Relations between police and private security officers: a case study of Serbia

AB  - In the last few years, under the influence of various circumstances, the demand for the private security industry has increased in Serbia. The aim of this research is to examine the extent and quality of cooperation between members of the public and private security sector as the mutual perception of its members because their relations are important for establishing a safe environment for citizens. The survey was conducted from February to June 2019 using a questionnaire among 190 police officers and 178 security personnel. The results of this research showed that mutual relations between the private security personnel and police officers are satisfactory, but also that members of private security look at these relations from a brighter side and have a very positive attitude towards members of the police, while members of the police view these relations more negatively. The results of this research can be used for planning campaigns to improve the relationships between police officers and security personnel.

Analysis of the Frequency of Verbal and Vocal Signs in True and False Statements

AB  - The paper presents research aimed at analysing the frequency of verbal and vocal signs in a situation of false and true statements, by introducing a secondary task. The research involved 100 students (47 men and 53 women) of the master's studies of criminal investigation at the University of Criminal Investigation and Police Studies, aged 23-44. Students had the task, based on the observation of twenty selected videos (10 true statements and 10 false statements), to mark the frequency of each individual verbal and vocal sign, on a previously generated and prepared list. The results show that there is a statistically significant difference in terms of the frequency of all verbal and vocal signs in a false or true statement: response latency, speech hesitation, speech errors, speech rate, number of spoken words in the utterance, and length of utterance. Response latency, speech hesitation, and speech errors have higher median values in false utterances than in true ones, while speech rate, number of words spoken, and length of utterance show higher median values in true than false utterances.

Analiza učestalosti neverbalnih znakova povezanih s obmanom kod osumnjičenika

AB  - Polazeći od toga da je problematika obmanjujućeg iskaza izuzetno značajna za policijski rad,
te da je fenomen laganja često prisutan u policijskoj praksi prilikom ispitivanja osumnjičenih
osoba, u radu se izlažu nalazi istraživanja o učestalosti prisustva i grupiranju neverbalnih
znakova obmane kod osumnjičenika koji su negirali krivicu tijekom policijskog ispitivanja zbog
kaznenih djela ubojstva i silovanja. U istraživanju je sudjelovalo 100 ispitanika (49 muškaraca
i 51 žena), studenata master studija kriminalistike Kriminalističko-policijskog univerziteta u
Beogradu. Rezultati istraživanja glede uopćene procjene položaja tijela, frekvencije neverbalnih
znakova i njihova grupiranja, upućuju na prisustvo određenih neverbalnih znakova koji se
odnose na temeljne psihološke procese obmane.

AB  - Говор мржње је веома честа појава на
подручју Балканског полуострва, a нарочито је чест био у време
ратова у бившој СФРЈ. Тада се јављао као катализатор насиља,
нетрпељивости, мобилизације људства и подизања тензија на
етничком и националном нивоу. У последње време националне
тензије су замењене расистичким и верским нетрпељивостима и
омаловажавањем, посебно циљањем на најниже вредности и
инсистирањем на различитостима уз приказивање најлошијих
аспеката неке културе или порекла с намером да се она унизи, а
њени представници сатанизују и стигматизују. Као крајњи циљ
јавља се, опет, мобилизација националног мњења, а путеви који
се у том смеру користе најчешће се везују за електронско и
виртуелно окружење. Посебну анализу у овом раду спровели смо
на неколико веб-сајтова и страница (најчешће вести) у погледу
тенденциозности извештавања – начина коришћења појединих
термина којима се циљају прецизно детерминисане социјалне
групе и појединци. Поред анализе сајтова, посебно је вршена и
анализа коментара њихових посетилаца и метода коришћених у
обраћању јавности. Указано је на усмеравано утицање на
креирање јавног мњења и приказани су методи утицаја на
кориснике сајтова.
AB  - Hate speech has had a very common occurrence in
the Balkan Peninsula, especially during the wars in the former SFRY.
At the time, it emerged as a catalyst for violence, intolerance, human
mobilization, and raising ethnic and national tensions. In recent times,
national tensions have been partially replaced by racist and religious
intolerance and disparagement - specifically targeting the lowest
values and insisting on diversity by displaying the worst aspects of a
culture, or one’s descent with the intention of disparaging it, and of its
representatives being satanized and stigmatized. The ultimate goal is,
again, the mobilization of a certain national feeling, and the routes
used towards that goal are most often linked to the electronic and
virtual environment. Special analysis presented in this paper was
carried out on several websites and web pages, most often news or
media coverage, regarding the tendency of reporting - ways of using
certain terms in order to reach precisely defined and targeted social
groups and individuals. In addition to the analysis of the websites,
there was a special analysis of the comments of visitors to such
websites and the methods used in addressing the public. Directed
influence on public opinion creation is indicated and methods of
influencing website users are presented.

