse Saveta Evrope i Evropskog suda za ljudska prava u ovoj oblasti, kao i postojeće lekarske prakse u pogledu sprovođenja različitih modaliteta eutanazije. Na domaćim prostorima tema dobija na aktuelnosti budući da Prednacrt Građanskog zakonika Srbije načelno predviđa pravo na eutanaziju kao pravo koje se može izuzetno ostvariti ako se ispune propisani humani, psiho-socijalni i medicinski uslovi, dok je, pak, javna rasprava o predloženom rešenju pokazala nespremnost stručne javnosti, pre svega medicinske, za radikalne promene u ovoj oblasti. Imajući u vidu da je pasivna eutanazija, odnosno prepuštanje da neizlečiva bolest ide svojim prirodnim tokom raširena u lekarkoj praksi, te da palijativna nega ne može obezbediti svim umirućim pacijentima sa mučnim simptomima mirnu i dostojanstvenu smrt, pitanju prava na eutanaziju bi trebalo prići bez hipokrizije. Etuanaziji bi valjalo omogućiti, ali pod restriktivnim uslovima, isključivo licima koja boluju od neizlečive bolesti u završnoj fazi, a smrtni ishod je neminovan u kratkom i predvidivom periodu. Uslove i procedure vezane za eutanaziju trebalo bi što preciznije urediti, kako bi se izbegle zloupotrebe i postavila jasna pravila lekarske odgovornosti.

Imajući u vidu da je pasivna eutanazija, odnosno prepuštanje da neizlečiva bolest ide svojim prirodnim tokom raširena u lekarkoj praksi, te da palijativna nega ne može obezbediti svim umirućim pacijentima sa mučnim simptomima mirnu i dostojanstvenu smrt, pitanju prava na eutanaziju bi trebalo prići bez hipokrizije. Etuanaziji bi valjalo omogućiti, ali pod restriktivnim uslovima, isključivo licima koja boluju od neizlečive bolesti u završnoj fazi, a smrtni ishod je neminovan u kratkom i predvidivom periodu. Uslove i procedure vezane za eutanaziju trebalo bi što preciznije urediti, kako bi se izbegle zloupotrebe i postavila jasna pravila lekarske odgovornosti.",

AB  - Despite the prevailing view to the contrary, the Police Act of 2016 cannot be said to be a completely new law in the material sense. The manner in which it regulates the major concepts and institutions suggests that it is an amended and supplemented version of the Police Act of2005. The actual reasons for the enactment of the 'new ' law concern the legal employment status of employees of the Ministry of Interior, as well as the reduction of the internal affairs staff. The greatest expectations from the Act are in the part relating to the police staff management, monitoring of employees ' career development, through performance assessment, professional development and other trainings. Although with nomotechnic and editorial shortages, the Police Act, basically, represents an effective legal framework for the performance of, primarily, policing and other related duties.
AB  - Premda preovladava drugačije stanovište, za Zakon o policiji iz 2016. godine se ne može reći da je, u materijalnom smislu, u potpunosti nov zakon. Način uređivanja najznačajnijih pojmova i instituta sugeriše da je reč o donekle izmenjenoj i dopunjenoj verziji Zakona o policiji iz 2005. godine. Pravi razlozi donošenja 'novog' zakona tiču se radno-pravnog položaja zaposlenih u Ministarstvu, kao i redukcije kadrova u oblasti unutrašnjih poslova. Najveća očekivanja od Zakona su u delu koji se odnosi na upravljanje kadrovima u policiji, praćenje karijernog razvoja zaposlenih, kroz ocenjivanje rezultata rada, stručno usavršavanje i druge obuke. Iako nomotehnički i redaktorski manjkav, Zakon o policiji, u osnovi, predstavlja delotvoran pravni okvir za obavljanje pre svega policijskih i sa njima povezanih drugih poslova.

