Uloga policije u sprovođenju mere bezbednosti “zabrana prisustvovanja određenim sportskim priredbama”

Abstract

The Law Amending the Criminal Code of the Republic of Serbia of 2009 has introduced for the first time safety measure “Ban on Attendance at Certain Sporting Events”

in Serbian criminal sanctions system. 32 Ratio legisof the legislator was efficient and intense fight against violence at sporting events. A six-year time distance is sufficiently long

to be able to analyse this measure’s effects – advantages and disadvantages. The question

is whether the legislator has managed to prevent and combat future violent offences and

misconducts at sporting events and other public gatherings.This measure is imposed on a criminal offender who has committed the offense related to violence at sporting events, if that is necessary to protect general safety. Protective measure with the same title, but on

the basis of the Law on Misdemeanours 33 , may be issued by a misdemeanour court judge (Article 52 of the Lawon Misdemeanours). It is imposed on offender who has committed an offense in the area of the Law on Prevention of Violence and Misbehaviour at Sporting Events. 34 The internal affairs authorities (the police) are the state body competent to supervise the implementation of these judicial measures.

In this paper, the author will analyse in which way the above mentioned measures are being implemented in Valjevo Police Department and judiciary, that is, whether new legal regulations are contributing to greater safety of participants at sporting events.