Legalization of criminal profit in the course of agricultural privatization : a view from the Republic of Serbia

AB  - This scientific paper presents the knowledge and experiences related to the legalization of criminal profit with a view to agricultural ownership
transformation in the Republic of Serbia. We define the concept, the standards
aimed against money laundering and the real threats which create the possibility for this criminal offence in Serbia. The practical goal of the research is
concerned with gaining further knowledge of the research topic, which would
contribute to solving the current but also similar problems related to money
laundering. In all countries transition privatization is a complex and painful
process, and this refers to the agricultural sector particularly. This process is
one of the fundamental factors of a market economy which must prevent legalization of contaminated money through legal flows. Parallel to this, organized
crime expands the field of money laundering activities in the process of agricultural privatization. Starting from a previously defined problem the hypothesis this paper is based on is as follows: the risks of money laundering and new
techniques for its integration are not possible to eliminate, but it is necessary to
make efforts and undertake adequate measures to minimize them, particularly
in the field of agriculture. The problem has become additionally complex due
to the fact that at the beginning of 2016 the Privatization Agency ceased its
operation according to the Law on Amendments to the Law on Privatization.
The paper uses both general and specific scientific methods and procedures of
logical conclusion, statistical, as well as positivist legal method. The manner of
research includes the selection and application of scientific methods, the tion of data and the scope of research. The specific technique used to collect
data in this paper includes case studies.

Exploitation of minors for pornographic purposes : the sociodemographic and criminal profile of the perpetrator

AB  - The paper presents research in the form of a survey aimed at examining the sociodemographic and criminal profile of the perpetrator of the
crime of displaying, acquiring and possession of pornographic material and
exploitation of a juvenile for pornography under Article 185 of the Criminal
Code of Serbia, with particular reference to the imposed criminal sanctions.
The survey was conducted at the beginning of 2018 and included 62 convicted
male persons aged 18 to 70, prosecuted under jurisdiction of the Special Prosecutor’s Office for Combating High-Tech Crime in the period from 2012 to
2016. The results of the research show that the perpetrators of the said criminal
offense are exclusively male individuals of an average age of 36.6 years, whose
structure in terms of the working status is extremely diverse, starting from
workers of various occupations, students to pensioners. In terms of other socio-demographic characteristics, the results of the survey show that the largest
percentage of the convicted offenders have completed secondary school, that
the number of the employed and unemployed is the same, that they are not
married, gravitate towards urban areas, and have not been convicted before.
In terms of the modus operandi, the results of the survey show that two methods of execution are dominant: the first implies the use of P2P technology on
the Internet and the use of certain closed networks, which allow searching,
downloading and sharing of photos and audio-visual data whereas the other
involves creating a false profile on the Facebook social network.

abstract = "The paper presents research in the form of a survey aimed at examining the sociodemographic and criminal profile of the perpetrator of the
crime of displaying, acquiring and possession of pornographic material and
exploitation of a juvenile for pornography under Article 185 of the Criminal
Code of Serbia, with particular reference to the imposed criminal sanctions.
The survey was conducted at the beginning of 2018 and included 62 convicted
male persons aged 18 to 70, prosecuted under jurisdiction of the Special Prosecutor’s Office for Combating High-Tech Crime in the period from 2012 to
2016. The results of the research show that the perpetrators of the said criminal
offense are exclusively male individuals of an average age of 36.6 years, whose
structure in terms of the working status is extremely diverse, starting from
workers of various occupations, students to pensioners. In terms of other socio-demographic characteristics, the results of the survey show that the largest
percentage of the convicted offenders have completed secondary school, that
the number of the employed and unemployed is the same, that they are not
married, gravitate towards urban areas, and have not been convicted before.
In terms of the modus operandi, the results of the survey show that two methods of execution are dominant: the first implies the use of P2P technology on
the Internet and the use of certain closed networks, which allow searching,
downloading and sharing of photos and audio-visual data whereas the other
involves creating a false profile on the Facebook social network.",

AB  - The main objective of the research was to study the most important socio-demographic characteristics of violent fan groups at football matches, as well as criminal activities of their members. The authors in the paper have used data from the Ministry of Internal Affairs of the Republic of Serbia, especially originating from Novi Sad Police Department, and from the Section of monitoring violence and misbehavior at sports events, which included a total of 139 members, 18 fan groups, aged 16-40 years. The research results show that in the overall structure of registered members of fan groups, the largest share of adults as well as young adults, who are recruited from families with unfavorable socio-economic status. In terms of other socio-demographic characteristics, the survey results show that members of the fan groups in the highest percentage have finished high school, and that they were unemployed, unmarried and gravitate from the city and partially from suburban areas. In view of their delinquent activities, predominantly author have found crimes against property and crimes and offenses, which is characterized by a particular method of execution that is dominated by violence and the use of various explosive devices.