Contribution to the discussion on the banning of corporal punishment of children

AB  - This paper discusses the arguments pro et contra banning of corporal punishment of children, in light of existing comparative legal solutions, experience from foreign countries and results of scientific research on the effects of this method of child discipline. According to the current state of knowledge, the fact that corporal punishment of children does not produce long-lasting positive changes in behavior, but likely produces several detrimental consequences; implies that this child discipline method should be abandoned and substituted by alternative ones. The experience of countries where the corporal punishment of children has been outlawed for decades tells us this may be achieved primarily through awareness raising activities and measures aimed at empowering parents and caregivers. A tendency to equate corporal punishment with physical abuse may turn out to be ineffective in suppression of inadequate child discipline practices if the focus of societal reaction is predominantely put on punishment and stigmatization of parents and caregivers instead on their proper training and empowering, and activities aimed at raising public awareness on the rights of children.
AB  - U radu se razmatraju argumenti za i protiv zabrane fizičkog kažnjavanja dece u svetlu uporednopravnih rešenja, komparativnih iskustava i rezultata naučnih istraživanja o efektima ove prakse u disciplinovanju dece. Okolnost da, prema postojećim naučnim saznanjima, fizičko kažnjavanje dece ne proizvodi značajne pozitivne efekte, ali dovodi do određenih negativnih posledica, upućuje na to da ovu bi ovu praksu disciplinovanja trebalo napuštati i podsticati njenu supstituciju alternativnim metodama vaspitavanja dece. Iskustva zemalja u kojima već decenijama postoji zakonska zabrana fizičkog kažnjavanja dece govore da tom cilju treba težiti prevashodno podizanjem javne svesti i kroz mere osnaživanja roditelja i staratelja. Tendencija da se fizičko kažnjavanje izjednači sa fizičkim zlostavljanjem može se pokazati neproduktivnom u suzbijanju neadekvatnih praksi disciplinovanja i vaspitavanja dece ukoliko njen ishod bude to da se akcenat društvene reakcije stavi na stigmatizaciju i kažnjavanje roditelja i staratelja, umesto na njihovu edukaciju, osnaživanje i podizanje javne svesti o pravima deteta.

AB  - One of the key dilemmas faced in organizing a state and society concerns the importance afforded to central and local goals and interests. Adaptation to demographic, economic, political, scientific and technological changes in the environment requires changes in the status and role of local self-government. Adding to this mix, the constitutional and administrative traditions of Serbia affect the establishment and development of local self-government. Therefore, the enhancement of the model of local self-government must be studied using the historical method, among others. This paper aims to provide an overview of the historical development of local self-government in Serbia from the period of Developed Feudalism up to the mid-1990s. Historical considerations and traditions are vital to sustaining a certain practice of territorial decentralization of state power and to envisaging future solutions for the effective territorial organization and models of local (self) government in accordance with the realities of the region.

AB  - Since their emergence in ancient times - although in rudimentary form - human rights have continually evolved and have undergone multiple transformations. The initial stage in the development of human rights is characterised by their extremely modest and restrictive practice, as well as by the emergence of the first ideas of natural law that did not tend to change the unjust social reality. The stage of institutionalisation, which began in the Middle Ages, is characterised by the struggle to reduce the monarch's absolute power. This process has enabled a gradual recognition of human rights, primarily the guarantees of personal liberty and security. The process of constitutionalization of human rights, which began with glorious revolutions in the USA and France, was inspired by medieval ideas of natural law. At the time, the natural law theories were actualised for the first time in their history. The next stage in the development of human rights occurred after World War II, with the beginning of the process of their internationalisation and the emergence of human rights protection mechanisms at the international level. Nevertheless, in the recent decades of their development, through conversion into an ideology, human rights have increasingly become a means for manipulation. With their relativization and the growing trend of removing the line between rights and morality, there appeared interpretations that could justify (or condemn) very different life situations and thus present the basis for the application of double standards. Accordingly, human rights must be redefined and freed from association with natural law features; otherwise, they will remain a means for manipulation and pursuit of ethically (non)controversial political goals.
AB  - Od njihove pojave, doduše u rudimentarnom obliku, u starom veku, ljudska prava su neprestano evoluirala i višestruko su transformisana. Početnu fazu u razvoju ljudskih prava odlikuje njihova izrazito skromna i restriktivna praksa, kao i nastanak prvih prirodnopravnih ideja koje nisu imale pretenziju da menjaju nepravednu društvenu stvarnost. Fazu institucionalizacije ljudskih prava, započetu u srednjem veku, odlikuje borba za sužavanje monarhove apsolutne vlasti. U tom procesu se postepeno zadobijaju ljudska prava, i to prevashodno garantije lične slobode i bezbednosti. Proces konstitucionalizacije ljudskih prava, započet slavnim revolucijama u SAD i Francuskoj, podstaknut je srednjovekovnim prirodnopravnim idejama. Tada, prvi put u svojoj istoriji, prirodnopravne teorije bivaju otelovljene u stvarnosti. Sledeća faza u njihovom razvoju nastupila je nakon Drugog svetskog rata, kada je došlo do procesa internacionalizacije ljudskih prava i nastanka mehanizama njihove zaštite na međunarodnoj ravni. Međutim, ljudska prava u poslednjim decenijama svog razvoja putem ideologizacije postaju sve više sredstvo manipulacije. Njihovim relativizovanjem, kao i sve prisutnijim trendom brisanja granica između prava i morala, javljaju se interpretacije koje mogu opravdati (ili osuditi) veoma različite životne situacije i tako predstavljati podlogu za primenu dvostrukih standarda. Upravo iz tog razloga, ljudska prava moraju biti redefinisana i oslobođena svih prirodnopravnih primesa, jer će, u suprotnom, ona i dalje ostati sredstvo za manipulisanje i ostvarivanje moralno (ne)spornih političkih ciljeva.

