Legislative Framework of Nuclear Security in the Republic of Serbia

AB  - The paper presents the concept and characteristics of nuclear security, the elements of the nuclear safety strategy, the legislative framework and the most important solutions from the Law on Radiation and Nuclear Safety and Security. At the international level, the most important entity in this field is the International Atomic Energy Agency, while at the national level, most important is the Directorate for Radiation and Nuclear Safety and Security of Serbia. An important role is played by the Vinča Institute of Nuclear Sciences as the most referential scientific institution in this field, as well as the operational bodies – Nuclear Facilities of Serbia, the Ministry of Internal Affairs, Ministry of Defence, and the Serbian Armed Forces. Engagement of these bodies is carried out in regular peacetime circumstances, emergency situations and wartime. The most important challenges, risks and threats to nuclear security of Serbia were pointed out as well as the need to harmonize norms, procedures and processes in purpose of the strengthening institutional mechanisms in the field of nuclear security.
AB  - У раду су изложени појам и карактеристике нуклеарне и радијационе безбедности, елементи стратегије нуклеарне безбедности, легислативни оквир и важнија решења из Закона о радијационој и нуклеарној сигурности и безбедности. На међународном нивоу најважнији субјект у овој области је Међународна агенција за атомску енергију, док је на националном нивоу Директорат за радијациону и нуклеарну сигурност и безбедност Србије. Значајну улогу имају Министарство одбране, Војска Србије, Министарство унутрашњих послова Републике Србије, Институт за нуклеарне науке Винча као најреферентнија научна институција у овој области и Јавно предузеће Нуклеарни објекти Србије као оперативни орган. Ангажовање субјекта остварује се у редовним мирнодописким околностима, ванредним ситуацијама и ратним приликама. Указано је на најзначајније изазове, ризике и претње по нуклеарну безбедност у Србији, као и на потребу усаглашавања норми, процедура и процеса у циљу јачања институционалних механизама у области нуклеарне безбедности.

Legislative framework and criminal operational aspect of combatingnew forms of community violence

AB  - The paper presents the legislative framework and the criminalistics-operational aspect of the fight against new forms of violence in Serbia. It is primarily about domestic violence, then peer violence and violence at sports events. The social response to the challenges, risks and threats posed by new forms of violence in the community first included normative-legal activity. The legal frame-work for the fight against new forms of violence in the community included the adoption of special laws and bylaws, which were pointed out in the paper. On that basis, the criminalistics-operational response  of  the  police  and  law  enforcement  agencies,  judicial  bodies  and  other  relevant  entities  was  further  upgraded.  The  paper  also  points  out  the  activities  of  the  RS  Ministry  of  the  Interior  in the fight against forms of domestic violence, peer violence and violence at sports events. In the concluding remarks, proposals were made for improving the legislative framework de lege ferenda, strengthening multi-agency and multi-sectoral cooperation, and accepting the good practice of the developed countries in the context of our application for the EU accession.

AB  - Народна скупштина је крајем 2019. године усвојила Стратегију националне безбедности Републике Србије. У питању је други документ ове врсте од када је Србија поново постала самостална и независна држава, јер је први документ усвојен 2009. године. Овај рад је покушај компаративне анализе поменутих докумената који су од капиталног значаја у области националне безбедности. У том смислу, у раду је најпре извршена анализа појмова и структуре докумената, затим основних ставова и опредељења и, што је најважније, анализа садржаја изузетно значајног националног документа. Закључак аутора је да је нова Стратегија националне безбедности из 2019. године квалитативно различита у односу на претходни документ, као и да је утврдила нека значајна питања која захтевају ширу и дубљу теоријску разраду.
AB  - At the end of 2019, the National Assembly adopted the National Security Strategy of the Republic of Serbia. This is the second document of this kind since Serbia became an independent state again, because the first document was adopted in 2009. This paper is an attempt at a comparative analysis of the mentioned documents that are of vital importance in the field of national security. In that sense, the paper first analyzes the concepts and structure of documents, then the basic attitudes and determinations and, most importantly, the the content of extremely important national documents. The authors' conclusion is that the new National Security Strategy from 2019 is qualitatively different as compared to the previous document, as well as that it has identified some important issues that require a broader and deeper theoretical elaboration.

AB  - The paper presents the legal framework and institutional mechanisms of international police cooperation between the Republic of Serbia and the countries of our region, primarily in the suppression of the most serious emerging forms of crime. The legal framework for work and co-operation in the fight against crime consists of important international sources such as conventions, treaties and other acts adopted at the multilateral, regional and bilateral levels. The most important internal sources are the Law on Police and regulations in the field of criminal legislation: the Law on International Legal Assistance in Criminal Matters, the CPC, the Criminal Code, the Law on Organization and Competences of State Bodies in Combating Organized Crime, Terrorism and Corruption and others. Institutional mechanisms of cooperation include forms of work, bodies, organizations and bodies established at the international level, especially at the regional level. A critical review of the legal and institutional mechanisms of cooperation is aimed at increasing the efficiency of the engaged entities in the suppression of the most serious forms of crime. In the final part, some proposals for improving the legislative framework and criminal-operational practice of the police and other law enforcement agencies are given, especially in the context of Serbia's application for EU accession.