AB  - The paper aims to present the results of research on the prevalence and characteristics of cyber violence among elementary school pupils, and results with respect to connections of this form of bullying with age and gender of students, and facts like who are perpetrators or victims of this type of violence. The survey also sought to get a few answers to questions concerning: knowledge of elementary pupils about what cyber violence is; which means of electronic communication are preferred in communication with their peers; whether parents control their access to a personal computer and mobile phone, as well as whether the parents would report acts of violence, if they occurred? The study included 300 students of the 5th, 6th, 7th and 8th grade, in the Autonomous Province of Vojvodina, of which 147 were male and 153 females. Research has shown that every other elementary school student was the victim of cyber violence. Number of victims decreases with age, which means that least frequent victims were students in lower grades, and most frequent victims were students in higher grades, with the notable that girls, unlike boys were victims of a much higher percentage. Students were most often the victims of exclusion, misrepresentation, insults and gossip, but in smaller percentages were victims of unlawful communication, lying, stalking and harassment. Observed from the aspect of the perpetrator, the study found that one in four elementary school students was the perpetrator of some form of cyber violence, such as "online" exclusion, misrepresentation, slander and lying and deceiving. A practical and theoretical implications of these findings are discussed further in this text.

AB  - This article examines the distribution of officer opinions combined with personal statuses and perceived statuses of interviewed and interrogated people, types of successful tactics used by police, and types of defence tactics used by suspects in interviews and interrogations. Interviews were conducted and surveys were distributed by 2nd and 3rd year students of the Academy of Criminalistic and Police Studies (ACPS) practical course in police stations across Serbia. Overall, the officers in the sample vary in gender and age. Generally one thing is to be expected, those results are to be very precise and without censure because of distributors of those two techniques of research. Given that the data were not drawn from a study specifically focused on tactics but also on other characteristics of subjects of the procedure, there could be more deductions and analyses of presented data with further scientific implications. This article addresses a pioneering project in Serbia and it could be the first of many to seek the best practice and the most suitable techniques and tactics in addressing citizens, possible witnesses or a suspect.

AB  - U stručnoj javnosti, ali i među građanima sve češće se postavlja pitanje adekvatnosti postupanja policijskih službenika u pojedinim situacijama, a time i kompetentnosti policijskih službenika, odnosno profesionalizacije policije uopšte. Istovremeno, sve više se naglašava da je kadrovski potencijal jedan od ključnih faktora i preduslova uspešnosti u radu i razvoju svake organizacije. Ovo je odavno poznato, prihvaćeno i nebrojeno puta potvrđeno u različitim sferama delatnosti. Delikatni i odgovorni poslovi sprečavanja i suzbijanja kriminaliteta nikako nisu izuzetak, te se i izbor u i obrazovanju izvršilaca tih poslova mora posvetiti dužna pažnja. Cilj ovog rada je da ukaže na nužnost razvijanja kompetencije policijskih službenika kroz školovanje na visoko školskim ustanovama na kojima se, uz oslanjanje na postignuća pionira kriminalistike Republici Srbiji, ova nauka razvija, ali i oplemenjuje iskustvom kriminalista praktičara uključenih u nastavni proces.
AB  - The adequacy of police officers’ conduct in particular situations and, therefore, the competence of police officers, i.e. the professionalization of the police in
general, represent the issues that have been increasingly often raised in expert public as well as among citizens. At the same time, it has been more and more frequently emphasized that professional potential is one of key factors and preconditions for
successful work and development of every organization. The aforesaid has always
been well known, accepted and confirmed countless times in various professional
fields. Delicate and responsible professions including crime prevention and suppression are not an exception. Therefore, due attention has to be given to the selection and education of professionals who perform these tasks. The aim of this paper
is to point out the necessity to develop the competence of police officers through
education at educational institutions of higher level where, relying on the achievements of the pioneers of criminalistics in the Republic of Serbia, this science is not
only developed but also enriched by the experience of experts with practical skills
in criminalistics, who are included in the educational process.

The impact of global strategic international relations to the trends of organized criminal activities