The initial stage in the development of human rights is characterised by their extremely modest and restrictive practice, as well as by the emergence of the first ideas of natural law that did not tend to change the unjust social reality. The stage of institutionalisation, which began in the Middle Ages, is characterised by the struggle to reduce the monarch's absolute power. This process has enabled a gradual recognition of human rights, primarily the guarantees of personal liberty and security. The process of constitutionalization of human rights, which began with glorious revolutions in the USA and France, was inspired by medieval ideas of natural law. At the time, the natural law theories were actualised for the first time in their history. The next stage in the development of human rights occurred after World War II, with the beginning of the process of their internationalisation and the emergence of human rights protection mechanisms at the international level. Nevertheless, in the recent decades of their development, through conversion into an ideology, human rights have increasingly become a means for manipulation. With their relativization and the growing trend of removing the line between rights and morality, there appeared interpretations that could justify (or condemn) very different life situations and thus present the basis for the application of double standards. Accordingly, human rights must be redefined and freed from association with natural law features; otherwise, they will remain a means for manipulation and pursuit of ethically (non)controversial political goals., Od njihove pojave, doduše u rudimentarnom obliku, u starom veku, ljudska prava su neprestano evoluirala i višestruko su transformisana. Početnu fazu u razvoju ljudskih prava odlikuje njihova izrazito skromna i restriktivna praksa, kao i nastanak prvih prirodnopravnih ideja koje nisu imale pretenziju da menjaju nepravednu društvenu stvarnost. Fazu institucionalizacije ljudskih prava, započetu u srednjem veku, odlikuje borba za sužavanje monarhove apsolutne vlasti. U tom procesu se postepeno zadobijaju ljudska prava, i to prevashodno garantije lične slobode i bezbednosti. Proces konstitucionalizacije ljudskih prava, započet slavnim revolucijama u SAD i Francuskoj, podstaknut je srednjovekovnim prirodnopravnim idejama. Tada, prvi put u svojoj istoriji, prirodnopravne teorije bivaju otelovljene u stvarnosti. Sledeća faza u njihovom razvoju nastupila je nakon Drugog svetskog rata, kada je došlo do procesa internacionalizacije ljudskih prava i nastanka mehanizama njihove zaštite na međunarodnoj ravni. Međutim, ljudska prava u poslednjim decenijama svog razvoja putem ideologizacije postaju sve više sredstvo manipulacije. Njihovim relativizovanjem, kao i sve prisutnijim trendom brisanja granica između prava i morala, javljaju se interpretacije koje mogu opravdati (ili osuditi) veoma različite životne situacije i tako predstavljati podlogu za primenu dvostrukih standarda. Upravo iz tog razloga, ljudska prava moraju biti redefinisana i oslobođena svih prirodnopravnih primesa, jer će, u suprotnom, ona i dalje ostati sredstvo za manipulisanje i ostvarivanje moralno (ne)spornih političkih ciljeva.",

The Constitutional Court considerations of Vojvodina's territorial autonomy

AB  - While ruling on the constitutionality of the Law on establishing the competences of the Autonomous Province of Vojvodina, the Constitutional Court of the Republic of Serbia has found 22 provisions in this law unconstitutional. That offered an opportunity of which the Constitutional Court has tried to take advantage in further considerations of the constitutional framework for territorial autonomy. However, the Court has failed since it has made some inadmissible and discreditable errors. There was no detailed constitutional analysis of the established territorial autonomy concept. Therefore, many questions remained open. One of these open questions is the legal nature of the statute of autonomous province, on which the Constitutional Court will decide when the constitutionality of the supreme legal act of Vojvodina will be brought to the attention of the Court. If the Constitutional Court had been in a good way while ruling on the constitutionality of the above-mentioned Law, it would not have had so many hesitations while ruling on the constitutionality of the Vojvodina Statute.
AB  - Odlučujući o ustavnosti Zakona o utvrđivanju nadležnosti AP Vojvodine, Ustavni sud je doneo odluku kojom je proglasio neustavnim 22 odredbe ovog zakona. Bila je to prilika za Ustavni sud, koju je pokušao da iskoristi, da dalje razvija i precizira ustavni okvir teritorijalne autonomije. Međutim, u ovom svom nastojanju, Ustavni sud nije bio previše uspešan, budući da je načinio i neke nedopustive greške, dakako nedostojne ovog organa. Izostala je fina ustavnopravna analiza ustanovljenog koncepta teritorijalne autonomije, tako da su mnoga pitanja i dalje ostala otvorena. Jedno od tih otvorenih pitanja je i pravna priroda statuta autonomne pokrajine, o kojoj Ustavni sud tek treba da se izjasni kada bude odlučivao o ustavnosti najvišeg pravnog akta Vojvodine. Da je kojim slučajem bio na dobrom putu kada je odlučivao o (ne)ustavnosti pomenutog zakona, sada svakako ne bi bilo potrebe za tolikim oklevanjem kada treba da odluči o (ne) ustavnosti Statuta AP Vojvodine.