AB  - The paper gives a brief overview of the definition of organized crime with the answer what definition is most appropriate from the aspect of police work. The basic characteristics of organized crime are also presented.
In the continuation, the paper gives an overview on some methods used by
members of an organized criminal group or criminal organization as a whole
in order to obscure their criminal activities and avoid criminal prosecution.
An analysis of the practical activities of the police and modern technologies reveals certain possibilities that can lead to the improvement of police
work in the field of the fight against organized crime. An analysis of the content of available literature related to the topic of paper was also carried out.
To improve the rates of detecting and clarifying of organized crime, police
must primarily be able to assess the perpetrators of such crimes. Finally, the
synthesis of all methods leads to the conclusion what methods are the most
effective. All contemporary methods have to be used while respecting the
fundamental rights and freedoms that are guaranteed by the constitution and
international legal acts. If not so, all police and prosecutor work on proving
the felonies will ‘go down the drain’ as the courts must declare the evidence
to be inadmissible and unlawful.

AB  - The paper presents an overview of trafficking in human beings (THB) for the purpose of sexual exploitation in Croatia and Serbia. The paper is based on a legal, descriptive and comparative method of analyzing the international and national legal framework, state and trends. Sexual exploitation is the most common form of exploitation of victims of trafficking. Prostitution, sexual exploitation, child pornography and pedophilia were treated as manifested form. Significant place is held by a comparative critical review of international documents, solutions in the national legislations, analysis of the situation and trends of sexual exploitation. In combating THB, cooperation at national and international level is necessary. The paper is limited to research related to THB for the purpose of sexual exploitation in Croatia and Serbia. The paper, with a critical overview of previous solutions, gives analysis of the situation and trends of sexual exploitation as a form of THB.

abstract = "The paper presents an overview of trafficking in human beings (THB) for the purpose of sexual exploitation in Croatia and Serbia. The paper is based on a legal, descriptive and comparative method of analyzing the international and national legal framework, state and trends. Sexual exploitation is the most common form of exploitation of victims of trafficking. Prostitution, sexual exploitation, child pornography and pedophilia were treated as manifested form. Significant place is held by a comparative critical review of international documents, solutions in the national legislations, analysis of the situation and trends of sexual exploitation. In combating THB, cooperation at national and international level is necessary. The paper is limited to research related to THB for the purpose of sexual exploitation in Croatia and Serbia. The paper, with a critical overview of previous solutions, gives analysis of the situation and trends of sexual exploitation as a form of THB.",

AB  - The Western Balkans is a region that is at the same time one of the migrant routes from the war-affected areas to the EU countries. Recent decades in the world have seen an increase in the number of terrorist attacks, which culminated in the attack on the Twin Towers of the 9/11 in the United States. In major cities across Europe, there has been a series of bombings and other attacks, particularly with the onset of the major migrant crisis in 2015. Armed conflicts in the areas of North Africa and the Middle East are still the main generator of the refugee wave, with new terrorist attacks. Although the increase in the number of attacks and migration leads to the link of research, they say the opposite. An effective counter terrorism and the elimination of the consequences of an attack implies, at the same time, the reaction of states on the national level, as well as international criminal law cooperation between states and organizations at the regional and global level. In the first part of the article, the authors briefly referred to the (un)defined notion of terrorism, then examining migration on the route of the Western Balkans and ultimately pointed to the legal and institutional mechanisms of criminal law cooperation of the countries of the Region in counter terrorism.

AB  - The subject of the paper is the European Arrest Warrant as a Model of Extradition of EU Member States, established by the EU Council Framework Decision (2002/584/ PUP) of 13 June 2002 about the surrender procedure between the EU Member States. The introductory part of the paper gave a brief overview of the idea of the unification of Europe after the II World War and in this regard the adoption of the EUW as a substitute for slow and insufficiently effective extradition. The central part of the paper contains an exposition of its concept, legislative framework, substantive and procedural legal conditions for publication and content. The EAW can not be issued for all offenses, but only for the works listed in the Catalog 32. The principle of double punishment has been abolished for some serious crimes, as well as the prohibition of the extradition of its own citizens for some financial crimes. In the concluding part pointed to the role of EAW in the construction and functioning of the EU's single judicial area.
AB  - Predmet rada je Evropski nalog za hapšenje (u daljem tekstu: EUN) kao model ekstradicije država članica Evropske unije, uspostavljen Okvirnom odlukom Veća EU (2002/584/PUP) od 13. 6. 2002. o postupku predaje između država članica EU. U uvodnom delu rada je dat kratak osvrt na ideju ujedinjenja Evrope posle II svetskog rata i s tim u vezi usvajanje EUN kao supstituta spore i nedovoljno efikasne ekstradicije. Centralni deo rada sadrži izlaganje o njegovom pojmu, legislativnom okviru, materijalnim i procesnim pravnim uslovima za izdavanje i sadržini. Evropski nalog za hapšenje ne može se izdati za sva krivična dela, već samo za dela navedena u Katalogu 32. Načelo dvostruke kažnjivosti je ukinuto za pojedina teška krivična dela, kao i zabrana izručenja vlastitih državljana za neka finansijska krivična dela. Criminal and Disciplinary Liability of Physicians for Passive Bribery in the Hippocrates Affair