AB  - Being marked either by dominating superpower or by forced balance of dichotomous block division, periods of modern history are for sure the result of various and very complex international political and economic relations. Replacing of these periods had been defining last six decades and has been stipulating specific complexity in actual states' interaction. According to the authors, changes of the global relations' flows have affected on rhythm of the organized criminal activities' trends having in mind possible causality of the ratio between essentially strategic nature of politically economic issues and tactically operational core of illegal matters, worldwide. As examples of illicit actions regarding their intensity, numerous forms, institutional adaptability and high degree of caused social danger, in the article are going to be analyzed terrorism, illicit drug trafficking, money laundering, trafficking in human organs and illegal migration, as well as governmental and nongovernmental responses presented through projects of international organizations of INTERPOL and World Justice.
AB  - Periodi savremene istorije, obeleženi primatom jedne svetske supersile odnosno iznuđenom ravnotežom dihotomne blokovske podele, svakako su ishod mnogostrukih i veoma kompleksnih međunarodnih, kako političkih, tako i ekonomskih odnosa. Smenjivost ovih perioda označila je poslednjih šest decenija i uslovila specifičnu složenost u interakciji današnjih država. Autori smatraju da su tokovi globalnih odnosa u svetu svojim promenama uticali na ritam trendova organizovanih kriminalnih aktivnosti, imajući u vidu moguću uzročnost odnosa suštinski strateške prirode svetskih političko-ekonomskih relacija i taktičko-operativne svrhovitosti ilegalnih radnji. abstract = "Being marked either by dominating superpower or by forced balance of dichotomous block division, periods of modern history are for sure the result of various and very complex international political and economic relations. Replacing of these periods had been defining last six decades and has been stipulating specific complexity in actual states' interaction. According to the authors, changes of the global relations' flows have affected on rhythm of the organized criminal activities' trends having in mind possible causality of the ratio between essentially strategic nature of politically economic issues and tactically operational core of illegal matters, worldwide. As examples of illicit actions regarding their intensity, numerous forms, institutional adaptability and high degree of caused social danger, in the article are going to be analyzed terrorism, illicit drug trafficking, money laundering, trafficking in human organs and illegal migration, as well as governmental and nongovernmental responses presented through projects of international organizations of INTERPOL and World Justice., Periodi savremene istorije, obeleženi primatom jedne svetske supersile odnosno iznuđenom ravnotežom dihotomne blokovske podele, svakako su ishod mnogostrukih i veoma kompleksnih međunarodnih, kako političkih, tako i ekonomskih odnosa. Smenjivost ovih perioda označila je poslednjih šest decenija i uslovila specifičnu složenost u interakciji današnjih država. Autori smatraju da su tokovi globalnih odnosa u svetu svojim promenama uticali na ritam trendova organizovanih kriminalnih aktivnosti, imajući u vidu moguću uzročnost odnosa suštinski strateške prirode svetskih političko-ekonomskih relacija i taktičko-operativne svrhovitosti ilegalnih radnji. AB  - Purpose: The purpose of this paper is to identify and describe various factors for understanding criminal behaviour involved in phishing and to provide advice in the areas of security, criminal procedure, and victimology. Design/methodology/approach: The project combined several qualitative and quantitative techniques such as interviews and surveys, as well as content analysis. Findings: Several categories of subjects were identified: those who are aware of some scientific achievements in this field and who feel increasingly apprehensive about the disclosure of private information; those who are not prepared to readily incorporate scientific progress in similar fields; the third category includes staff members who do not embrace all new measures in the fight against this type of cybercrime. The participants could also be categorized on the basis of their inclination to recognize new forms and types of phishing: some are aware of new forms and can recognize them as soon as they emerge locally; others cannot do so. Research limitations/implications: To allow findings to be generalized, future research should include measures that could specify additional means to be used by members of a wider representative group, such as tools, materials, educational and course modules, implemented during training. Practical implications: This research represents a useful source of information for method implication in combating phishing schemes, and for detecting new emerging forms and types of cybercrime promptly, as well as new social engineering methods to facilitate it. Originality/value: This paper should be of particular interest to forensic specialists, in the analysis of crime scene behaviour and of methods phishers use in luring their victims.

Analysis of legislative norms regarding communication surveillance and of the praxis of European Court of Human Rights

AB  - Communication surveillance is a relatively new measure in the Serbian legal system and with the development of new technologies applicable to various types of communication, new problems are emerging very fast. Of course this is not the case exclusively in Serbia, but much further. Similar problems emerge in the EU, and Serbia as a signatory of the European Convention on Human Rights, has to oblige with the case law of the European Court of Human Rights in Strasbourg (ECHR). Standards made in this area in the laws of the EU countries are derived from the rules made by case law of ECHR. Regardless of the depicted trends and occurrences in this sphere, Serbian legislation has not been lately following the lead of European legislators. Authors are analyzing facts and circumstances in connection to legal defining and proscribing of the measure of communication surveillance, giving a parallel comparative legal analysis of ECHR and Luxemburg Court of EU. The analysis also includes considerations regarding some articles from the draft Act on Criminal Procedure in Serbia pertaining to communication surveillance. The purpose of the analysis is to suggest certain regulations de lege ferenda in Serbia.
AB  - Mera nadzora nad komunikacijama je relativno nova u našem zakonodavstvu, ali pojavom novih tehnologija primenljivih na najrazličitije oblike komunikacija javljaju se mnogobrojni problemi. Naravno, ovo nije slučaj samo u Srbiji, već mnogo šire. Slična problematika javlja se i u Evropskoj uniji, a mi se kao potpisnica evropske Konvencije o ljudskim pravima (EKLjP) moramo rukovoditi i praksom Evropskog suda za ljudska prava u Strazburu (ESLjP). Standardi koji se u evropskim zemljama postavljaju u ovoj oblasti u svojoj osnovi sadrže pravila ustanovljena upravo u praksi ovog suda. Bez obzira na sve trendove i događaje u ovoj oblasti naš zakonodavac, u poslednje vreme, nije u potpunosti na nivou evropskih. Autori analiziraju činjenice i okolnosti vezane za zakonsko regulisanje mere nadzora i snimanja telefonskih i drugih oblika komunikacija, uz uporedno pravnu analizu prakse ESLjP, ali i suda EU u Luksemburgu. U ovu analizu unosi se i razmatranje predloga nacrta novog Zakonika o krivičnom postupku (ZKP). Autori analizom i prikazom uporedno pravne prakse pokušavaju i da daju predloge de lege ferenda u Srbiji.

