Међународни стандарди о насиљу у породици и њихова примена у Републици Србији : Инстанбулска конвенција

Abstract

Општа распрострањеност насиља у породици чини га глобалном појавом; стога, реч је о феномену који захтева свеобухватан приступ не само на локалном, већ и на националном и међународном нивоу. У последњих пар деценија насиље у породици постало је предмет о којем се све више дискутује у међународној заједници. Чак и Уједињене нације, највећа и најутицајнија светска организација, све чешће овај проблем стављају у фокус своје пажње, разматрајући га и установљујући обавезе и препоруке које треба да поштују државе чланице. Управо зато, и овај рад се бави анализом међународних стандарда о насиљу у породици са посебним акцентом на Истанбулску конвенцију која је, као први регионални документ у овој области утицала на редефинисање националног законодавног оквира у Републици Србији и допринела усвајању првог закона који се бави искључиво проактивним одговором државе на проблем насиља над женама у породици и партнерским односима.

Violence against women is a widespread social problem rooted in the unequal distribution of resources and power between men and women, and institutionalized through laws, policies and social norms that grant preferential rights to men. Violence against women and girls is not just a story about unhealthy individuals, families or relationships, but about unhealthy social norms and often the damaging consequences of poverty. Part of the solution to such violence, therefore, lies in addressing the drivers of gender inequality and other forms of discrimination. Relevant factors include legislative, economic, and cultural structures, and legal, educational, workplace, family, religious, sports, media and other institutions that might fuel inequalities in womens and girls access to education and social and political participation. The general prevalence of domestic violence makes it a global phenomenon; therefore, it is a phenomenon that requires a comprehensive approach not only at the local, but also at the national and international level. In the last few decades, domestic violence has become a subject of increasing debate in the international community. Even the United Nations, the world's largest and most influential organization, is increasingly focusing on this issue, considering it and establishing obligations and recommendations that member states should respect. That is why this paper deals with the analysis of international standards on domestic violence with special emphasis on the Istanbul Convention, which, as the first regional document in this area, influenced the redefining of the national legislative framework in Serbia and contributed to the adoption of the first law. the state's response to the problem of violence against women in the family and partnerships.