AB  - Passive bribery under Art. 293 Par. 2 of the official Croatian Criminal Code is a crime of corruption, with which a number of primary care physicians have been charged. They have as responsible persons, received bribes to perform what they are already required to perform during the course of their own business or through their regular activities; in other words, they have received bribes from drug manufacturear to prescribe their own medications. Criminal proceedings, initiated against 364 accused physicians in the Hippocrates Affair are slowly concluding. Completed criminal proceedings, for now, ended with the 283 convictions, which were mainly the result of a settlement between physicians and the Office for the Suppression of Corruption and Organised Crime. However, for the physicians, the case is not closed, because after the final convictions, the Croatian Medical Chamber decided to conduct disciplinary proceedings to determine the unworthiness of convicted doctor. In this paper, the authors examined the responsibility of the physicians accused of bribery based on the Criminal Code, as well as other regulations and acts of the Croatian Medical Chamber which regulate the work of primary care physicians. An analysis of the final judgment in the Hippocrates Affair highlighted the sentences imposed and confiscated material gained through individual criminal offenses committed by physicians. In conclusion, the degree of the endangered property and its consequences are presented. Based on the investigationand analyzes of the situation, we offer de lege ferenda suggestions.

Corruption and combating corruption in transitional societies: Example of Croatia and Serbia

AB  - Corruption danas predstavlja globalni problem i jednu od najvećih pretnji demokratskom državnom poretku i vladavini prava. The paper points to the criminological and legal aspects of corruption in Croatia and Serbia as countries that have somewhat completed the transition process, society reform and harmonization of legislation with relevant international documents. Provided are the most significant international and national legislative sources that are important for the suppression of corruption, as well as the mechanisms for monitoring the presence of corruption in these countries. A study of the state and movements of corrupt criminal offenses committed in Croatia and Serbia was conducted and their comparative representation was given. Distinctions in the incrimination of corruptive offenses in these countries were pointed out, which are, among other things, the result of the absence of a single international definition of corruption. Concluding considerations include the de lege ferenda proposals with the aim of more effective combating of corruption in the public as well as in the private sector.

U radu je ukazano na kriminološki i pravni aspekt korupcije u Hrvatskoj i Srbiji, kao državama koje su donekle okončale proces tranzicije, reforme društva i harmonizacije zakonodavstva sa relevantnim međunarodnim dokumentima. Navedeni su važniji međunarodni i nacionalni legislativni izvori značajni za suzbijanje korupcije, kao i izloženi mehanizmi za praćenje prisustva korupcije u ovim državama. Sprovedeno je istraživanje stanja i kretanja izvršenih koruptivnih krivičnih dela na području Hrvatske i Srbije, te je dat njihov komparativno-pravni prikaz. Ukazano je na distinkciju u inkriminaciji koruptivnih krivičnih dela u navedenim državama koje su, pored ostalog, i rezultat nepostojanja jedinstvene međunarodnopravne definicije korupcije. U zaključnim razmatranjima navedeni su predlozi de lege ferenda sa ciljem što uspešnijeg suzbijanja korupcije kako u javnom, tako i u privatnom sektoru.

Analysis of characteristic novelties in the Police Law: Critical review

AB  - Although it had not yet reached full-capacity implementation, the Police Law experienced changes as early as March 18. It took full two years to detect certain shortcomings both in terms of the immediate enforcement of the legal provisions and regarding the adoption of secondary legislation. For the purposes of this paper, novelties can be classified in several groups: 1) novelties of a general character, 2) organizational-functional novelties, and 3) labor-law novelties. The greatest number of innovations is in the field of labor-law relations of a specific officer's (career) system in the Ministry of the Interior. The authors analyze some of the characteristic novelties with a critical review of the exercised freedoms and rights of citizens, especially police officers, but also their obligations. At the same time, they point out to some additional novelties de lege ferenda.
AB  - Iako još uvek nije primenjen u punom kapacitetu, Zakon o policiji je već u martu 2018. godine doživeo izmene i dopune. Trebalo je pune dve godine da se uoče određeni nedostaci kako u neposrednoj primeni normi zakona, tako i sa aspekta donošenja sekundarne legislative. Za potrebe ovog rada novele možemo svrstati u nekoliko grupa: 1) novele opšteg karaktera, 2) organizaciono-funkcionalne novele i 3) radno-pravne novele. Najveći broj novela je iz oblasti radno-pravnog odnosa, konkretno specifičnog službeničkog (karijernog) sistema u MUP-u. Autori u radu analiziraju neke od karakterističnih novela uz kritički osvrt na ostvarivanje sloboda i prava građana, naročito policijskih službenika, ali i njihovih obaveza. Istovremeno su ukazali na još neke novele de lege ferenda.