Police acting when securing a crime scene as a precondition of successful forensic identifications

AB  - A police officer's action, that is crime scene processing, is a significant point in the actions at the crime scene (or a scene of an event) within a measure of searching for the perpetrator and his capturing - if caught in action, as well as measures of providing assistance to injured persons, preventing further harmful effects of causes of events, consequences, etc. If we start from the hypothesis that the evidence material is the only means to determine the veracity of allegations and accusations by defense and prosecution participating in the criminal proceeding brought to court, it is clear that those state authorities, which during the criminal process in general, and processing scenes of criminal events, in course of preparing evidence material must be dedicated to the task level. It can be said that the expertise and professionalism of police officers who secure the crime scene and the professional competence of persons who are finding, fixating, analyzing, interpreting, preserving and presenting evidence, is of significant importance in the function of evidence. Basic protocol for the crime scene processing means continually taking the following actions: securing the scene, gathering information at the scene, controlling the flow of information from the crime scene and CSI. It is possible to identify seven groups of actions being performed at a crime scene site. Classifications of these actions could have multiple importance for processing the scene and the subsequent legal proceedings. While securing the crime scene organizational aspects and also the risk assessment for performing the actions in it are of great importance. The goal that must be achieved in securing the scene is to prevent further spread of harmful consequences, or to prevent occurrence of new damage. Experience has shown that the personal safety of the officials and safety of other persons present at the scene is the main priority. To do so at this stage of criminal conduct on the occasion of the event involves taking a series of measures aimed at recognizing, and then eliminating or limiting the risks of injuries and illnesses. The authors pointed out that basically there are four levels of protective clothing. The efficiency of the measures undertaken include consistency of the application in the protection by properly selected equipment and awareness of existing risks and possible contamination. Specific problems and difficulties in crime scene processing, and within it, the securing the crime scene and CSI are connected to the tragic events that had resulted in great loss of life and enormous material damage. The authors elaborate this situation by offering a number of important guidelines for the conduct under those circumstances. In order to make managing of the situation easier, the authors recommend awareness of a number of special elements in securing the scene by placing obstacles, marking the crime scene and treatment of persons present to determine the command post.
AB  - Mesto krivičnog događaja ima nesumnjiv značaj u kriminalističkom postupanju, pa se in loci delicto, posledično, odvijaju brojne, raznovrsne i kompleksne aktivnosti policije i drugih relevantnih subjekata. U tom smislu, jedan od najznačajnih segmenata policijskog postupanja predstavlja očuvanje predmeta i tragova u njihovom izvornom i nekontaminiranom obliku, kako bi se stvorila adekvatna informativna i dokazna osnova, neophodna za uspešnu kriminalističku obradu i kasnije forenzičke identifikacije. Autori u radu iznose opšta razmatranja u vezi s kriminalističkom obradom mesta događaja i organizaciono-tehničke napomene koje prethode policijskom delovanju na mestu događaja, a zatim, razmatraju najbitnija kriminalistička pravila njegovog profesionalnog obezbeđenja, sve u funkciji stvaranja pretpostavki za prikupljanje kvalitetnog i nespornog dokaznog materijala. Na kraju, zaključuju da bi se izgradnja, formulisanje i dosledna primena preciznih pravila postupanja, obavezujućih za sve učesnike u obezbeđenju mesta događaja i vršenju uviđaja, posmatranih u celini, mogla posmatrati kao svojevrsna garancija da će svi pojedinačni zadaci biti obavljeni na procesno prihvatljiv i kriminalistički celishodan način.

