Полиција у немирнодопским и другим посебним безбедносним стањима

Abstract

Послове из своје законом утврђене надлежности, полиција извршава у веома различитим временским, просторним, политичким, економским, социолошким, безбедносним, правним и другим условима. Наглашено специфичне услове функционисања полиције, посебно у политичком, правном и безбедносном смислу, чине немирнодопска и друга посебна безбедносна стања, у која се најчешће убрајају ванредно и ратао стање. Упркос томе што полиција у тим стањима, суштински, наставља да обавља своје мирнодопске послове, њена улога и статус се, у њима, често не чине довољно јасним. На то посебно указује чињеница да се полиција, традиционално и с разлогом, сматра легалном „полувојном" или „паравојном" организацијом, али и чињеница да се полицијска организација често, више неосновано него основано, сматра саставним делом националних оружаних (војних) снага, посебно у ратном стању. Полазећи од тога, овим радом су презентовани резултати истраживања о утицају немирнодопских и других посебних безбедносних стања на промене у делокругу, организационој структури, овлашћењима и правном статусу полицијске организације и полицијских службеника, у контексту одредаба националног и међународног права

The paper is an effort to explore the impact of nonpeaceful and other special security situation in scope, organizational structure, powers and status of the police in these states. In the first part, as a special security conditions in which the police operate, there were identified, described and explained in brief: war (as international and non-international armed conflicts), emergency, emergency situation and civil unrest (internal disturbances and tensions). In the second part of the paper, there were analyzed the impacts of these conditions on the scope and organizational structure of the police. In this part, stands out for the police in any specific security tasks continue to carry out their everyday tasks by adapting to the changes its organizational structure, forms and methods. Police, at the same time, retains its status as civilian public service, and the police officers status as civilians under international humanitarian law. As an exception to this rule, in the second part of the paper, it is stressed ability (not a rule) that parts (not the whole) of the police organization, in accordance with the law temporarily (not permanently) are included in the composition of the armed forces, by which time police during international armed conflicts (not in other states security) becomes a military organization. In the third part of the paper analyzes the impact of special security status to changes in police powers and status of police officers. When it is pointed out that the police authorities in these states generally expanding, especially in the implementation of emergency regulations which limit the human and minority rights, which is why there is a strong need of controlling the legality of police officers. In this part of the paper highlights the fact that police officers retain civilian status at all times, except when they are part of the police units involved in the composition of the armed forces of a non-international armed conflict, when acquiring the status of a fighter with the ability to acquire the status of prisoner of war.