abstract = "Although it had not yet reached full-capacity implementation, the Police Law experienced changes as early as March 18. It took full two years to detect certain shortcomings both in terms of the immediate enforcement of the legal provisions and regarding the adoption of secondary legislation. For the purposes of this paper, novelties can be classified in several groups: 1) novelties of a general character, 2) organizational-functional novelties, and 3) labor-law novelties. The greatest number of innovations is in the field of labor-law relations of a specific officer's (career) system in the Ministry of the Interior. The authors analyze some of the characteristic novelties with a critical review of the exercised freedoms and rights of citizens, especially police officers, but also their obligations. At the same time, they point out to some additional novelties de lege ferenda., Iako još uvek nije primenjen u punom kapacitetu, Zakon o policiji je već u martu 2018. godine doživeo izmene i dopune. Trebalo je pune dve godine da se uoče određeni nedostaci kako u neposrednoj primeni normi zakona, tako i sa aspekta donošenja sekundarne legislative. Za potrebe ovog rada novele možemo svrstati u nekoliko grupa: 1) novele opšteg karaktera, 2) organizaciono-funkcionalne novele i 3) radno-pravne novele. Najveći broj novela je iz oblasti radno-pravnog odnosa, konkretno specifičnog službeničkog (karijernog) sistema u MUP-u. Autori u radu analiziraju neke od karakterističnih novela uz kritički osvrt na ostvarivanje sloboda i prava građana, naročito policijskih službenika, ali i njihovih obaveza. Istovremeno su ukazali na još neke novele de lege ferenda.",

AB  - Novi Zakon o policiji stupio je na pravnu snagu i počeo da se primenjuje 5. februara 2016. godine. Sličan je starom zakonu i njime se uređuju unutrašnji poslovi, organizacija i nadležnost MUP-a, policijski poslovi, organizacija i nadležnost policije, ljudski resursi, disciplinska odgovornost i odgovornost za materijalnu štetu, kontrola rada MUP-a i policije, finansiranje, pomoćna policija, primena drugih propisa i ovlašćenje za donošenje podzakonskih propisa. U radu su izložene najbitnije novine u Zakonu o policiji sa posebnim osvrtom na upotrebu sredstava prinude, kao najvažnije oblasti sa stanovišta ljudskih prava i građanskih sloboda.

AB  - Нови Закон о полицији иако носи такав назив и
регулише организацију Полиције и комплементарна питања, не
односи се само на полицију. Закон је уредио битне појединости из
домена државне управе у области унутрашњих послова и
организацију МУП-а у целини, његове надлежности и права и обавезе свих запослених у Министарства. Закон је такође увео нека
нова полицијска овлашћења, осавременио већ постојећа и увео новине у области употребе средстава принуде. Радноправне одредбе детаљно регулишу рад, радне односе, организацију процеса
рада и друга питања из ове области. Посебна пажња у закону посвећена је јачању морала, интегритета запослених у Министарству и борби против корупције. Нови Закон о полицији је класичан
тип нормативноправног акта о полицији али уз значајно осавремењена решења која стављају акценат на: поштовање и заштиту људских - мањинских права и грађанских слобода, нове елементе полицијске етике, управљање људским ресурсима, конкурсе
у радним односима, механизме борбе против корупције и јачање
интегритета и контролу рада свих запослених у МУП-у. Своју пуну примену, као и сваки други системски пропис, овај закон доживеће доношењем свих подзаконских аката који ће ближе уредити
поједине области.
AB  - The new law on police pertains to significant details
of the state administration, and although the title is the Police Act, it
does not only apply to police work, the organization of the police and
the rights and obligations of police officers. The law regulates the
organization of the whole MoI, its jurisdiction, the rights and
obligations of all employees in the MoI. The law also introduced a number of new police powers, modernized the existing ones and
introducing innovations in the field of the use of force. There are also
provisions pertaining to employment and labor issues, organization of
work, and other issues in this field. Special attention was paid to
strengthening ethics, integrity and anti-corruption. The new Police Act
is a classic type of act аbout police with some modern solutions that
have put the emphasis on the respect and protection of human and
minority rights and freedoms, new elements of police ethics, human
resource management, competition in labor relations, mechanisms of
combating corruption and strengthening integrity and control of the
work of all employees in the MoI. Its full implementation, like that of
any other system law, will ensue following the adoption of bylaws that
will regulate certain areas.

Status of experts in criminal proceedings in the Republic of Serbia

AB  - The growing use of forensic science in criminalistics resulted, in practice, in the need that the parties in criminal procedure, particularly the defendant and the injured party (acting as a prosecutor), increasingly hire experts as consultants. With the introduction of the concept of prosecutorial and police investigations in criminal procedure in the Republic of Serbia, it is evident that assistance based on the knowledge from different fields and disciplines of science, technology, arts or crafts is essential to the public prosecutor. There is also no doubt that the subsidiary prosecutor, defense counsel and the defendant increasingly needed such assistance. The amendments to the Criminal Procedure Code introduced the concept of an expert advisor. Modeled after similar solutions in comparative law, the expert advisor has wider options when it comes to helping the parties in the proceedings. Participation of expert advisors can realistically contribute to the quality of professional expertise in court proceedings, in order not to miss important details relevant to the proceedings as a whole. In this paper, the authors deal with the status of experts in criminal proceedings in the Republic of Serbia. The form and content of their expert assistance deserves further analytical analysis and critical examination.
AB  - Sve izraženija primena forenzičkih disciplina u kriminalistici rezultirala je potrebom da krivično-procesne stranke, a naročito okrivljeni i oštećeni kao tužilac, u praksi sve češće angažuju stručna lica kao konsultante. Sa uvođenjem tužilačko-policijskog koncepta istrage u krivičnu proceduru u Republici Srbiji Srbiji, evidentno je da se pomoć bazirana na poznavanju različitih struka i disciplina nauke, tehnike, umetnosti ili zanata ne može poreći ni javnom tužiocu. Nesporno je, takođe, da je takva pomoć sve potrebnija i oštećenom kao tužiocu, braniocu i okrivljenom. Izmenama Zakonika o krivičnom postupku (2014) uvodi se stručni savetnik koji po ugledu na slična rešenja u uporednom pravu ima šire mogućnosti kada je u pitanju pomoć stranci. Učešće stručnog savetnika realno može doprineti da veštačenje bude temeljnije obavljeno, tj. da ne promaknu važni detalji od značaja za postupak u celini. U ovom radu autori se bave statusom stručnih lica u krivičnom postupku čija forma i sadržina pružanja stručne pomoći zaslužuju dodatno analitičko sagledavanje i kritičko preispitivanje.