AB  - The authors of this article are trying to present the strategic, tactical and operational levels of complex activities of the National Central Bureau of Interpol in Belgrade. They attempted to merge participation of many operational lines of work of the NCB Interpol in Belgrade. The greatest attention was given to international police cooperation in cyber crime cases, because of its exceptional importance for EU integration of the Republic of Serbia. This article presents author's choices in relation to importance of the exchange of operational data and the existing social threats of these areas of a crime.
AB  - Autori pokušavaju da u radu prikažu i povežu strateški, taktički i operativni nivo rada u različitim oblastima kompleksnih delatnosti kojima se bavi NCB Interpol u Beogradu. Pokušano je fuzionisanje raspoloživog sudelovanja mnogih linija rada, pri čemu je najveći akcenat, zbog izuzetnog značaja, stavljen na međunarodnu policijsku saradnju u oblasti visokotehnološkog kriminala, sa aspekta integracije Republike Srbije u EU. Fokusi koji su u radu prikazani izbor su autora prema operativnom značaju u razmeni podataka i postojećoj društvenoj opasnosti ovih oblasti kriminala.

AB  - The numerous up-to-dated ranges of multilateral ways of police and judicial cooperation in Southeast Europe are analyzed by the authors in the article. Regarding this the ranges indicate to genesis, structure and achievement of South East European Cooperation Initiative (SECI) Centre and the South East European Prosecutors Advisory Group (SEEPAG); PROSECO; Cyber SEE, Regional Anti Corruption Initiative (RAI); SEE PCC and SEE Police Chiefs Association (SEPCA) Joint European determining of the states in Southeast Europe, according to the authors, will significantly contribute to stabilization of the region, exposed to the large number of conflicts during the last two centuries, and to attach it onward successfully to European Union, as the biggest peace-keeping project created after the Second World War ending up. In this regard the authors especially stress out the necessity of further trust building among the states in Southeast Europe, just as strengthening of actual network of the regional initiatives in the matter of security during the process of euro integration of all of the states.
AB  - U ovom radu autori analiziraju dosadašnje domete brojnih multilateralnih vidova saradnje u Jugoistočnoj Evropi u oblasti unutrašnjih poslova i pravosuđa. U tom smislu oni ukazuju na nastanak, strukturu i dostignuća Saveta za regionalnu saradnju (SRS), Inicijative za saradnju u Jugoistočnoj Evropi (South East European Cooperation Initiative (SECI) Centre), Savetodavne grupe javnih tužilaca u Jugoistočnoj Evropi (JIE) (South East European Prosecutors Advisory Group - SEEPAG); PROSEKA (PROSECO); Regionalne saradnje u krivičnom postupku: ojačavanju kapaciteta u borbi protiv VTK (SEE Cybercrime IPA), Regionalne Antikorupcijske inicijative (Regional Anti Corruption Initiative - RAI); Konvencije o policijskoj saradnji u Jugoistočnoj Evropi (Secretariat of South East Europe Police Cooperation Convention-SEE PCC) i Asocijacije šefova policije u Jugoistočnoj Evropi (SEE Police Chiefs' Association-SEPCA). Zajednička evropska opredeljenost država jugoistoka Evrope, umnogome će, kako navode autori, doprineti da se ovaj region, koji je bio izložen brojnim sukobima tokom protekla dva veka stabilizuje i da se ubuduće uspešno pridruži Evropskoj uniji, kao najvećem mirovnom projektu nastalom nakon okončanja Drugog svetskog rata. S tim u vezi, autori posebno podvlače da je neophodno da dođe do dalje izgradnje poverenja između država regiona Jugoistočne Evrope, ali i da se postojeća mreža regionalnih inicijativa u oblasti bezbednosti osnaži tokom procesa evrointegracija svih država.

AB  - Nowadays civilization profile is, by all means, marked with dynamic, brutal and unfortunately efficient organized criminal activity. Its international prefix, surely, contribute to increasing of social endangering to the detriment of a state and an individual just as to the state and private property. In this article, we try to recognize as society response to the constant presence of enemy of its fundamental values, the existing of international police organization running worldwide, continentally and regionally. To understand their role completely, there will be made an overview to the historical aspects of their origin and development, just like to the historical episodes of them being misused. Focused on world level we will explore the importance of International Criminal Police Organization - INTERPOL, analyze European, African, Asian, Latino American, Central American, Pan-American and Pacific police organization, continentally and stress out the purpose of international organization of SECI, regionally. We think that the international police organizations' ranges combating, after all, organized criminal activities, make essential impact on protection of basic human rights and liberties, just as on stability and prosperity of international relations seeing through regional, continental and world perspectives.
AB  - Savremeni profil civilizacije neizostavno je obeležen dinamičnom, brutalnom i nažalost efikasnom organizovanom kriminalnom aktivnošću. Njen međunarodni prefiks, svakako, doprinosi uvećanju stepena društvene opasnosti po državu i pojedinca odnosno štete koju izaziva na državnim i privatnim dobrima. Odgovor društva na konstantno prisustvo neprijatelja njegovih osnovnih vrednosti, u ovom članku, pokušavamo da pronađemo u postojanju međunarodnih policijskih organizacija, koje deluju na svetskom, kontinentalnom i regionalnom nivou. Kako bi njihova uloga bila shvaćena što potpunije biće prikazan i osvrt na istorijat njihovog nastanka i razvoja, kao i na one istorijske epizode u kojima su neke od predmetnih međunarodnih policijskih organizacija bile zloupotrebljene. Na svetskom nivou razmatraćemo značaj međunarodne organizacije kriminalističke policije INTERPOL, na kontinentalnom planu analiziraćemo evropske afričke, azijske, latinoameričke, centralnoameričke, panameričke i pacifičke policijske organizacije, dok ćemo se na regionalnom planu usredsrediti na svrhu međunarodne organizacije SECI. Mišljenja smo da su dometi ovih međunarodnih policijskih organizacija, u borbi protiv, pre svega, organizovane kriminalne aktivnosti, od presudne važnosti za zaštitu kako osnovnih ljudskih prava i sloboda, tako i stabilnosti i prosperiteta međunarodnih odnosa u regionalnoj, kontinentalnoj i svetskoj perspektivi.

