Legal status of persons employed in police

Abstract

The police used to include the whole field of interior administration, but today this term includes only one of the fields of state administration in the sphere of activity of which are the matters referring to the security of the state and its citizens, 'the organization, activities and control of which are, due to their specific nature, subjected to the additional ('special') legal system when compared with the legal regulations ('general') which are in force for other institutions of state administration.' (Slobodan Miletić, 2001). The specific nature of the police affairs is the reason for the specific nature of legal regulations related to their performance, which includes also as its element the specific nature of the status of persons performing the police activities, in addition to the elements of those regulations which are general for all branches (fields) of state administration. The specific nature of administrative work in the police is the reason why the position of persons working in the police is specific as well. Legal sources by which this position is regulated are numerous. On the other hand, not all the police personnel have the same authorizations, duties, rights and responsibilities, i.e. they do not have equal legal status.

Policija je nekada obuhvatala čitavo područje unutrašnje uprave, da bi se danas tim izrazom obuhvatilo samo jedno od područja državne uprave u čijem su delokrugu poslovi koji se odnose na bezbednost države i njenih građana 'čija su organizacija, delatnost i kontrola, zbog njihove osobenosti podvrgnuti i dopunskom ('posebnom') pravnom režimu u odnosu na ('opšti') pravni režim koji važi i za druge organe državne uprave' (Miletić Slobodan 2001). Posebnost poslova policije razlog je posebnosti pravnog režima za njihovo obavljanje, koje kao svoj element uključuje i posebnost pravnog položaja lica koja obavljaju delatnost policije, pored elemenata tog režima koji su opšti za sve grane (resore) državne uprave. Posebnost upravnog rada u policiji razlog je posebnostima u položaju lica u policiji. Pravni izvori kojima je taj položaj uređen su nekoliki. S druge strane svi kadrovi u policiji nemaju jednaka ovlašćenja, dužnosti, prava i odgovornosti, tj nemaju jednak pravni položaj.