Disciplinary sanctions for police officers in Croatia and in Serbia

AB  - The authors in the paper give a review and a description of legally proscribed disciplinary punishments for police officers in the legislations of the Republic of Croatia and the Republic of Serbia. With certain institutes the authors give the point of view of legal doctrine and case law, and the statistical data. In the introduction the terms police officer and disciplinary responsibility are defined, and the purpose of disciplinary punishments is explained, as the authors point out that imposing punishments ensures proper functioning of the service, and the effect of the punishment has a special and general prevention. Following are legal provisions which regulate obligations of police officers and the rules for determining their responsibility for violations of official duty. In the chapter on disciplinary punishments the term disciplinary punishment is defined, and afterwards particular punishments for certain minor or severe violations of official duty are listed and described. The authors point out the punishment of conditional termination of civil service, which is imposed for particularly severe violations of official duty, when it makes sense to give the police officer one last chance to improve their behaviour and attitude towards the official duty. The following chapter describes the rules for determining disciplinary punishments, competent persons and deadlines for the execution of disciplinary measures, as well as the deadlines and reasons for deleting the executed disciplinary sanctions from the files of the police officers. After the analysis and comparison of the legal solutions in both countries, in the conclusion the authors give a critical review of the existing legislation and solutions for their improvement as refinements of existing and prescribing additional disciplinary sanctions for police officers, as well as proscribing disciplinary sanctions for the retired police officers. Thus the authors note that by proscribing two punishments for minor and six for severe violations of official duty in Croatia, and two punishments for minor and five for severe violations of official duty in Serbia, the legislators enabled individualization of sanctioning for particular violations and violators; however, they suggest also proscribing other disciplinary measures for the purpose of individualization of punishing. The authors propose proscribing the possibility of punishing retired police officers for violations committed while they were in the service, which would be modelled on the German Federal Disciplinary Law. Furthermore, they point out that it is not clear what purpose would be achieved in the Croatian law by imposing a punishment of relocating to another position with the same complexity of work, as well as suggest changing disciplinary punishment of prohibiting professional promotion and advancement in the service into the legal consequences of disciplinary punishments for police officers in Croatia, according to the Croatian Law on Civil Servants.
AB  - Autori u radu daju prikaz i opis zakonom propisanih disciplinskih mera za policijske službenike u pravu Republike Hrvatske i Republike Srbije. Uz pojedine institute autori iznose stavove pravne doktrine, sudske prakse i statističke podatke. U uvodnom delu definišu se pojmovi policijskog službenika, disciplinske odgovornosti i obrazlaže svrha disciplinskog kažnjavanja. U poglavlju o disciplinskim merama određuje se pojam disciplinske mere, a zatim se navode i opisuju mere za lake i teške povrede službene dužnosti u hrvatskom i srpskom zakonodavstvu. U narednom poglavlju autori opisuju pravila za odmeravanje, izvršenje i brisanje disciplinskih mera. Nakon analize i upoređenja zakonodavnih rešenja u ovim državama, u zaključku autori daju kritički osvrt na postojeće zakonodavstvo i pojedine predloge za unapređenje u smislu preciziranja postojećih i propisivanja dodatnih disciplinskih mera za policijske službenike.