Institutional prerequisites for reconciliation of constitutional and real powers of the president of the Republic of Serbia

AB  - It is undoubted that the President of the Republic of Serbia represents the most controversial debating issue in constitutional theory and practice. We can find completely opposite attitudes toward the constitutional status of the President of the Republic: on the one hand, the prevailing opinion that the President of the Republic has an active role in the executive branch of the government, but on the other hand, the opinion that the President of the Republic is a figurehead and has only a moderating role. If we remain focused only on normative analysis, there is no doubt that we will be brought to a conclusion that the constitution-maker insisted on the moderating role of the President of the Republic making him an independent constitutional body providing the balance in the system of government. However, if we only analyze functioning of the system of government in practice, it is necessary to conclude that the president of the Republic has an active role in the executive branch. This gap between the written and the real Constitution is a consequence of mistakes and negligence in creating institutional physiognomy of the president of the Republic. Namely, the direct election of the president of the Republic is not followed by adequate powers. We can say that implementation of the semi- presidential system can be one of the possible ways to overcome shortcomings of the constitutional status of the President of the Republic of Serbia in the 2006 Constitution.
AB  - Nesumnjivo, predsednik Republike Srbije je institucija koja izaziva najviše kontroverzi prilikom teorijskopravnih rasprava. U teoriji se mogu susresti dijametralno suprotni stavovi o ustavnopravnom položaju predsednika Republike. Sa jedne strane, dominira stav da predsednik Republike predstavlja aktivnu vlast u okviru egzekutive, dok se sa druge strane zastupa teza da ova institucija ima ulogu moderatorne i pasivne vlasti. Ukoliko bi se zadržali isključivo na normativnoj analizi, nema dileme da bi zaključak bio da je ustavotvorac nastojao da od predsednika Republike stvori moderatornu vlast koja svojim nezavisnim ustavnopravnim položajem treba da doprinosi uspostavljanju ravnoteže u sistemu vlasti. Ipak, ako analizi podvrgnemo isključivo funkcionisanje sistema vlasti u praksi, neminovno bi zaključili da je predsednik Republike aktivni deo egzekutive. Ovaj raskorak pisanog i realnog ustava posledica je propusta i protivrečnosti pri ustavnom oblikovanju institucionalne fizionomije predsednika Republike. Naime, neposredan izbor predsednika Republike nije propraćen ovlašćenjima koja su prirodna posledica takvog načina izbora. Može se reći da bi uspostavljanje polupredsedničkog sistema mogao biti jedan od mogućih načina prevazilaženja nedostataka u ustavnopravnom položaju predsednika Republike iz 2006. godine.

Universalization and/or ideologization of human rights?

AB  - The goal of this paper is to analyze transformations of human rights in contemporary societies, as a result of intricacy of law and moral. Human rights, derived from the noble idea of natural rights, are becoming today an instrument of global politics with covert totalitarian tendencies. Most of contemporary wars are led with an excuse of universalization of human rights and spreading of concept of 'good governance'. Ideological nature of human rights, which is visible in unidirectional understanding and spreading the idea of ‘good’ life, is entirely evident. The authors, after analyzing and criticizing unselective transplanting and 'value burdening' of the notion of human rights in the Constitution of the Republic of Serbia, take a position of moral relativism of human rights, which would best suite to contemporary pluralistic societies.
AB  - U ovom radu autori analiziraju preobražaje ljudskih prava u savremenom društvu, koji predstavljaju posledicu isprepletenosti prava i morala. Ljudska prava, koja su izrasla iz plemenite ideje prirodnih prava, danas sve više postaju sredstvo vođenja svetske politike, sa skrivenim totalitarnim tendencijama. Pod izgovorom univerzalizacije ljudskih prava i širenja koncepta 'dobre vladavine' vodi se najveći broj ratova današnjice. Ideološki karakter ljudskih prava, koji se ogleda u jednosmernom razumevanju i širenju ideje 'dobrog' života, je potpuno primetan, a ponekad i ogoljen. Nakon analize i kritike neselektivnog preuzimanja i vrednosnog punjenja pojma ljudskih prava u Ustavu Republike Srbije, autori zastupaju stanovište moralnog (vrednosnog) relativizma u odnosu na ljudska prava, koje bi najbolje odgovaralo savremenim pluralističkim društvima.