AB  - In the introductory part of the paper the authors were involved in reviewing the problem of drug abuse and drug-related crimes as sociopathological phenomenon with a wide range of criminal consequences. They also give a brief overview of the genesis and development of the basic causes of the wide prevalence of this phenomenon in the society. After that there is a cohesive review of the factors of drug addiction and crime (primary, secondary and tertiary drug-related crime), while the central section is devoted to typology and characterization of persons in the sphere of drug-related crimes and their relation to the police, as one of the entities that are actively involved in combating this social evil.
AB  - Autori se u uvodnom delu rada bave razmatranjem problema narkomanije i narkokriminala kao sociopatološke pojave sa širokim dijapazonom kriminalnih konsekvenci i daju kratku genezu razvoja i pregled osnovnih uzroka široke rasprostranjenosti ove pojave u našem društvu. Zatim sledi razmatranje kohezivnih faktora narkomanije i kriminala (primarni, sekundarni i tercijarni narkokriminal), u kojem autori zaključuju da nesumnjivno postoji visok stepen međuzavisnosti između narkomanije i kriminala, što potvrđuju ranije sprovedena istraživanja, čiji rezultati govore o povećanoj upotrebi droga među uhapšenima, visokom nivou kriminalnog ponašanja među korisnicima droga, kao i velikom stepenu korelacije između korišćenja droga i kriminala u opštoj populaciji. Centralni deo rada posvećen je tipologiji i karakterizaciji lica iz sfere narkokriminala i njihovom odnosu prema policiji, kao jednom od subjekata koji aktivno učestvuje u suzbijanju ovog društvenog zla.

MOS and profiling in crime investigation

AB  - The author has tried to connect a couple of institutes residing in different scientific systems. In studying ties between the modus operandi of the perpetuator of an actual crime and the system (Modus Operandi System) based on exploration thereof, as a special method for solving crimes, the author was pushed into revealing new institutes in the West European and American systems, concerning the field of forensics. Comparative studying of existing practical and theoretical models drives the author to find some similarities between those systems and to use some forms of combining their elements. In trying to focus on the novelties applicable in Serbian praxis, the author attempts to relate them to the behavioral analysis, operative investigative analyses and analyses of similarity among criminal offences, skillfully combining all these with prevailing theoretical models in Serbia. The author then tries to establish similarities between the elements of these institutes and MOS. The paper thus concisely outlines possible solutions and suggests combining with other similar institutes, such as criminal profiling. It is this field that offers broadest possibilities for processing data pertaining to similarities and for convergence with other systems.

Pokušaji razmatranja relacija modus operandia izvršilaca i sistema zasnovanog na njima, kao posebne metode rasvetljavanja krivičnih dela i otkrivanja izvršilaca, navode na proučavanje novih instituta na zapadnoj hemisferi, u okvirima forenzike. Uporednim proučavanjem postojećih naučnih i praktičnih rešenja autor ustanovljava postojanje određenih sličnosti među različitim sistemima, ali i uviđa mogućnosti kombinovanja datih. Ukazujući na novine koje se mogu primeniti u praksi, autor unosi detalje koji postoje u analizi povezanosti, operativnoj istražnoj analizi ili komparativnoj analizi sličnosti krivičnih dela i vešto ih kombinuje sa aktuelnim teorijskim stavovima u Srbiji. Šta više, on vrši analizu sličnosti elemenata datih instituta sa MOS-om. Preglednim izlaganjem autor daje moguća rešenja i spekuliše o mogućoj daljoj povezanosti sa nekim sličnim institutima kao što je kriminalističko profilisanje. Upravo u ovoj oblasti se najviše primenjuju instituti koji se obrađuju u pogledu postojećih sličnosti (analiza sličnosti) sa aktuelnim sistemom u Srbiji, gde se mogu prepoznati zajednički prostori za konvergencije sa drugim sistemima.