AB  - International police and other cooperation is a necessity of the modern world and imperative for the survival of human civilization. The goal of cooperation is that states and the international community unite in opposing crime as the greatest peacetime evil in the world. This is particularly in relation to organized crime, terrorism, and corruption and other most serious forms of crime in contemporary society. Cooperation takes place at the bilateral, regional and multilateral levels. Bilateral cooperation mainly has a trans-border character of neighboring countries, while the regional cooperation between states within certain areas such as the SEE region (Western Balkan) or Europe (e.g. Europol). Multilateral cooperation is mainly on a broader level, e.g. in the field of combating terrorism or through universal organizations (e.g. Interpol). International police cooperation in Europe has a long tradition. One part takes place today in this area through the OSCE, with the caveat that this is a global organization that deals with security issues. The Council of Europe is the next organization through which co-operation began in the past and is partly carried out to this day, given that it brings all European countries together (except Belarus). Cooperation is more intensive still throughout the European Union, its forerunners, the current forms of the organization and present mechanisms (EAW- European surrender and arrest warrant).53 The cooperation in the EU, that takes place through Europol as a specialized agency of the Union is especially current, but with minimal operational competencies. In the SEE region, a significant cooperation between countries of the former Yugoslavia and countries in its neighborhood has been achieved. This cooperation is not only based on bilateral and multilateral acts, but primarily regional documents of which the most important are the International Convention on Police Cooperation in SEE and SELEC Convention. According to these and other acts, all the countries in the region have taken part in regional cooperation, since the fight against crime is the common interest of all. This applies in particular to organized crime, terrorism, corruption and other most serious forms of crime. Extremely important shapes, forms and mechanisms of international police cooperation are: exchange of information, joint investigation teams, joint operational actions, liaison officers, contact points, regional centers for police and customs cooperation, joint police stations and others. To recap, international police cooperation in the world today is an expression of anti-criminal solidarity between states and its prospects are clear, because the danger of crime is global and requires a harmonized response at the international level.
AB  - U radu se obrađuje važno pitanje međunarodne policijske saradnje u regionu JIE u funkciji bezbednosti u Evropi, sa naglaskom na status i ulogu Republike Srbije. U funkciji teme je dat kratak osvrt na pravne izvore, vidove i oblike međunarodne policijske saradnje. AB  - This paper deals with us a little-known phenomenona of in­surance fraud which eventually became a real 'hit' in the countries in transition, as is the case in recent years with us. The first section lists the concept, elements and characteristics of fraud in insurance primarily with the crimi­nal justice aspect to the current Criminal code Republic of Serbia. The cen­tral part of the paper addresses the issue of insurance fraud in the territory of the RS and it lists the most important forms, such as improper medical diag­nosis, rigging traffic accidents, agreed car theft, inflated invoices for repairs, later calling the police, fraud in area of property insurance and others. Next follows the statistics insurance fraud and the RS for the period 2010 - 2013 years, the analysis of the structure of registered persons and the relationship to corruption offenses. The final part includes measures and recommenda­tions for the control and prevention of insurance fraud.
AB  - U radu se obrađuje kod nas malo poznati fenomen prevara u osiguranju koje su vremenom postale pravi 'hit' u zemljama u tranziciji, a što je u poslednje vreme slučaj i kod nas. U prvom delu se navode pojam, elementi i karakteristike prevare u osiguranju sa krivično-pravnog aspekta i prema KZ. Centralni deo rada obrađuje pitanje prevara u osiguranju na teritoriji Republike Srbije i navode se najvažniji pojavni oblici: nepravilne lekarske dijagnoze, lažiranje saobraćajnih nezgoda, dogovorena krađa automobila, preuveličani računi za popravke, naknadno pozivanje policije, prevare u oblasti imovinskog osiguranja i dr. Dalje sledi statistika prevara u osiguranju na teritoriji PC za period 2010-2013. godina, analiza prema strukturi prijavljenih lica i odnos sa koruptivnim krivičnim delima. Završni deo rada obuhvata mere i preporuke za suzbijanje i prevenciju prevara u osiguranju.

AB  - The aim of this paper is to present the scientific basis of Special Physical Education and the necessity of applying knowledge, abilities and skills which are developed in police. Special Physical Education (SPE) is studied on all levels of police education, training and improvement in the Republic of Serbia. According to the scientific nomenclature, it is a part of police sciences, actually the group of special police sciences. As a teaching discipline it belongs to the group of narrowly professional subjects, whereas at police colleges it is one of the main subjects. Education and training in SPE is based on science, scientific methods and police practice, and together with other scientific disciplines contributes to the development of personal integrity and professional capacity of each police officer, by involving specially designed educational training programs. Educational training programs and materials of SPE are designed in such a way that in relation to similar teaching subjects of they contribute to the development of personal integrity and capacity of police officers, and it’s a good recommendation for all colleges and police institutions both in Europe and the World.

AB  - The novels of the Criminal Procedure Code (CPC) Republic of Serbia have introduced the concept of prosecutorial investigation in relation to that of evidence, special evidentiary actions and other software for the operation of the criminal prosecution. The meaning of novels is to conduct harmonization of standards with solutions of modern criminal law practice, particularly with regard to EU standards Serbia applying for membership in the Union. Preventing the most serious forms of crime is the focus of authorized bodies Serbia and in this context combating and preventing all forms of forgery, as is the case with forgeries frescoes and selling them on the world market. In exposed paper the method determining age of the frescoes is proposed. It is based on the use of closed Markov's graphs with three cells. The measurements of contents of water molecules in surrounding area can be done only for the space in which the frescoes is located. This means that followed exposed method is non destructive.
AB  - Novele o krivičnom postupku (ZKP) Republike Srbije imaju uvodni koncept tužilačke istrage u vezi sa ovim dokazima, posebne dokazne radnje i drugi softver za funkcionisanje krivičnog gonjenja. Značenje novela je da sprovede usklađivanje standarda sa rešenjima savremenog krivičnog zakona u praksi, posebno u vezi sa standardima EU Srbije, koja se prijavljuje za članstvo u Uniji. Sprečavanje najozbiljnijih oblika kriminala je fokus nadležnih organa Srbije i u tom kontekstu je sprečavanje i borba protiv svih oblika falsifikata, kao što je slučaj sa falsifikatima fresaka i umetničkih slika i njihova prodaja na svetskom tržištu. U izloženom radu je predložen metod određivanja starosti fresaka. On se zasniva na korišćenju zatvorenih Markovljevih grafova sa tri ćelije. Merenja sadržaja molekula vode u okolini može se uraditi samo za prostor u kome se nalaze freske. To znači da je sledeći izloženi metod koji se koristi - nedestruktivan.