AB  - The expansion of constitutional complaint through the landscape of European constitutionalism in the last decade of the XX century, as well as its implementation in the Serbian constitutional system in 2006, have increased the interest of Serbian legal scholars in this legal instrument. Comparative law does not provide a uniform institutional model of constitutional complaint, and experience of the Republic of Serbia with respect to this institute is very short. As a result, many questions regarding constitutional complaint have been raised in Serbian legal theory so far. This paper offers a theoretical and legal framework of the instrument of constitutional complaint. The author firstly examines the institutional models of three countries − Germany, Austria and Spain, and, secondly, deals with some specific characteristics of other constitutional systems which have subsequently introduced this legal instrument.
AB  - Širenje ustavne žalbe u okvirima evropskog konstitucionalizma poslednje dekade XX veka, ali i njeno konstituisanje u srpski ustavni sistem 2006. godine, izaziva porast interesovanja za ovim pravnim institutom. Imajući u vidu da uporedno pravo ne pruža jedinstven institucionalni model ustavne žalbe, kao i relativno kratkotrajno iskustvo Republike Srbije sa ovim institutom, ne iznenađuje činjenica da je u našoj teoriji otvoreno mnogo pitanja na ovom polju. Upravo iz tog razloga autor je nastojao da prvenstveno kroz uporednu analizu institucionalnih modela tri ugledna primera, Nemačke, Austrije i Španije, obogaćenu pojedinim specifičnostima pravnih sistema u kojima je naknadno konstitucionalizovana ustavna žalba, pruži teorijsko-pravni okvir ovog pravnog sredstva.

Imajući u vidu da uporedno pravo ne pruža jedinstven institucionalni model ustavne žalbe, kao i relativno kratkotrajno iskustvo Republike Srbije sa ovim institutom, ne iznenađuje činjenica da je u našoj teoriji otvoreno mnogo pitanja na ovom polju. Upravo iz tog razloga autor je nastojao da prvenstveno kroz uporednu analizu institucionalnih modela tri ugledna primera, Nemačke, Austrije i Španije, obogaćenu pojedinim specifičnostima pravnih sistema u kojima je naknadno konstitucionalizovana ustavna žalba, pruži teorijsko-pravni okvir ovog pravnog sredstva.",

People as the holder and performer of sovereignty: Reanimation of direct democracy

AB  - The authors examine possibility of direct democracy revival in contemporary environment. Based upon thought that performance of sovereign power should not be placed too far from the people as the real holder of sovereignty, they foster idea of a wider use of institutions typical for direct democracy. They suggest that it might be the first step towards revitalization of ancient Athenian type of democracy in new circumstances. Along with the fast technological development and expansion of new information technologies, technical limitations are not a vast obstacle anymore in establishing something what could be qualified as an 'electronic agora'. Electronic popular initiatives and electronic referendums could be become quick, efficient and inexpensive modes in acquiring social consensus upon the most important legal and political issues. The authors hold that a kind of Rousseau’s social contract could have a chance to be realized in a cyber space, through a kind of cyber ecclesia.
AB  - Autori u radu razmatraju mogućnost ponovnog oživljavanja neposredne demokratije u savremenim uslovima. Polazeći od ideje da se vršenje suverene vlasti ne sme suviše udaljiti od naroda kao stvarnog nosioca suverenosti, autori se zalažu za širu upotrebu institucija neposredne demokratije, što bi moglo predstavljati samo prvi korak ka revitalizaciji neposredne antičke demokratije atinskog tipa, ali u drugačijim okolnostima. Uz ubrzani tehnološki razvoj i napredovanje informacionih tehnologija, tehnička ograničenja ne predstavljaju više veliku prepreku uspostavljanju onoga što se može nazvati 'elektronska agora'. Elektronske narodne inicijative i elektronski referendumi bi mogli postati brz, efikasan i jeftin način postizanja društvenog konsensusa oko najvažnijih pravnih i politički pitanja. Autori stoje na stanovištu da bi jedan oblik Rusoovog društvenog ugovora danas možda mogao zaživeti u sajber prostoru, u nekoj vrsti sajber eklezije.