abstract = "The author has tried to connect a couple of institutes residing in different scientific systems. In studying ties between the modus operandi of the perpetuator of an actual crime and the system (Modus Operandi System) based on exploration thereof, as a special method for solving crimes, the author was pushed into revealing new institutes in the West European and American systems, concerning the field of forensics. Comparative studying of existing practical and theoretical models drives the author to find some similarities between those systems and to use some forms of combining their elements. In trying to focus on the novelties applicable in Serbian praxis, the author attempts to relate them to the behavioral analysis, operative investigative analyses and analyses of similarity among criminal offences, skillfully combining all these with prevailing theoretical models in Serbia. The author then tries to establish similarities between the elements of these institutes and MOS. The paper thus concisely outlines possible solutions and suggests combining with other similar institutes, such as criminal profiling. It is this field that offers broadest possibilities for processing data pertaining to similarities and for convergence with other systems., Autor pokušava da poveže nekoliko instituta u različitim naučnim sistemima. AB  - Under the contemporary conditions, in developing police and criminalistic techniques and actions traditional forms of international criminal police co-operation should take new forms. During the development of criminal police co-operation, its forms went through different shapes and modalities in taking their today's looks and status. Various forms and modalities of co-operation in the past made the authors deal with INTERPOL notices (warrants), diffusions and European arrest warrants. In the light of legal grounds for certain police actions explaining these acts the authors make attempts to illuminate their scope and influence on movement of freedom and its restrictions. Also, they elaborate the principles of modernity and bona fide in police actions and actions of other government entities in facilitating the international police and judicial co-operation.
AB  - U savremenim uslovima razvoja policije i kriminalističkih metoda i tehnika, tradicionalni oblici međunarodne saradnje kriminalističke policije moraju dobiti nove forme. Tokom razvoja oblika međunarodne saradnje kriminalističke policije, njihove forme su se razvijale kroz različite oblike i vrste da bi ostvarile današnji izgled i status. Različitost oblika i modaliteta ove saradnje u prošlosti odredila je autorima za predmet sledeće: Interpolova obaveštenja (poternice), difuzije (raspise o traganju) i Evropski nalog za lišenje slobode. Tokom objašnjavanja ovih akata, u svetlu pravnih osnova za preduzimanje određenih policijske aktivnosti, autori pokušavaju da rasvetle njihov obim i uticaj na slobodu kretanja, i ograničenja iste. Takođe pokušavaju prikazati svoje mišljenje o principima suvereniteta i bona fide u policijskim aktivnostima kao i aktivnostima drugih vladinih subjekata u omogućavanju međunarodne policijske i sudske saradnje.

Comparative criminal law analysis of the practice of earprint identification

AB  - The aim of this paper is to point out particular moments in comparative criminalistic and criminal law practice that could be improved, as well as critic of the existing state. The author presents the historical evolution of the use of earprint identification in criminalistic practice, and then gives an overview of possible cases of use of this trace of evidence in practice. It’s inevitable to present the comparative law overview and forensic achievements in some of the eminent law systems. Along with the above, the author seeks to provide comparative constructive views of critics of use of earprint identification in criminalistic practice. The author points out the existence of different techniques of finding, developing and fixing of this trace of evidence, as well as its conservation. The paper describes comparative cases and provides reviews of expertise techniques for the purpose of identification or elimination of the suspect. Of course, this overview wouldn’t be complete if the author didn’t consider physiological development of ear and its possible changes. On the end of the paper, the author considers possible tendencies of use of the earprint identification.
AB  - Smisao ovog rada, po autoru, je ukazivanje na pojedine momente u uporednoj kriminalističkoj i krivičnopravnoj praksi koji mogu biti unapređeni, kao i kritika postojećeg stanja. Autor ukazuje na istorijski razvoj upotrebe traga ušne školjke nepoznatog izvršioca u kriminalističkoj praksi, a potom daje pregled mogućih slučajeva iskorišćavanja ovog traga u praksi. Neizbežno je ponuditi i uporedno-pravni pregled, kao i ukazivanje na dostignuća forenzičara u nekim od eminentnih pravnih sistema, a, uz opisano, autor pokušava da da uporedno konstruktivno stanovište kritičara korišćenja traga ušne školjke u kriminalističkoj praksi, naročito u smislu identifikacije. Ukazuje se i na postojanje različitih tehnika pronalaženja, izazivanja i fiksiranja ovog traga, kao i njegovog konzerviranja. Daju se i uporedni slučajevi i prikazi tehnika veštačenja ovih tragova u cilju identifikacije ali i eliminacije (u smislu orijentaciono–eliminacione indicije) mogućih osumnjičenih lica. Naravno, ovakav pregled ne bi bio potpun ukoliko se autor ne bi osvrnuo i na moguće uticaje fiziološkog razvoja ušne školjke i posebno, podložnosti promenama iste. Na kraju su razmatrane, kao bitne, i neke moguće tendencije primene.