The police in the protection of human rights and civil liberties

AB  - Human rights and civil liberties are the achievements of human civilization and development of the society, which are accepted by all progressive and democratic states as an integral part of the international legal order. In countries with a parliamentary tradition, with the separation of powers and control mechanisms, human rights and civil liberties are a category of primary importance. In accordance with contemporary requirements, a process of social transformation and reform of the police and security services was initiated in Serbia at the end of the twentieth century. The main objectives of the reform of the security sector are depoliticization, debureaucratisation, decriminalization and professionalization. In terms of operational organization and models of the Serbian Ministry of Interior, a universal model of 'Community Policing' was accepted, which centers on a safe community. Police Act and by-laws are largely harmonized with the EU and international standards. The regulations and the rules everyday conduct of the police emphasize the principle of legality in the work, the protection of human rights and civil liberties, and the affirmation of the rule of law principle.
AB  - Ljudska prava i građanske slobode tekovina su ljudske civilizacije i razvoja društva, koje kao integralni deo međunarodnog pravnog poretka prihvataju sve progresivne i demokratske države. U zemljama sa parlamentarnom tradicijom, podelom vlasti i mehanizmima kontrole, ljudska prava i građanske slobode su par excellence kategorija od prvorazrednog značaja. U skladu sa zahtevima savremenog trenutka u Srbiji je krajem XX veka pokrenut proces društvenih reformi i transformacije policije, službi bezbednosti i unutrašnjih poslova. Najvažniji ciljevi reforme sektora bezbednosti su depolitizacija, debirokratizacija, dekriminalizacija i profesionalizacija. U pogledu organizacije i načina rada MUP RS prihvaćen je univerzalni model 'Community policing', u čijem je središtu bezbedna zajednica. Zakon o policiji i podzakonski akti u velikoj meri su harmonizovani sa normama EU i međunarodnim standardima. U propisima i svakodnevnom postupanju policije ističu se načelo zakonitosti u radu, zaštita ljudskih prava, građanskih sloboda i afirmacija principa vladavine prava.

In countries with a parliamentary tradition, with the separation of powers and control mechanisms, human rights and civil liberties are a category of primary importance. In accordance with contemporary requirements, a process of social transformation and reform of the police and security services was initiated in Serbia at the end of the twentieth century. The main objectives of the reform of the security sector are depoliticization, debureaucratisation, decriminalization and professionalization. In terms of operational organization and models of the Serbian Ministry of Interior, a universal model of 'Community Policing' was accepted, which centers on a safe community. Police Act and by-laws are largely harmonized with the EU and international standards. AB  - This paper presents solutions contained in the most recent amendments to the Law on the Police of the Republic of Serbia, with a special focus on the more important ones. In the first part, we have pointed to environmental and other factors that were relevant to the legal regulation of the security sector in our country, especially in times of transition and past events. The central part of the paper is devoted to the novelties of the RS Law on Police and in it first offers general remarks regarding the amendment, then the change in the area of international cooperation and police missions, organizations, police and labor law solution (employment status, rights and duties of the police and other employees of the RS MI). This is followed by a digression regarding the special collective agreement for police officers and complementary bylaws, operational implementation and interpretation of the provisions of the Police Act and adopted novelties. The final part gives a recapitulation of the adopted amendments with an emphasis on the legal conduct of the police, respect and protection of human and minority rights, civil liberties and other universal values.
AB  - U radu su izložena rešenja u vezi sa poslednjim izmenama i dopunama Zakona o policiji Republike Srbije, sa posebnim osvrtom na važnije novele. U uvodnom delu, u funkciji teme, ukazano je na ambijentalne i ostale činioce koji su bili od značaja za normativno uređenje sektora bezbednosti kod nas, posebno u vreme tranzicije i minulih događaja. Centralni deo referata je posvećen novelama Zakona o policiji i u njemu se najpre iznose generalne napomene povodom izmena i dopuna, zatim promene u delu međunarodne saradnje i policijskih misija, organizacije policije i radno-pravnih rešenja (radni status, prava i obaveze pripadnika policije i drugih zaposlenih u MUP RS). U kontinuitetu sledi digresija u pogledu Posebnog kolektivnog ugovora za policijske službenike i komplementarnih podzakonskih akata, u funkciji primene i tumačenja odredaba Zakona o policiji i usvojenih novela. U završnom delu je data rekapitulacija usvojenih izmena i dopuna sa akcentom na zakonito postupanje policije, poštovanje i zaštitu ljudskih i manjinskih prava, građanskih sloboda i ostalih univerzalnih vrednosti.

Some possibilities of predicting the selection of the line of study

AB  - In accordance with the omnipresent process of computerization of society, along with a permanent global economic crisis, there is a need for saving by avoiding wrong choices for study. It is the interest of both the students and high education institutions that high education be as successful as possible, hence the need for adequate selection of the line of study is almost inevitable. The aim of the paper is to show how modern mathematical - informational media can construct a model of prediction in the selection of the line of study. In order to achieve our aim we conducted a research in the Criminal Police Academy in Belgrade. By using classic regression analysis, they developed a model which instructs students how to choose one of three lines of study after the first year, based on individual achievements in subjects in the first year and overall average period of study. The results are presented in the paper.
AB  - U skladu s opšteprisutnim procesom informatizacije društva, uz permanentnu svetsku ekonomsku krizu, nameće se potreba uštede izbegavanjem izbora pogrešnog usmerenja studiranja. Interes je kako studenata, tako i visokoškolskih institucija da visokoškolsko obrazovanje bude što uspešnije, pa se stoga gotovo nužno javlja potreba za adekvatnim izborom smera studija. Cilj rada je da ukaže na mogućnost korišćenja savremenih mate- matičko-informatičkih sredstava kojima se realizuje jedan model predikcije u izboru smera studiranja. Radi realizacije ovog cilja sprovedeno je istraživanje na Kriminalističko-policijskoj akademiji u Beogradu na kojoj je primenom klasične regresione analize razvijen model koji daje studentima uputstva za izbor jednog od tri postojeća smera studiranja nakon prve godine studiranja, a na osnovu pojedinačnog uspeha postignutog iz predmeta na prvoj godini studija i ukupnog proseka studiranja. Rezultati tog istraživanja prezentovani su u ovom radu.

AB  - The uneven development and achieved degree of economy have negative consequences on the quality of the environment in Smederevo. The most endangered area is the industrial area of "Zelezara Smederevo" which directly threatens the city of Smederevo and a few settlements nearby, like Radinac, Ralja and Vranovo. Using a mathematical pattern the maximum low concentration of SO2 exhausted from the blast furnace of "Zelezara Smederevo" was calculated. The data from health statistics about prescribed medicine, the structure of diseases and the current information about the degree of endangered environment were used to illustrate the cause and effect relation between health condition and the influence of certain pollutants existing in the environment.

AB  - The main idea of this paper is to highlight the need for police training, which is conducted in educational institutions and organizational units of the Ministry of Internal Affairs of the Republic of Serbia (MoI RS), to devote adequate attention and to comprehensively investigate all their aspects. The work contains an introductory part which considers the basic problem and the current issues of police training in the country, a part which is related to the organization and the type of police training, followed by the presentation and interpretation of the methodology of its implementation, which was presented and performed on a coaching course II (contractor rate OSCE), and finally the concluding part.
AB  - Osnovna ideja rada je da ukaže na potrebu da se policijskoj obuci, koja se sprovodi u obrazovnim ustanovama i organizacionim jedinicama Ministarstva unutrašnjih poslova Republike Srbije (MUP RS), posveti adekvatna pažnja, odnosno da se svestranije izuče svi njihovi aspekti. Rad sadrži uvodni deo u kom se razmatraju osnovna problemska i aktuelna pitanja policijske obuke u našoj zemlji, deo koji se odnosi na organizaciju i vrste policijske obuke, zatim predstavljanje i interpretacija metodologije njenog izvođenja po modelu kojim se obučava Engleska policija, a koja je prikazana i izvedena na Kursu za trenere II (izvođač kursa OEBS) na Kriminalističko policijskoj akademiji u Beogradu, i na kraju zaključni deo.

AB  - Today, when most of humanity is in the information era of development of human society with predominantly present globalization, the necessary connection of money laundering as a criminal act and the tools for visualization as meaningful methods of criminal investigation is a hot topic of scientific and professional considerations and because of that the topic of the this paper. When it comes to finance, criminal activity could not be achieved without the use of computer technology, especially the part where the condition of processing large amounts of information in a short period. The computer proved to be a means to make the widest and most complex crimes such as robbery, fraud, financial fraud, espionage, terrorism and all forms of abuse. All this points to a recent (modern) form of committing criminal acts that characterize the properties of the dynamics and special forms forms and manifestations, and to the high-tech crime. On the end of this paper work on a specific case study considered the use of visualization tools for detection and analysis of money laundering and on this example proposed one possibly way of its using.
AB  - Danas kada je većina čovečanstva u informatičkoj epohi razvoja ljudskog društva sa dominantno prisutnom globalizacijom, nužna veza pranja novca kao kriminalnog događaja i vizualajzera kao svrsishodne metode kriminalističke istrage je aktuelna tema naučno-stručnog razmatranja i zato i predmet proučavanja ovog rada. Kada je u pitanju oblast finansija, kriminalna aktivnost se ne bi mogla ostvariti bez korišćenja kompjuterske tehnologije, naročito kod dela kod kojih je uslov obrada velikog broja informacija u kratkom periodu. Kompjuter se pokazao kao sredstvo kojim se mogu izvršiti najraznovrsnija i najsloženija krivična dela, kao što su: pljačke, pronevere, finansijske malverzacije, špijunaža, terorizam, kao i svi oblici zloupotreba. Sve ovo ukazuje na jedan noviji (savremeniji) oblik vršenja krivičnih dela koji karakterišu svojstva velike dinamike i posebnih formi pojavnih oblika i vidova ispoljavanja, a to je visokotehnološki kriminal. Na kraju ovog rada je na konkretnoj studiji slučaja razmotrena upotreba alata vizuelajzera u detektovanju i analizi pranja novca i na tom primeru predložen jedan od mogućih načina korišćenja.
